But the order violates the Administrative Procedure Act (APA), according to a new lawsuit filed Friday by America First Policy Institute (AFPI).<\/p>\n<p>Biden <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/03\/07\/executive-order-on-promoting-access-to-voting\/\">signed<\/a> Executive Order 14019 in March of 2021, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-releases-list-of-president-trumps-accomplishments-and-it-is-historic\/\" title=\"White House Releases List of President Trump\u2019s Accomplishments \u2013  And It Is Historic!\">directing federal agencies<\/a> to develop plans to \u201cpromote voter registration and voter participation.\u201d As AFPI <a href=\"https:\/\/americafirstpolicy.com\/assets\/uploads\/files\/AFPI_v_Biden_One-Pager.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">pointed out<\/a>, \u201cthe only statutory authority it cites is the National Voter Registration Act which has never been interpreted as authorizing such action.\u201d The suit, <em>America First Policy Institute v. Biden<\/em>, was filed in the Northern District of Texas on behalf of AFPI, Republican Reps. Ronny Jackson and Beth Van Duyne of Texas, and Ohio Secretary of State Frank LaRose.<\/p>\n<div  class=\"fdrlst__b89e9-6ead5f7e7777b0bf7f028fe9893e0296 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-6ead5f7e7777b0bf7f028fe9893e0296\"><\/div>\n<p>The plaintiffs seek a preliminary and permanent injunction to stop the Biden administration from executing the order.<\/p>\n<p>\u201cThis [Executive Order] is a blatant and unlawful effort to use taxpayer money to help elect Democratic candidates, including President Joe Biden,\u201d the <a href=\"https:\/\/americafirstpolicy.com\/assets\/uploads\/files\/AFPI_v._Biden-1-Complaint_.pdf\">suit alleges<\/a>. \u201cFor instance, approach the U.S. Department of Agriculture\u2019s Rural Development program about a grant \u2014 get pushed to register to vote. Approach the Small Business Administration about a loan \u2014 get pushed to register to vote. Contact U.S. Department of Health and Human Services about Head Start \u2014 get pushed to register to vote. \u2026 And as shown below, all such efforts are impermissibly tailored toward persons who are likely to vote Democratic if they were to register.\u201d<\/p>\n<p>In Michigan, a key state to both Biden and former President Donald Trump\u2019s path to reelection, the Department of State <a href=\"https:\/\/www.michigan.gov\/sos\/resources\/news\/2024\/03\/20\/mdos-and-us-small-business-administration-announce-voter-registration-agreement\" target=\"_blank\" rel=\"noreferrer noopener\">signed<\/a> a memorandum of understanding with the U.S. Small Business Administration \u201cto promote civic engagement and voter registration in Michigan.\u201d During a House Committee on Small Business <a href=\"https:\/\/thefederalist.com\/2024\/06\/04\/hearing-federal-business-agency-spends-bidenbucks-to-win-michigan-for-democrats\/\">hearing<\/a>, Rep. Pete Stauber, R-Minn., noted that approximately 91 percent of Michiganders are registered to vote. So why, Stauber <a href=\"https:\/\/thefederalist.com\/2024\/06\/04\/hearing-federal-business-agency-spends-bidenbucks-to-win-michigan-for-democrats\/\">wondered<\/a>, did the <a href=\"https:\/\/thefederalist.com\/2024\/05\/16\/republicans-to-small-business-administration-on-bidenbucks-coverup-stop-stonewalling\/\">SBA<\/a> focus on Michigan rather than states with lower registration numbers if the executive order is meant to increase voter registration in a nonpartisan way?<\/p>\n<p>Pennsylvania lawmakers have also challenged Biden\u2019s order, arguing it violates the right of legislators to set the time, place, and manner in which an election shall be held.
