This amount is significantly higher than the $130,000 \u2063that former President Donald Trump was convicted of misreporting in business records during \u200dthe same campaign. The court found that Correct the Record, the super PAC, engaged in coordinated \u2062activities to support Clinton&#8217;s presidential campaign, including conducting\u2064 polls, hiring\u200d fact-checkers, and connecting\u2064 media \u2064surrogates with news outlets. Circuit Court of Appeals ruled Tuesday that the 2016 Hillary Clinton campaign and an affiliated super PAC violated federal election law in spending that totaled close to $6 million.<\/p>\n<p>The amount in question is more than 45 times the $130,000 a Manhattan court <a href=\"https:\/\/www.westernjournal.com\/trumps-right-scotus-step-stop-interference-new-york-2024-election\/\" target=\"_blank\" rel=\"noopener\">convicted<\/a> former President Donald Trump of misreporting in business records during the same 2016 campaign.<\/p>\n<p>It should be noted that the <a href=\"https:\/\/www.washingtonpost.com\/nation\/2021\/05\/06\/fec-trump-stormy-daniels-cohen\/\" target=\"_blank\" rel=\"noopener\">Federal Election Commission<\/a> and the Justice Department looked at the payments Trump made through his personal attorney at the time, Michael Cohen, to adult film star Stormy Daniels as part of a nondisclosure agreement and <a href=\"https:\/\/www.nytimes.com\/2023\/03\/31\/nyregion\/justice-dept-trump-indictment-charges.html\" target=\"_blank\" rel=\"noopener\">declined<\/a> to prosecute him.<\/p>\n<p>But Democrat Manhattan District Attorney <a href=\"https:\/\/www.westernjournal.com\/alvin-braggs-team-begs-judge-pile-even-punishment-trump\/\" target=\"_blank\" rel=\"noopener\">Alvin Bragg<\/a> chose to bring the case under New York law, bootstrapping the alleged FEC violation as an underlying crime to the state business record violations.<\/p>\n<p>The reimbursement payments made to Cohen were listed by the Trump organization as <a href=\"https:\/\/manhattanda.org\/district-attorney-bragg-announces-34-count-felony-indictment-of-former-president-donald-j-trump\/#:~:text=Manhattan%20District%20Attorney%20Alvin%20L,and%20after%20the%202016%20election.\" target=\"_blank\" rel=\"noopener\">legal expenses<\/a>. Bragg argued these payments made to Daniels initially by Cohen amounted to an illegal contribution to the Trump campaign.<\/p>\n<p>Regarding the Clinton campaign case, the <a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/8A979B82BC5A09C085258B5500561738\/%24file\/22-5336-2063669.pdf\" target=\"_blank\" rel=\"noopener\">D.C. Circuit found<\/a> the super PAC Correct the Record \u201cset out to engage in a wide range of coordinated activities to support Hillary Clinton\u2019s 2016 presidential campaign.\u201d<\/p>\n<p>\u201cIn an administrative complaint filed with the Federal Election Commission, nonprofit watchdog Campaign Legal Center alleges that Correct the Record spent close to $6 million in coordination with the Clinton campaign during the lead-up to the 2016 election, including to conduct polls, hire teams of round-the-clock factcheckers, and connect Clinton media surrogates with radio and television news outlets,\u201d the Court said.<\/p>\n<p>The three-judge panel noted that Correct the Record coordinated all these activities with Clinton\u2019s campaign.<\/p>\n<p>\u201cBut it characterized all of the committee\u2019s myriad expenditures \u2014 from staff salaries and travel expenses to the cost of commissioning polls and renting offices \u2014 as \u2018inputs\u2019 to unpaid communications over the internet. For that reason, neither Correct the Record nor the Clinton campaign designated any of Correct the Record\u2019s expenditures as contributions to the campaign,\u201d the ruling said.<\/p>\n<p>In other words, Correct the Record committed FEC \u201cbusiness record\u201d violations, if you will, by failing to properly account for money spent to help the Clinton campaign.<\/p>\n<p>The FEC had dismissed the complaint against the Clinton campaign and Correct the Record, citing an <a href=\"https:\/\/www.fec.gov\/updates\/internet-communications-and-activity\/#:~:text=An%20uncompensated%20individual%20or%20group,reporting%20requirements%20with%20the%20FEC.\" target=\"_blank\" rel=\"noopener\">internet exemption<\/a> had allowed them not to list the coordination between the two, but the D.C. Circuit Court found that decision was in error.<\/p>\n<p>\u201cWe hold that the Commission acted contrary to law in dismissing the complaint. Because we conclude that the internet exemption cannot be read to exempt from disclosure those expenditures that are only tangentially related to an eventual internet message or post, the Commission\u2019s reading of the internet exemption stretches it beyond lawful limits,\u201d the ruling read.<\/p>\n<p>\u201cAs to those expenditures that it deemed not to be covered by the internet exemption, the Commission acted contrary to law in dismissing the complaint for want of reason to believe the relevant expenditures were coordinated with the campaign, despite plausible allegations that Correct the Record coordinated all its expenditures with Hillary for America \u2014 and openly acknowledged doing so.\u201d<\/p>\n<p>They upheld a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/2021-border-patrol-agents-faced-historic-level-of-line-of-duty-deaths\/\" title=\"2021: Border Patrol Agents Faced Historic Level of Line-of-Duty Deaths\">federal district court\u2019<\/a>s ruling concluding the same and directed the FEC to conform its findings consistent with the judge\u2019s decision.<\/p>\n<p>In a separate matter, the Clinton campaign and the Democratic National Committee agreed in 2022 to pay $113,000 to settle an FEC investigation into alleged violations of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/google-expands-security-efforts-ahead-of-2022-elections\/\" title=\"Google Expands Security Efforts Ahead of 2022 Elections\">campaign finance law<\/a> in relation to funding the infamous Steele dossier during the 2016 race, according to the <a href=\"https:\/\/apnews.com\/article\/russia-ukraine-2022-midterm-elections-business-elections-presidential-elections-5468774d18e8c46f81b55e9260b13e93\" target=\"_blank\" rel=\"noopener\">Associated Press<\/a>.<\/p>\n<p>\u201cThe Clinton campaign hired <a href=\"https:\/\/www.westernjournal.com\/levin-clinton-obama-campaigns-committed-egregious-fec-violations-just-fines-imposed-no-prosecution\/\" target=\"_blank\" rel=\"noopener\">Perkins Coie<\/a>, which then hired Fusion GPS, a research and intelligence firm, to conduct opposition research on Republican candidate Donald Trump\u2019s ties to Russia. But on FEC forms, the Clinton campaign classified the spending as legal services,\u201d the AP said.<\/p>\n<p>That\u2019s interesting, because that\u2019s exactly the violation Bragg said the Trump Organization committed in relation to paying Cohen.<\/p>\n<p>The initial complaint, according to the AP, charged that \u201c[b]y intentionally obscuring their payments through Perkins Coie and failing to publicly disclose the true purpose of those payments,\u201d the campaign and DNC \u201cwere able to avoid publicly reporting on their statutorily required FEC disclosure forms the fact that they were paying Fusion GPS to perform opposition research on Trump with the intent of influencing the outcome of the 2016 presidential election.\u201d<\/p>\n<p>\u201cThe Clinton campaign and DNC had argued that the payments had been described accurately, but agreed, according to the documents, to settle without conceding to avoid further legal costs,\u201d the news outlet noted.<\/p>\n<p>Trump made the <a href=\"https:\/\/www.westernjournal.com\/watch-trump-sidesteps-judges-gag-order-reads-cnns-news-report-trial\/\" target=\"_blank\" rel=\"noopener\">same point<\/a> in relation to the payment for Cohen, but on stronger grounds. Cohen was his personal attorney at the time and in addition to paying the lawyer\u2019s fees, the money had gone to reimburse him for funds paid to Daniels as part of a non-disclosure agreement, i.e., a contract.<\/p>\n<p>How else was the Trump Organization accountant supposed to list the payment?<\/p>\n<p>So Clinton and the DNC pay an FEC administrative fine and the matter is done with, but Trump has to go through a six-week criminal trial and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-biden-plea-mccarthy-says-deal-may-enhance-house-investigations\/\" title=\"McCarthy suggests Hunter Biden&#039;s plea could bolster House investigations.\">faces potential jail time<\/a>.<\/p>\n<p>And Democrats wonder why they\u2019re accused of overseeing a two-tiered system of justice.<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>I heard a chilling comment the other day: \u201cWe don\u2019t even know if an election will be held in 2024.\u201d <\/span><\/i><\/p>\n<p><i><span>That wasn\u2019t said by a conspiracy theorist or a doomsday prophet.
