The outlet said that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-urges-lawmakers-to-extend-eviction-ban-as-delta-variant-cases-increase\/\" title=\"Biden Urges Lawmakers To Extend Eviction Ban As Delta Variant Cases Increase\">ruling stated<\/a> that there is a \u201cpresumption that they have immunity for their official acts more broadly.\u201d<\/p>\n<p><span>A <\/span><a href=\"https:\/\/www.huffpost.com\/entry\/supreme-court-immunity-trump-biden-assassinate_n_66831f73e4b06575b36641d8?d_id=7846687&#038;ncid_tag=tweetlnkushpmg00000067&#038;utm_medium=Social&#038;utm_source=Twitter&#038;utm_campaign=us_main\"><span>HuffPost<\/span><\/a><span>  article claims President Joe Biden could kill Trump and be have full immunity for prosecution.<\/span><\/p>\n<div id=\"attachment_8159842\">\n<p id=\"caption-attachment-8159842\">Huff Post\/Screenshot<\/p>\n<\/div>\n<p>The article is titled \u201cSupreme Court Gives Joe Biden The Legal OK To Assassinate Donald Trump.\u201d It claims that Biden could \u201ctheoretically\u201d order for Trump to be killed and not be criminally prosecuted for it. The article cites Supreme Court justice Sonia Sotomayor\u2019s <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-939_e2pg.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">dissent<\/a> in the case.<\/p>\n<p>\u201cOrders the Navy\u2019s Seal Team 6 to assassinate a political rival? Immune. Organizes a military coup to hold onto power? Immune. Takes a bribe in exchange for a pardon? Immune. Immune, immune, immune,\u201d Sotomayor wrote.<\/p>\n<p>Check Your Fact reached out to multiple law experts to gain more insight into whether or not a president would be able to get immunity for assassinating his political rival.<\/p>\n<p><a href=\"https:\/\/www.uclawsf.edu\/people\/zachary-price\/\"><span>Zachary Price<\/span><\/a><span>, a professor at the University of California College of the Law, believes immunity for an assassination is possible. <\/span><\/p>\n<p><span>\u201cThe majority opinion could make the President at least presumptively immune from criminal liability for an assassination to the extent that ordering it was an \u2018official act,\u2019 meaning an exercise of presidential powers, rather than personal misconduct,\u201d Price said <\/span><span>in an email to Check Your Fact. He added that such immunity would not extend to any subordinates that helped carry out the crime. <\/span><\/p>\n<p><a href=\"https:\/\/www.lawschool.cornell.edu\/faculty-research\/faculty-directory\/michael-dorf\/\"><span>Michael C. Dorf<\/span><\/a><span>, a professor at Cornell Law School, believes that, while the act would still be illegal from a technical standpoint, the potential to order military to conduct such an act complicates things. <\/span><\/p>\n<p><span>\u201cIt would still be illegal but there\u2019s a decent argument (made by Justice Sotomayor in dissent and not refuted by the majority) that if Biden ordered the military to do so, he couldn\u2019t be prosecuted for it,\u201d Dorf said <\/span><span>in an email to Check Your Fact. Dorf, too, added that anyone who helped carry out the act could be prosecuted, but also said that they could be pardoned by the president. <a href=\"https:\/\/checkyourfact.com\/2024\/07\/08\/fact-check-fact-checking-bidens-claim-that-trump-referred-to-veterans-as-suckers-and-losers\/\" target=\"_blank\" rel=\"noopener noreferrer\">(<b>Fact-Checking Biden\u2019s Claim That Trump Referred To Veterans As \u2018Suckers And Losers\u2019)<\/b><\/a><\/span><\/p>\n<p><a href=\"https:\/\/cjrc.osu.edu\/people\/dressler.11\" target=\"_blank\" rel=\"noopener noreferrer\">Joshua Dressler<\/a>, a law professor at the Ohio State University, also told Check Your Fact that \u201cby my reading, if a President orders the military to kill a person, including an American citizen, [they] would have full immunity.\u201d<\/p>\n<p>\u201c<span>And, because Chief Justice Roberts stated that it is impermissible to consider a President\u2019s motive for his actions, it is legally irrelevant whether the President is acting to protect national security or kill someone he doesn\u2019t like,\u201d Dressler said. <\/span><\/p>\n<p>Some legal experts have said Sotomayor is exaggerating, according to <a href=\"https:\/\/www.cbc.ca\/news\/world\/scotus-seal-team-six-analogy-analysis-1.7256053\" target=\"_blank\" rel=\"noopener noreferrer\">CBC<\/a>. However, Harold Hongju Koh, a Yale Law School professor, told the outlet that if the law is read at value, it\u2019s true that it would provide such immunity, but added that the majority justices did not intend to address this issue.<\/p>\n<p><span><a href=\"https:\/\/www.law.buffalo.edu\/faculty\/facultyDirectory\/FinleyLucindaM.html\" target=\"_blank\" rel=\"noopener noreferrer\">Lucinda Finley<\/a>, a professor at University of Buffalo School of Law, told Check Your Fact that she believes the president receiving immunity for murder is \u201cpossible but unlikely.\u201d<\/span><\/p>\n<p><span>\u201cAs for ordering the assassination of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-russias-instability-could-throw-off-xi-jinpings-taiwan-invasion-timeline\/\" title=\"Russia&#039;s instability may disrupt Xi Jinping&#039;s plans to invade Taiwan.\">domestic political rival<\/a>, that could be considered an \u201cunofficial act\u201d related to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/battle-stations-msnbc-analyst-says-if-republicans-win-theyll-cancel-elections-impeach-biden-weekly\/\" title=\"\u2018Battle Stations!\u2019: MSNBC Analyst Says If Republicans Win They\u2019ll Cancel Elections, Impeach Biden Weekly\">personal political interest<\/a>. But there would have to be an extensive evidentiary hearing to determine whether the President was acting as a candidate or as commander in chief,\u201d Finely said. <\/span><\/p>\n<p>Former Attorney General Bill Barr dismissed Sotomayor\u2019s examples as \u201chorror stories,\u201d according to <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4750625-bill-barr-supreme-court-immunity-ruling\/\" target=\"_blank\" rel=\"noopener noreferrer\">The Hill<\/a>.<\/p>\n<p>\u201c[The president] has the authority to direct the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/president-trump-please-pardon-jon-woods-a-victim-of-process-crimes-like-michael-flynn\/\" title=\"President Trump, Please Pardon Jon Woods, a Victim of Process Crimes Like Michael Flynn\">justice system<\/a> against criminals at home. He doesn\u2019t have authority to go and assassinate people,\u201d Barr said. \u201cSo, whether he uses the SEAL team or a private hit man, it doesn\u2019t matter; it doesn\u2019t make it a carrying out of his authority.
