Anna Paulina Luna, R-Fla., introduced the resolution to hold Garland in \u201cinherent contempt\u201d over the attorney general\u2019s refusal to release audio tapes of President Joe Biden\u2019s interviews with Special Counsel Robert Hur. Luna released a statement immediately after the vote to announce she refiled the motion to fine Garland $10,000 per day until the tapes are made public.<\/p>\n<p>\u201cToday\u2019s vote on my inherent contempt resolution and the legislative appropriations bill did not pass due to some Republican absences,\u201d Luna said. \u201cI have refiled the resolution and will be calling it up again in a couple of weeks when Congress is back in session and Members return.\u201d<\/p>\n<p>The contempt vote failed 204 to 210, with four Republicans voting with Democrats against the resolution. Those Republicans were Reps. Tom McClintock and John Duarte of California, and Mike Turner and David Joyce of Ohio.<\/p>\n<p>Rep. Brian Mast of Florida wrote on X that he missed the vote to attend his father\u2019s funeral. \u201cOtherwise, I would have voted to hold Merrick Garland in inherent contempt of Congress,\u201d Mast wrote. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>I missed this vote because I am en route to my father\u2019s funeral. Brian Mast (@RepBrianMast) <a href=\"https:\/\/twitter.com\/RepBrianMast\/status\/1811423068759441687?ref_src=twsrc%5Etfw\">July 11, 2024<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>In February, Hur wrapped up a federal investigation into the president\u2019s mishandling of classified material by <a href=\"https:\/\/thefederalist.com\/2024\/02\/08\/prosecutors-decline-to-charge-elderly-biden-over-poor-memory\/\" target=\"_blank\" rel=\"noreferrer noopener\">concluding <\/a>the 81-year-old commander-in-chief was too senile to face felony charges. <\/p>\n<p>\u201cBased on our direct interactions with and observations of him, he is someone for whom many jurors will want to identify reasonable doubt,\u201d Hur\u2019s team wrote in the nearly 400-page report. \u201cIt would be difficult to convince a jury that they should convict him \u2014 by then a former president well into his eighties \u2014 of a serious felony that requires a mental state of willfulness.\u201d<\/p>\n<p>Biden apparently struggled to recall when he was vice president, forgot the timeline of his son\u2019s death \u201ceven within several years,\u201d and had a \u201chazy\u201d recollection \u201cwhen describing the Afghanistan debate that was once so important to him.\u201d<\/p>\n<p>More lapses in the president\u2019s memory were on display at the snap-White House press conference delivered upon the Hur report\u2019s immediate release when Biden accused the special counsel of raising the topic of Beau Biden\u2019s death.<\/p>\n<p>\u201cHow in the hell dare he raise that?\u201d Biden said in an angry tirade. The transcripts, however, <a href=\"https:\/\/thefederalist.com\/2024\/03\/12\/hur-transcripts-show-another-lapse-in-bidens-memory-at-white-house-press-conference\/\" target=\"_blank\" rel=\"noreferrer noopener\">show<\/a> Biden was the one who brought up the topic.<\/p>\n<p>While the transcripts of the president\u2019s October interviews with Hur have been made public, the audio recordings remain concealed by the Department of Justice. House Republicans on the Judiciary Committee under Chairman Jim Jordan, R-Ohio, <a href=\"https:\/\/thehill.com\/homenews\/house\/4750196-house-gop-lawsuit-garland-biden-hur-audio\/\" target=\"_blank\" rel=\"noreferrer noopener\">sued <\/a>the department last week to compel the agency\u2019s release of the audio.<\/p>\n<p>Biden\u2019s cognitive decline was put on public display last month in CNN\u2019s televised debate between the White House incumbent and former President Donald Trump. Biden appeared frail and forgetful on stage and <a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/biden-quips-almost-fell-asleep-onstage-debate-rcna160075\" target=\"_blank\" rel=\"noreferrer noopener\">said later<\/a> at a campaign fundraiser that he \u201calmost fell asleep\u201d during the primetime event.<\/p>\n<figure><\/figure>\n<p>The catastrophic performance from the president triggered a panic among many within the Democrat Party to replace the presumptive nominee just months before the November election. On Thursday, Axios <a href=\"https:\/\/www.axios.com\/2024\/07\/10\/schumer-biden-dump-donors-2024-election\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> Democrat Senate Majority Leader Chuck Schumer of New York is now \u201copen to dumping Biden in 2024.\u201d<\/p>\n<p>\u201cIn public, Schumer has been insistent that he is \u2018for Joe.\u2019 In private, he\u2019s singing a different tune,\u201d Axios reported. \u201cThe majority leader is one of several Democrats, including former President Obama and former House Speaker Nancy Pelosi, who has the political and personal standing to convince Biden to step aside.
