Statehood Is A Democrat Power Grab\">constitutional problem<\/a>,\u201d Fox News contributor Byron York said on \u201cFox &#038; Friends\u201d Wednesday, according to <a href=\"https:\/\/www.newsweek.com\/donald-trump-marco-rubio-florida-vice-president-2024-election-1923281\" target=\"_blank\" rel=\"noopener\">Newsweek<\/a>.<\/p>\n<p>\u201cWhich is the 12th Amendment,\u201d he continued. \u201c[It] prohibits the state\u2019s electors from voting for both the president and the vice president from that same state.\u201d<\/p>\n<p>York added: \u201cSo, for Rubio to be on the ticket and for Trump to and Rubio to be able to win Florida\u2019s electoral votes, one of them would have to move out of Florida, which is kind of an awkward situation if you\u2019re the senator from Florida.\u201d<\/p>\n<p>While Rubio may carry a tiny bit of name recognition and support to Trump\u2019s campaign, whatever he brings will be grossly outweighed by the loss of Florida\u2019s 30 electoral votes.<\/p>\n<p>As <a href=\"https:\/\/www.politifact.com\/article\/2024\/may\/07\/a-donald-trump-marco-rubio-ticket-here-are-the-obs\/\" target=\"_blank\" rel=\"noopener\">PolitiFact<\/a> notes, Article II of the Constitution, under proscriptions from the 12th Amendment, also details the restriction.<\/p>\n<p>Trump, a lifelong resident of New York, <a href=\"https:\/\/www.westernjournal.com\/lifelong-new-yorker-donald-trump-officially-moves-primary-residence-state\/\" target=\"_blank\" rel=\"noopener\">moved his primary residence to Florida<\/a> in 2019.<\/p>\n<p>\u201cI cherish New York, and the people of New York, and always will,\u201d Trump wrote in 2019, \u201cbut unfortunately, despite the fact that I pay millions of dollars in city, state and local taxes each year, I have been treated very badly by the political leaders of both the city and state. Few have been treated worse.<\/p>\n<p>\u201cI hated having to make this decision, but in the end it will be best for all concerned.\u201d<\/p>\n<p>According to PolitiFact, if Trump truly wants Rubio as a running mate, there are a few options for the pair to clear the constitutional hurdle.<\/p>\n<p>As Dick Cheney moved his residency from Texas to Wyoming so he could run alongside George W. Bush in 2000, so Rubio could give up his seat in the Senate and abandon the Sunshine State to become Trump\u2019s running mate.<\/p>\n<p>Rubio is otherwise set to hold his Senate seat until early 2029.<\/p>\n<p>The legal dance of shifting his residence and handling the departure from the Senate would not create a guaranteed win for Trump, meaning this gamble might be too risky to even consider.<\/p>\n<p>If <a href=\"https:\/\/www.westernjournal.com\/biden-campaign-scrambles-make-excuse-trump-calls-bluff-golf-challenge\/\" target=\"_blank\" rel=\"noopener\">Donald Trump<\/a> wants Marco Rubio on the ticket, that\u2019s his prerogative.
