The DOJ argued that despite a recent Supreme Court ruling narrowing the scope of certain charges, prosecutors can still pursue cases like Tara Stottlemyer&#8217;s. Justice Ketanji Brown Jackson sided with five conservative justices, while Justice Amy Coney Barrett aligned with two liberal justices on the decision.<\/p>\n<p>Jackson, however, wrote a concurring opinion that some have <a href=\"https:\/\/www.washingtonpost.com\/opinions\/2024\/07\/01\/fischer-kbj-prosecutions\/\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a> created a road map for prosecutors to keep their cases intact.<\/p>\n<p>Prosecutors put Jackson\u2019s words to use in Stottlemyer\u2019s case, citing the liberal justice in their response to Stottlemyer to argue the defendant still may have violated the obstruction of an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/i-researched-judicial-ethics-rules-for-years-heres-why-the-alito-recusal-calls-are-ridiculous\/\" title=\"After Extensive Research, Why Demanding Alito&#039;s Recusal Seems Absurd\">official proceeding statute<\/a> under the Supreme Court\u2019s more narrowed view that the charge had to involve tampering with physical records.<\/p>\n<p>\u201c\u2018And it might well be that Fischer\u2019s conduct, as alleged here, involved the impairment (or the attempted impairment) of the availability or integrity of things used during the January 6 proceeding,&#8217;\u201d prosecutors wrote, quoting from Jackson\u2019s opinion.<\/p>\n<p>In several cases involving the obstruction charge, the DOJ has recently <a href=\"https:\/\/www.washingtonexaminer.com\/news\/3071487\/doj-plots-path-forward-supreme-court-setbacks\/\" target=\"_blank\" rel=\"noopener\" title>asked<\/a> federal judges in Washington, D.C., for a month or two of extra time to develop a response to defendants\u2019 arguments that they were improperly charged.<\/p>\n<p>The department had asked for 60 days of extra time in Stottlemyer\u2019s case, but Judge Timothy Kelly determined that was excessive, resulting in prosecutors filing their first response to Stottlemyer by the judge\u2019s deadline of Tuesday.<\/p>\n<p>Stottlemyer pleaded guilty in 2022 to one charge of obstructing an official proceeding, admitting that she illegally entered the Capitol, wandered into then-House Speaker <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/Nancy-Pelosi\/\" target=\"_blank\" rel=\"noopener\" title>Nancy Pelosi<\/a>\u2019s (D-CA) suite and the Senate Chamber, and rifled through senators\u2019 papers. She was sentenced to eight months in prison and two years of probation.<\/p>\n<p>She served her prison sentence already and is now under home detention and GPS monitoring and allowed to leave her home for work on her farm 60 hours per week. Her attorney argued that in addition to her charge and sentence being vacated, the court should also modify her current sentence to get rid of the GPS monitoring so that she can come and go to work freely for as many hours as she needs.<\/p>\n<p>Prosecutors wrote that they would allow her to leave her home for up to 16 hours per day, but that her probation stipulations should otherwise remain as they were.<\/p>\n<p>\u201cDefendant contends that [factors] have now changed given the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\" target=\"_blank\" rel=\"noopener\" title>Supreme Court<\/a>\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/kevin-mccarthy-calls-on-pentagon-to-restore-nsa-general-counsel-michael-ellis-to-active-service\/\" title=\"Kevin McCarthy Calls on Pentagon to Restore NSA General Counsel Michael Ellis to Active Service\">recent decision<\/a> in <em>Fischer<\/em>,\u201d prosecutors wrote. \u201cThe government disagrees. Given the remand to the Circuit and the ongoing litigation in <em>Fischer,<\/em> the government is still evaluating <em>Fischer\u2019s<\/em> impact on this and other January 6 cases.
