The decisions challenged the authority of federal agencies\u200b and put power\u2062 back \u2064in the \u200dhands of elected representatives and ultimately,\u200b the people. The \u2063rulings addressed issues such as the right to jury \u2063trials, the statute of limitations for challenging agency actions, and the deference\u200c given to agency interpretations of statutes. These changes limit the ability \u2063of agencies to target individuals \u200bwithout \u2063<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/centene-raises-profit-forecast-on-strong-premium-growth\/\" title=\"Centene boosts profit outlook due to robust premium growth.\">due \u2062process<\/a> and \u200cprevent them from rewriting regulations based on political \u200dwhims. The decisions serve \u2063as a \u200dcheck on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/7-republicans-who-found-trump-guilty-of-inciting-capitol-riot-explain-their-votes\/\" title=\"7 Republicans Who Found Trump \u2018Guilty\u2019 Of Inciting Capitol Riot Explain Their Votes\">presidential power<\/a> and underscore the importance of Congress enacting clear statutes to govern. \u200dthe rulings highlight the importance\u200d of democratic \u200bprinciples in governing the administrative state.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>While the media and Democrats spent the time leading up to the Independence Day holiday in paroxysms over Joe Biden\u2019s disastrous debate performance, the final rulings of the Supreme Court\u2019s term brought a breath of fresh air. Several major decisions weakened the administrative state in ways long sought by conservatives.<\/p>\n<p>The fact that the three liberal justices dissented from each of these rulings, and offered a proverbial \u201cparade of horribles\u201d when doing so, speaks to how the left wants unelected bureaucrats to run the country \u2014 and our lives \u2014 for us. The actions hemming in the administrative state put power back where it belongs in our representative democracy \u2014 with the nation\u2019s elected representatives and ultimately with the people.<\/p>\n<h2><strong>The Rulings <\/strong><\/h2>\n<p>The three rulings in the court\u2019s final three days each take on an element of the bureaucratic power that agencies have arrogated to themselves in recent years. In <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-859_1924.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>SEC v. Jarkesy<\/em><\/a>, the court held that the Securities and Exchange Commission\u2019s method of assessing penalties via administrative tribunals violated rights under the Seventh Amendment right to jury trials. The ruling gives defendants greater procedural rights to challenge penalties assessed by federal agencies in open court, rather than starting in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/4-examples-of-wokeness-infecting-the-united-states-military\/\" title=\"4 Examples Of  \u2018Wokeness\u2019 Infecting The United States Military\">administrative proceedings<\/a> often biased in favor of the agency, with judicial review frequently rubber-stamping the agency\u2019s actions.<\/p>\n<p>In <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-1008_1b82.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Corner Post v. Federal Reserve<\/em><\/a>, the court ruled that the statute of limitations for challenging agency actions begins when a potential plaintiff is harmed by that action, not when the action is finalized. As with <em>Jarkesy<\/em>, this ruling will give entities harmed by agency regulations more power to challenge those regulations in court.<\/p>\n<p>But the lynchpin of this judicial troika came in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-451_7m58.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Loper Bright Enterprises v. Raimondo<\/em><\/a>, which struck down the court\u2019s 1984 precedent in <em>Chevron v. National Resources Defense Council<\/em>.\u00a0The <em>Chevron<\/em> case provided that if a statute\u2019s wording was ambiguous, courts should defer to the agency\u2019s interpretation of the statute, provided that interpretation was \u201creasonable.\u201d Now courts can give an agency\u2019s interpretation of a law weight, even great weight, but they are not obligated to endorse that interpretation.<\/p>\n<h2><strong>The Rulings\u2019 Importance<\/strong><\/h2>\n<p>These rulings all removed power from unelected officials in the executive branch and placed it where it belongs \u2014 with elected officials in the form of the president and members of Congress. Agency employees can no longer create administrative \u201cstar chambers\u201d to target individuals with minimal due process protections. Nor can agencies rewrite regulations every four years on a political whim, and assume that federal courts will rubber-stamp one interpretation of a statute due to <em>Chevron<\/em> deference when they had endorsed a completely different interpretation of the statute previously. These changes will circumscribe Republican administrations as much as Democrat ones.<\/p>\n<p>\u201cTrump appointees will have a harder time rewriting the law without congressional legislation,\u201d The\u00a0Wall Street Journal editorial board <a href=\"https:\/\/www.wsj.com\/articles\/supreme-court-donald-trump-presidency-immunity-administrative-state-joe-biden-3b7a0559\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a>. \u201cThis is a check on willful presidential power.\u201d So much for the allegations by the left that the court\u2019s decision on presidential immunity means Donald Trump can assume king-like powers.<\/p>\n<p>When it comes to most elements of the three cases regarding the administrative state, Congress and the president can rewrite the laws if they choose; <em>Jarkesy<\/em> involves the nexus of statutory interpretation and Seventh Amendment jurisprudence. As Justice Barrett\u2019s conclusion to the majority opinion in <em>Corner Post<\/em> noted, \u201cWe do agree with the dissent on one point: \u2018The ball is in Congress\u2019 court,&#8217;\u201d Barrett wrote. \u201cThe solution is for Congress to enact a distinct statute,\u201d responding to the court\u2019s ruling.<\/p>\n<h2><strong>Democrats Oppose Democracy<\/strong><\/h2>\n<p>But Democrat lawmakers \u2014 and Republican ones, for that matter \u2014 often don\u2019t want to enact explicit statutes. They find it much easier to pass vague bills and have unelected bureaucrats fill in the details, the better to give themselves plausible political deniability. Recall that Nancy Pelosi \u2014 she of \u201c<a href=\"https:\/\/www.youtube.com\/watch?v=NvSkeJbQy74\" target=\"_blank\" rel=\"noreferrer noopener\">We have to pass the bill so that you can find out what is in it<\/a>\u201d fame \u2014 and her House Democrat colleagues first proposed passing Obamacare <a href=\"https:\/\/www.juniperresearchgroup.com\/post\/2010\/03\/16\/the-slaughter-solution-democrats-latest-backroom-deal-to-pass-a-government-takeover-of-health-care\" target=\"_blank\" rel=\"noreferrer noopener\"><em>without even voting on the bill itself<\/em>.<\/a><\/p>\n<p>For all their recent talk about \u201cprotecting democracy,\u201d Democrats want rule by experts \u2014 i.e., not you and me. For instance, a <a href=\"https:\/\/newrepublic.com\/article\/94940\/peter-orszag-democracy\" target=\"_blank\" rel=\"noreferrer noopener\">2011 article<\/a> by Peter Orszag, President Obama\u2019s first budget director, claimed that our nation had \u201cToo Much of a Good Thing: Why We Need Less Democracy.\u201d<\/p>\n<p>To solve the serious problems facing our country, we need to minimize the harm from legislative inertia by relying more on automatic policies and depoliticized commissions for certain policy decisions. In other words, radical as it sounds, we need to counter the gridlock of our political institutions by making them a bit less democratic.<\/p>\n<p>Individually and collectively, the Supreme Court\u2019s decisions in <em>Jarkesy<\/em>, <em>Corner Post<\/em>, and <em>Loper Bright<\/em> work to remedy the administrative state\u2019s undemocratic nature, which might explain why the liberal justices and the left opposed each so loudly.
