The law required adult websites with a significant amount \u200dof pornographic content to verify the age of users through various methods.\u200c Judge \u200cYoung argued that access to\u200c pornography is protected by the First Amendment, and laws regulating its distribution must pass strict scrutiny. He referenced previous court\u200d rulings on similar laws in other states. The judge also criticized the\u2064 law as ineffective and suggested filtering and\u200c blocking technology as\u2064 an alternative. He noted that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/big-tech-to-ban-parler-over-lack-of-content-moderation\/\" title=\"Big tech to ban Parler over lack of content moderation\">social media sites<\/a> like Reddit might be exempt from the law despite \u200dcontaining \u200dpornographic content. The case awaits review by a higher court.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Last week, U.S. District Court Judge Richard Young temporarily blocked enforcement of a new Indiana law requiring porn sites\u00a0to implement age verification services. <\/p>\n<p>Young, who has a history of activism from the bench, ruled that the law was \u201clikely unconstitutional\u201d after a lawsuit was brought against the Indiana attorney general by the Free Speech Coalition and several pornography lobbyists. Though several courts have already given the green light to similar regulations \u2014 and the Supreme Court has <a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-texas-porn-sites-age-verification-law\/?ftag=CNM-00-10aab7e&#038;linkId=489252679\" target=\"_blank\" rel=\"noreferrer noopener\">declined<\/a> to block them \u2014 Indiana must now wait for a full review of <a href=\"https:\/\/iga.in.gov\/legislative\/2024\/bills\/senate\/17\/details\" target=\"_blank\" rel=\"noreferrer noopener\">Senate Enrolled Act 17<\/a> by a higher court.<\/p>\n<p>If an adult website consists of more than one-third \u201cmaterial harmful to minors,\u201d or pornography, the bill requires them to institute an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pornhub-blocks-access-in-utah-after-state-passes-new-age-verification-law\/\" title=\"Pornhub Blocks Access in Utah After State Passes New Age Verification Law\">age verification method<\/a> such as a \u201cmobile credential,\u201d or scan of a driver\u2019s license or other form of ID; an \u201cindependent third party age verification service\u201d that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/porn-advocates-sue-indiana-ag-over-law-shielding-minors-from-online-filth\/\" title=\"Porn Advocates File Lawsuit Against Indiana AG to Challenge Law Protecting Minors from Explicit Online Content\">compares identifying information entered<\/a> by the individual with a commercial database; or any other commercially reasonable method that \u201crelies on public or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/montana-becomes-the-latest-state-in-which-pornhub-has-banned-itself\/\" title=\"Montana joins the list of states where Pornhub has self-imposed a ban\">private transactional data<\/a>,\u201d such as what can be provided by a credit card.<\/p>\n<p>In his <a href=\"https:\/\/assets.freespeechcoalition.com\/documents\/legal\/FSCvRokita\/PIgranted.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">order<\/a> granting the preliminary injunction, Young parrots the <a href=\"https:\/\/www.freespeechcoalition.com\/blog\/free-speech-coalition-sues-indiana-to-block-age-verification-law\" target=\"_blank\" rel=\"noreferrer noopener\">argument<\/a> of the Free Speech Coalition, that pornography access is a fundamental right protected by the First Amendment. As a result, he says, laws regulating its distribution must pass \u201cstrict scrutiny\u201d or be the \u201cleast restrictive means\u201d of accomplishing a compelling government interest.<\/p>\n<p>However, the 5th U.S. Circuit Court has already <a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/23\/23-50627-CV0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> on an equivalent Texas law that, based on the precedent set in <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/390\/629\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Ginsberg v. New York<\/em><\/a>  (1968)<em>, <\/em>the distribution of obscene or sexually explicit materials to minors is subject to the much lower standard of rational-basis review. The Supreme Court <a href=\"https:\/\/www.cbsnews.com\/news\/supreme-court-texas-porn-sites-age-verification-law\/?ftag=CNM-00-10aab7e&#038;linkId=489252679\" target=\"_blank\" rel=\"noreferrer noopener\">agreed<\/a> to hear an appeal of this decision but declined to block enforcement of the Texas law in the interim.<\/p>\n<p>Young, for his part, brings up <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/521\/844\/\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Reno v. ACLU<\/em><\/a>  (1997) to defend against the application of <em>Ginsberg v. New York<\/em>. This case struck down most of the <a href=\"https:\/\/firstamendment.mtsu.edu\/article\/communications-decency-act-and-section-230\/#:~:text=Congress%20enacted%20the%20Communications%20Decency,explicit%20materials%20on%20the%20internet.\" target=\"_blank\" rel=\"noreferrer noopener\">Communications Decency Act<\/a> for being \u201cunconstitutionally vague,\u201d particularly in its definition of indecency. However, the decision left open enforcement of the law against obscenity.<\/p>\n<p><a href=\"https:\/\/law.justia.com\/codes\/indiana\/title-35\/article-49\/chapter-2\/section-35-49-2-2\/\">Indiana law<\/a> has a clear definition of \u201cmaterial harmful to minors\u201d (used in Senate Enrolled Act 17), that is based on the Supreme Court\u2019s definition of obscenity in the <a href=\"https:\/\/firstamendment.mtsu.edu\/article\/miller-test\/\">Miller Test<\/a>.<\/p>\n<blockquote>\n<p><em>[If it]  (1) describes or represents, in any form, nudity, sexual conduct, sexual excitement, or sado-masochistic abuse; (2) considered as a whole, it appeals to the prurient interest in sex of minors; (3) it is patently offensive to prevailing standards in the adult community as a whole with respect to what is suitable matter for or performance before minors; and (4) considered as a whole, it lacks serious literary, artistic, political, or scientific value for minors.<\/em><\/p>\n<\/blockquote>\n<p>Adults are still able to access the material, but access would be subject to the <a href=\"https:\/\/firstamendment.mtsu.edu\/article\/time-place-and-manner-restrictions\/\" target=\"_blank\" rel=\"noreferrer noopener\">time, place, and manner<\/a> restriction of submitting to age verification.<\/p>\n<p>Young also <a href=\"https:\/\/drive.google.com\/file\/d\/1o2vtRL5DLiEOs-zB4Epecv4baYGIMXr9\/view?usp=sharing\" target=\"_blank\" rel=\"noreferrer noopener\">argues<\/a> that the law is \u201cineffective,\u201d again parroting the claims of the Free Speech Coalition, without providing any evidence other than potential workarounds of the law, and proposes filtering and blocking technology as an alternative.<\/p>\n<p>He notes that \u201cfiltering software is not widely used,\u201d but blames this on Indiana law and does not acknowledge that depending on the use of such software presupposes that parents are actively involved in their children\u2019s lives and care about protecting them from unhealthy content online, or even know how to.<\/p>\n<p>He also points out that social media sites like Reddit are likely excluded from the law, despite the significant amount of pornographic content available on them. Several sites with a significant portion of use dedicated to the distribution of pornography, such as Fetlife, also claim to function as social media, so it is unclear where a line would be drawn for those that may consist of more than one-third pornography.<\/p>\n<p>In his order, he also claims as a defense that Pornhub has a \u201cblog advocating for legislative change\u201d on their site in addition to other non-pornographic materials. \u201cWere a private building that ordinarily functions as a strip club acting as the site of a political rally for a night, the court doubts the State could require adults to provide identification to enter,\u201d he said.<\/p>\n<p>However, pornography is still accessible on the site to anyone who accesses the non-pornographic material, so the connection to the case at hand is unclear.<\/p>\n<p>Young, nominated by Bill Clinton in 1998, has a history of other <a href=\"https:\/\/ballotpedia.org\/Richard_Young_(Federal_judge)\" target=\"_blank\" rel=\"noreferrer noopener\">activist decisions<\/a>.<\/p>\n<p>Young <a href=\"https:\/\/www.indystar.com\/story\/news\/politics\/elections\/2020\/10\/20\/election-2020-five-big-indiana-election-lawsuits-to-know\/3709510001\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that a law requiring voters to go to a county election board rather than directly to the courts to petition to keep <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/over-20-gop-candidates-sue-largest-texas-county-alleging-election-day-malfeasance\/\" title=\"Over 20 GOP candidates sue Texas county for alleged election day misconduct.\">polling places open<\/a> for longer was unconstitutional. This decision was later stayed. In <a href=\"https:\/\/www.scribd.com\/document\/237252517\/Bowling-v-Pence-District-Court-ruling\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Bowling v. Pence<\/em><\/a>  (2014), he ruled that Indiana had to recognize same-sex marriages from other states, and in <a href=\"https:\/\/docs.justia.com\/cases\/federal\/district-courts\/indiana\/insdce\/1:2014cv00355\/51490\/51\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Baskin v. Bogan<\/em><\/a>  (2014) he ruled that Indiana had to perform same-sex marriages, before even <em>Obergefell v. Hodges<\/em>.<\/p>\n<p>He also <a href=\"https:\/\/www.aclu-in.org\/sites\/default\/files\/sea_340_decisoin.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">struck down a law<\/a> requiring doctors to report abortion complications, claiming that it violated Planned Parenthood\u2019s rights.<\/p>\n<hr>\n<p>      Abe Stahl is a graduate student studying policy analysis at Indiana University.
