return false;\" title=\"Printer Friendly, PDF &#038; Email\"><span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span><\/a><\/span><\/li>\n<\/ul><\/div>\n<p>Missouri Attorney General Andrew Bailey filed a lawsuit Wednesday against New York alleging in part that the lawfare trial against former President Donald Trump violated Missourians\u2019 First Amendment right \u201cto hear from a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/joe-biden-knows-he-messed-up-on-fracking-at-debate-and-is-now-doing-damage-control-the-daily-wire\/\" title=\"Joe Biden Knows He Messed Up On Fracking At Debate And Is Now Doing Damage Control | The Daily Wire\">presidential candidate<\/a> in the 2024 presidential election,\u201d as stated in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/public-radio-reporter-arrested-for-firebombing-police-cars\/\" title=\"Public Radio \u201cReporter\u201d Arrested For Firebombing Police Cars\">press release announcing<\/a> the suit.<\/p>\n<p>In a lawfare case brought by a D.A. who campaigned on taking on Trump, the former president was found guilty by a New York jury in May on 34 charges related to a <a href=\"https:\/\/thefederalist.com\/2024\/05\/31\/guilty-trump-verdict-will-keep-good-people-from-running-for-office\/\" target=\"_blank\" rel=\"noreferrer noopener\">crime<\/a> that \u201cnobody can quite articulate.\u201d Following the Supreme Court\u2019s immunity decision, Trump\u2019s team moved to <a href=\"https:\/\/www.nytimes.com\/2024\/07\/01\/nyregion\/trump-sentence-hush-money.html\" target=\"_blank\" rel=\"noreferrer noopener\">overturn<\/a> his conviction, and Trump\u2019s sentencing was <a href=\"https:\/\/www.politico.com\/news\/2024\/07\/02\/trump-sentencing-delayed-new-york-00166303\" target=\"_blank\" rel=\"noreferrer noopener\">delayed<\/a> until Sept. 18, less than two months before Election Day. In the lawsuit, Bailey filed a motion for a preliminary injunction, asking the Supreme Court to stop any further proceedings related to the New York lawfare case until after the election.<\/p>\n<div  class=\"fdrlst__b89e9-fe15ea109823de42f59961ae9d664553 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-fe15ea109823de42f59961ae9d664553\"><\/div>\n<p>\u201cNew York has brought transparently weak charges for the transparent purpose of trying to impose political damage against Trump and trying to restrain his ability to campaign in advance of an election forecasted by the polls to be very close,\u201d the <a href=\"https:\/\/ago.mo.gov\/wp-content\/uploads\/Missouri-v.-NY.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">suit<\/a> alleges.<\/p>\n<p>Bailey\u2019s complaint also takes issue with a gag order placed on Trump by Judge Juan Merchan, who is a Biden donor. This order prohibited Trump from criticizing Merchan\u2019s daughter, a Democrat political operative who, according to Bailey, stood to benefit \u201cfinancially\u201d from a Trump conviction. The order also prohibited Trump from criticizing the reliability and motivations of the witnesses involved in the case \u2014 like convicted liar Michael Cohen \u2014 and even one of the prosecutors, Matthew Colangelo, who surrendered his high-ranking role in Biden\u2019s Department of Justice \u201cspecifically so he could go prosecute Trump,\u201d the suit says.<\/p>\n<p>\u201cThis lawfare is poisonous to American democracy. The American people ought to be able to participate in a Presidential election free from New York\u2019s interference. Any gag order and sentence should be stayed until after the election.\u201d<\/p>\n<p>Bailey alleges that Manhattan District Attorney Alvin Bragg brought charges against Trump \u201cfor the purpose of assisting Joseph Biden\u2019s campaign by trying to inflict political damage against Trump and trying to restrain Trump\u2019s ability to campaign.\u201d<\/p>\n<div  class=\"fdrlst__b89e9-f6c2b5c008e246e9288225c49f0f1452 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-f6c2b5c008e246e9288225c49f0f1452\"><\/div>\n<p>The suit first argues that the \u201cgag order and impending sentence unlawfully impede the ability of electors to fulfill their federal functions.\u201d More specifically, the lawfare threatens Missouri electors\u2019 ability \u201cto become fully informed before casting their ballots.\u201d<\/p>\n<p>Bailey\u2019s second argument is that the gag order and sentencing \u201cviolate the <em>Purcell<\/em> principle,\u201d established when the Supreme Court ruled in 2006 in <em>Purcell v. Gonzalez<\/em> that \u201cCourt orders affecting elections, especially conflicting orders, can themselves result in voter confusion and consequent incentive to remain away from the polls.\u201d According to Bailey, the lawfare against Trump creates confusion for both electors and voters.<\/p>\n<p>Bailey\u2019s final argument is that the gag order and impending sentencing \u201cviolate the First Amendment rights of Missouri citizens to listen to the campaign speech of a specific individual on specific topics.\u201d<\/p>\n<p>\u201cRight now, Missouri has a huge problem with New York. Instead of letting presidential candidates campaign on their own merits, radical progressives in New York are trying to rig the 2024 election by waging a direct attack on our democratic process,\u201d Bailey said in the press release. \u201cI will not sit idly by while Soros-backed prosecutors hold Missouri voters hostage in this presidential election.\u201d<\/p>\n<div  class=\"fdrlst__b89e9-5f320898854dfcc0ae330479a31ea94a fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-5f320898854dfcc0ae330479a31ea94a\"><\/div>\n<p>Trump currently faces several other lawfare charges, including attempts by Biden\u2019s own Department of Justice to jail Trump for allegedly mishandling classified documents as well as for his speech on Jan. 6, 2021.
