The opposing sides of the debate see Tuesday\u2019s outcome differently.<\/p>\n<p>Gov. J.B. Pritzker enacted Illinois\u2019 ban on the sale and possession of more than <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/latest-gun-ban-lawsuit-seeks-court-to-declare-plaintiff-a-peace-officer\/\" title=\"Latest gun ban lawsuit seeks court to declare plaintiff a peace officer\">170 semi-automatic firearms<\/a> and magazine capacities in January 2023.<\/p>\n<p>Several cases went through the district and appeals courts on initial proceedings, but no final judgments had been issued. Thomas denied granting plaintiffs\u2019 requests for the Supreme Court to take the cases without final judgment.<\/p>\n<p>\u201cThis Court is rightly wary of taking cases in an interlocutory posture,\u201d Thomas wrote. \u201cBut, I hope we will consider the important issues presented by these petitions after the cases reach final judgment.\u201d<\/p>\n<p>Gun control groups heralded the decision to not take the cases.<\/p>\n<p>\u201cThe Supreme Court action means the protection of Illinois citizens from assault weapons and large capacity magazines will remain in effect. That\u2019s good news for all of us,\u201d Gun Violence Prevention PAC Executive Board member John Schmidt said in a statement.<\/p>\n<p>Hannah Hill, executive director with the National Foundation for Gun Rights, said Illinoisans\u2019 Second Amendment Rights continue to be violated. But, the ruling wasn\u2019t about substance, it was about procedure.<\/p>\n<p>\u201cAnd Justice Thomas gave us all hope when he said that basically, go through the merits and if the Seventh Circuit remains obdurate, if they say the same thing, then we\u2019re prepared to take the case,\u201d Hill told The Center Square.<\/p>\n<p>Yolanda Androzzo, executive director of One Aim Illinois, a group advocating for more regulations on firearms, was encouraged that the gun ban remains in place, \u201cat least for now.\u201d<\/p>\n<p>\u201cAs the fight over this law continues in district courts, we remain steadfast in our commitment to advocating for sensible <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-wont-rule-out-using-executive-orders-to-crackdown-on-second-amendment-rights-white-house\/\" title=\"Biden Won\u2019t Rule Out Using Executive Orders To Crackdown On Second Amendment Rights: White House\">gun control measures<\/a> that safeguard our residents,\u201d Androzzo said in a statement.<\/p>\n<p>Hill said while Illinois\u2019 gun ban remains in place, Thomas\u2019 opinion shows the law\u2019s days are numbered with his criticism of the appeal\u2019s court\u2019s ruling last year.<\/p>\n<p>\u201cHe used the term \u2018nonsensical,\u2019 \u2018contrived,\u2019 \u2018highly suspect,\u2019 and he said outright \u2018it is difficult to see how the [Seventh Circuit U.S. Court of Appeals] could have concluded that the most widely owned semi-automatic rifles are not arms protected by the Second Amendment.\u201d<\/p>\n<p>State Rep. Bob Morgan, D-Deerfield, sponsored the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/joe-biden-fails-to-keep-word-again-this-time-on-guns\/\" title=\"Joe Biden fails to keep word again, this time on guns\">gun ban legislation<\/a>. He said Tuesday\u2019s ruling \u201ckeeps weapons of war\u201d off the streets.<\/p>\n<p>\u201cI applaud the U.S. Supreme Court for allowing Illinois\u2019 common-sense gun reform to continue,\u201d Morgan said. \u201cEvery day that assault weapons and high capacity magazines are banned in Illinois represents fewer gun deaths and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-blames-gun-lobby-for-texas-mass-shooting\/\" title=\"Biden Blames \u201cGun Lobby\u201d for Texas Mass Shooting\">reduced gun violence<\/a>.\u201d<\/p>\n<p>Gun rights advocate Todd Vandermyde said those celebrating haven\u2019t seen the writing on the wall \u2013 the order reinforced previous precedent upholding Second Amendment rights.<\/p>\n<p>\u201cEvidently they didn\u2019t read the author of [New York State Rifle and Pistol Association v. Bruen], Justice Thomas\u2019 comments that the standard used by the Seventh Circuit was just made up,\u201d Vandermyde said.<\/p>\n<p>Thomas said in his view \u201cIllinois\u2019 ban is \u2018highly suspect because it broadly prohibits common semiautomatic firearms used for lawful purposes.\u2019\u201d<\/p>\n<p>\u201cThe Seventh Circuit\u2019s contrived \u2018non-militaristic\u2019 limitation on the Arms protected by the Second Amendment seems unmoored from both text and history,\u201d Thomas wrote. \u201cAnd, even on its own terms, the Seventh Circuit\u2019s application of its definition is nonsensical.\u201d<\/p>\n<p>The Seventh Circuit U.S. Court of Appeals could take up the case on the merits sometime after a bench trial in the Southern District of Illinois federal court. That\u2019s set for Sept. 16 in East St. Louis.<\/p>\n<p>Attorney General Kwame Raoul said he will \u201cvigorously defend\u201d the gun ban\u2019s constitutionality.<\/p>\n<p>\u201cThe law is an important part of what must be a multifaceted approach to addressing gun violence, and I am pleased it remains in effect in Illinois,\u201d Raoul said in a statement.<\/p>\n<p>The Illinois State Rifle Association said Tuesday\u2019s decision doesn\u2019t impact the trajectory of the district court\u2019s case.<\/p>\n<p>\u201cToo much is at stake, and the ISRA remains on the front lines and continues to stand up to Gov. Pritzker and anti-gun legislators in Springfield on behalf of 2.4 million law-abiding, responsible firearms owners in Illinois,\u201d said ISRA Executive Director Richard Pearson.<\/p>\n<p>Southern District of Illinois federal Judge Stephen McGlynn has said he wants to deal with the merits expeditiously.
