The \u200dsummary also includes a note from the \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pattern-continues-judge-issues-decision-against-trump-same-day-damning-hunter-biden-payments-revealed\/\" title=\"Judge rules against Trump as damning Hunter Biden payments are exposed.\">deputy\u200d managing editor<\/a> on the importance of the 2024 election and the potential consequences of \u2062losing it \u2064to wealthy elites.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><br \/>\n<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\"> <?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><html><body><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/randydesoto\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/randydesoto\/%20\"><span>Randy DeSoto<\/span><\/a> <\/span> <span>   July 2, 2024 at 2:13pm <\/span> <\/span>  <\/header>\n<section>\n<p>In a concurring opinion to Monday\u2019s U.S. Supreme Court presidential immunity ruling, Justice Clarence Thomas argued that Jack Smith\u2019s appointment as special counsel is unconstitutional.<\/p>\n<p>Chief Justice John Roberts <a href=\"https:\/\/www.westernjournal.com\/turley-scotus-immunity-decision-produces-cardiac-arrest-jack-smith-trump-case\/\" target=\"_blank\" rel=\"noopener\">wrote<\/a> in the majority <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-939_e2pg.pdf\" target=\"_blank\" rel=\"noopener\">opinion<\/a> that the president \u201cis entitled to at least presumptive immunity from prosecution for all his official acts.\u201d<\/p>\n<p>This is a much broader scope of immunity than Smith\u2019s prosecutors have argued before the Washington, D.C. federal district court, where former President Donald Trump\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/watch-deranged-sounding-georgia-grand-jury-foreman-throws-election-case-against-trump-into-legal-jeopardy\/\" title=\"WATCH: Deranged-Sounding Georgia Grand Jury Foreman Throws Election Case Against Trump Into Legal Jeopardy\">2020 election interference case<\/a> is being conducted.<\/p>\n<p>Thomas, along with justices Samuel Alito, Neil Gorsuch and Brett Kavanaugh, signed on to the majority opinion, while Justice Amy Coney Barrett joined in most of it.<\/p>\n<p>Justices Sonia Sotomayor, Elena Kagan, and <a href=\"https:\/\/www.westernjournal.com\/justice-ketanji-brown-jackson-true-thoughts-first-amendment-slip-obstacle-hamstringing-government\/\" target=\"_blank\" rel=\"noopener\">Ketanji Brown Jackson<\/a> all dissented.<\/p>\n<p>The case has been sent back to the federal district court to determine which wrongdoing, if any, contained in Smith\u2019s <a href=\"https:\/\/www.documentcloud.org\/documents\/23893902-trump-indictment\" target=\"_blank\" rel=\"noopener\">45-page indictment<\/a> against Trump falls within what could be deemed his official acts as president.<\/p>\n<p>In his concurring <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-939_e2pg.pdf\" target=\"_blank\" rel=\"noopener\">opinion<\/a>, Thomas explained, \u201cI write separately to highlight another way in which this prosecution may violate our constitutional structure. In this case, the Attorney General purported to appoint a private citizen as Special Counsel to prosecute a former President on behalf of the United States. But, I am not sure that any office for the Special Counsel has been \u2018established by Law,\u2019 as the Constitution requires.\u201d<\/p>\n<p>\u201cIf there is no law establishing the office that the Special Counsel occupies, then he cannot proceed with this prosecution. A private citizen cannot criminally prosecute anyone, let alone a former President,\u201d the justice added.<\/p>\n<p>Before he was appointed special counsel by Attorney General <a href=\"https:\/\/www.westernjournal.com\/option-arrest-attorney-general-merrick-garland-voted-house\/\" target=\"_blank\" rel=\"noopener\">Merrick Garland<\/a> in November 2022, Smith served as the chief prosecutor for the special court in The Hague in the Netherlands. Before that, he was a prosecutor in the U.S. Justice Department, according to a DOJ <a href=\"https:\/\/www.justice.gov\/opa\/pr\/appointment-special-counsel-0\" target=\"_blank\" rel=\"noopener\">news release<\/a>.<\/p>\n<p>\u201cIf this unprecedented prosecution is to proceed, it must be conducted by someone duly authorized to do so by the American people,\u201d Thomas argued.<\/p>\n<p>The justice then went into some history, highlighting, \u201cThe Founders broke from the monarchial model by giving the President the power to fill offices (with the Senate\u2019s approval), but not the power to create offices.\u201d<\/p>\n<p>This requirement was an intentional check on executive power.<\/p>\n<p>\u201cIf Congress has not reached a consensus that a particular office should exist, the Executive lacks the power to create and fill an office of his own accord,\u201d Thomas wrote.<\/p>\n<p>\u201cIt is difficult to see how the Special Counsel has an office \u2018established by Law,\u2019 as required by the Constitution. When the Attorney General appointed the Special Counsel, he did not identify any statute that clearly creates such an office,\u201d he added.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/politics\/clarence-thomas-swipes-special-counsel-jack-smiths-appointment-scotus-immunity-case\" target=\"_blank\" rel=\"noopener\">Fox News<\/a> reported that the issues Thomas raised in his concurring opinion mirror some of the points made by former Reagan Attorney General Edwin Meese in an <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A745\/300972\/20240220173530766_Trump%20v%20US%20Stay%20Amicus%20Final.pdf\" target=\"_blank\" rel=\"noopener\">amicus brief<\/a> to the Supreme Court in Trump\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-rejects-jack-smiths-request-to-expedite-trump-presidential-immunity-dispute\/\" title=\"SCOTUS denies Jack Smith&#039;s plea for fast-tracking Trump immunity dispute\">presidential immunity case<\/a>.<\/p>\n<p>He argued that \u201ceven if one overlooks the absence of statutory authority for the position, there is no statute specifically authorizing the Attorney General, rather than the President by and with the advice and consent of the Senate, to appoint such a Special Counsel.\u201d<\/p>\n<p>Meese said the only way Garland or any other attorney general can designate a special counsel is by assigning an existing U.S. attorney (all of whom must go through <a href=\"https:\/\/oig.justice.gov\/sites\/default\/files\/archive\/special\/s0809a\/chapter2.htm#:~:text=U.S.%20Attorneys%20are%20appointed%20by,the%20will%20of%20the%20President.\" target=\"_blank\" rel=\"noopener\">Senate confirmation<\/a>) to oversee the criminal prosecution.<\/p>\n<p>Trump\u2019s attorneys have raised the issue of the constitutionality of Smith\u2019s appointment in the <a href=\"https:\/\/www.westernjournal.com\/huge-trump-trial-development-judge-cannon-looks-reversing-prosecution-triumph-last-year\/\" target=\"_blank\" rel=\"noopener\">classified documents<\/a> handling case being brought in Florida and overseen by federal district court Judge Aileen Cannon.<\/p>\n<p><a href=\"https:\/\/www.nytimes.com\/2024\/07\/01\/us\/politics\/clarence-thomas-special-counsel-appointment.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a> reported, \u201cMr. Smith\u2019s deputies have countered that under the appointments clause of the Constitution, agency heads like Mr. Garland are authorized to name \u2018inferior officers\u2019 like special counsels to act as their subordinates.\u201d<\/p>\n<p>But in his concurrence, Thomas questioned this reasoning, writing that the only way Smith would be an \u201cinferior officer\u201d is if\u00a0 \u201ca statute created the special counsel\u2019s office and gave the attorney general the power to fill it.\u201d<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>I heard a chilling comment the other day: \u201cWe don\u2019t even know if an election will be held in 2024.\u201d <\/span><\/i><\/p>\n<p><i><span>That wasn\u2019t said by a conspiracy theorist or a doomsday prophet.
