The suit\u2062 names individual \u200bfaculty members and administrators as defendants, accusing them of \u200cintentionally discriminating in favor of certain candidates based \u200con race and gender. The lawsuit also highlights instances of inept and corrupt hiring \u2063practices, \u2064including \u2062the promotion of candidates with subpar credentials. The lawsuit seeks to hold the university accountable for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/actblue-facilitating-donations-to-terror-tied-charity-legal-group-says\/\" title=\"ActBlue Facilitating Donations to Terror-Tied Charity, Legal Group Says\">violating federal laws<\/a> regarding discrimination in hiring practices.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Whistleblowers from within Northwestern University\u2019s Pritzker School of Law reported that highly qualified white men were rejected in favor of \u201cmediocre and undistinguished women and racial minorities\u201d in violation of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tennessee-files-lawsuit-against-biden-admin-over-guidance-that-threatens-womens-sports-student-privacy\/\" title=\"Tennessee Files Lawsuit Against Biden Admin Over Guidance That \u2018Threatens Women\u2019s Sports,\u2019 Student Privacy\">federal anti-discrimination law<\/a>, according to a lawsuit filed Tuesday.<\/p>\n<p>The nonprofit group Faculty, Alumni, and Students Opposed to Racial Preferences (FASORP), formed \u201cfor the purpose of restoring meritocracy in academia,\u201d is challenging the school\u2019s \u201caffirmative-action\u201d hiring practices in court. Former Texas Solicitor General <a href=\"https:\/\/fedsoc.org\/contributors\/jonathan-mitchell\">Jonathan F. Mitchell<\/a> authored the lawsuit, which alleges Northwestern has violated several federal laws, including the <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/2000d\">Civil Rights Act of 1964<\/a>, and <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/20\/1681\">Title IX<\/a>. <\/p>\n<p>\u201cFaculty hiring at American universities is a cesspool of corruption and lawlessness. For decades, left-wing faculty and administrators have been thumbing their noses at <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sen-blackburn-promotes-bill-to-protecting-female-athletes-from-trans-competition\/\" title=\"Sen. Blackburn Promotes Bill to Protecting Female Athletes from Trans Competition\">federal anti-discrimination statutes<\/a> and openly discriminating on account of race and sex when appointing professors,\u201d Mitchell wrote in the lawsuit. \u201cThis practice, known as \u2018affirmative action,\u2019 is firmly entrenched at institutions of higher learning and aggressively pushed by leftist ideologues on faculty-appointments committees and in university DEI offices. But it is prohibited by federal law, which bans universities that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tennessee-partners-with-hillsdale-college-in-statewide-charter-school-initiative\/\" title=\"Tennessee Partners With Hillsdale College In Statewide Charter School Initiative\">accept federal funds<\/a> from discriminating on account of race or sex in their hiring decisions.\u201d<\/p>\n<h3><strong>Bad Actors<\/strong><\/h3>\n<p>The suit names a variety of individual bad actors as defendants in addition to Northwestern University. These include law school <a href=\"https:\/\/www.law.northwestern.edu\/faculty\/profiles\/harimosofsky\/\">Dean Hari M. Osofsky<\/a>, Professors <a href=\"https:\/\/www.law.northwestern.edu\/faculty\/profiles\/sarahlawsky\/\">Sarah Lawksy<\/a>, <a href=\"https:\/\/www.law.northwestern.edu\/faculty\/profiles\/janicenadler\/\">Janice Nadler<\/a>, and <a href=\"https:\/\/www.law.northwestern.edu\/faculty\/profiles\/danielrodriguez\/\">Daniel Rodriguez<\/a>, and law review <a href=\"https:\/\/northwesternlawreview.org\/about\/masthead\/\">student editors<\/a> Dheven Unni and Jazmyne Denman.<\/p>\n<p>The lawsuit alleges then-Dean Rodriguez created a mandate 12 years ago to \u201cintentionally and consciously discriminate in favor of black, Hispanic, Asian, female, homosexual, and transgender faculty candidates, and against white men who are heterosexual and non-transgender.\u201d The mandate has since been perpetuated by Osofsky and other faculty, according to the lawsuit.<\/p>\n<p>\u201cUniversity faculty and administrators think they can flout these anti-discrimination statutes with impunity because they are rarely sued over their discriminatory hiring practices and the Department of Education looks the other way,\u201d Mitchell wrote. \u201cBut now the jig is up.\u201d<\/p>\n<p>The lawsuit names legal scholars who were denied faculty positions at the school. <\/p>\n<p>Eugene Volokh, a renowned First Amendment scholar and 30-year law professor at UCLA, was blocked from the hiring process by Rodriguez, according to the lawsuit. The filing alleges Vice Dean <a href=\"https:\/\/www.law.northwestern.edu\/faculty\/profiles\/emilykadens\/\">Emily Kadens<\/a> \u201copenly said that Professor Volokh would have been hired at Northwestern had he been anything other than a white man.\u201d<\/p>\n<p>Ilan Wurman, a professor of administrative law and constitutional law, was recommended unanimously by Northwestern\u2019s appointment committee for the 2019-2020 hiring cycle. The lawsuit alleges both Lawsky and Nadler openly opposed Wurman\u2019s appointment \u201cbecause he is a white man.\u201d<\/p>\n<p>Mitchell notes that these professors did not initiate the lawsuit or provide their information, but serve as proof that the university \u201crefuses to even consider hiring white male faculty candidates with stellar credentials. \u2026\u201d<\/p>\n<h3><strong>Inept Faculty<\/strong><\/h3>\n<p>The lawsuit also notes the university \u201ceagerly hires mediocre and undistinguished affirmative-action candidates who check the proper diversity boxes.\u201d<\/p>\n<p>\u201cCandidates with preferred identities are awarded substantial advantages and chosen over white men with vastly superior publication records and far more impressive educational and professional credentials,\u201d Mitchell wrote.<\/p>\n<p>The lawsuit lists <a href=\"https:\/\/groups.psych.northwestern.edu\/spcl\/destiny.htm\">Destiny Peery<\/a> as one such hire, stating that she graduated at the bottom of her Northwestern law school class, was granted grade inflation, and was deemed \u201cunqualified for an academic appointment and incapable of producing serious scholarship\u201d by several faculty members. Rodriguez is accused of \u201cthreaten[ing] to withhold bonuses\u201d from faculty members who opposed Peery\u2019s appointment. Nadler is accused of lying to faculty to secure Peery\u2019s subsequent promotion, despite her having produced almost no legal scholarship.<\/p>\n<p>\u201cA candidate with a law-school record like Peery\u2019s would not even be considered for a tenure-track position at Northwestern in the absence of racial preferences,\u201d Mitchell wrote. \u201cPeery received her appointment at Northwestern because she is a black woman, and because Northwestern discriminates in favor of blacks (and women) and against white men when hiring its faculty.\u201d<\/p>\n<p>The suit lists a number of other inept hires, including professors accused of committing plagiarism, admitting they did not understand course material, and wasting $900,000 in school funds. <\/p>\n<h3><strong>Corrupt Law Review<\/strong><\/h3>\n<p>Also named in the lawsuit are Unni, editor-in-chief of the Northwestern University Law Review, and Denman, senior equity and inclusion editor at the review. Unni and Denman, both students at the law school, are accused of illegally discriminating against white students and men in the process of selecting articles for publication, members, and editors. <\/p>\n<p>The discrimination came to a head in the\u00a0 2023-2024 school year.<\/p>\n<p>\u201cThe editors \u2026 decided that they would publish an entire issue that would consist only of articles written by black women. No articles written by men or by any non-black person would even be considered for publication in that issue,\u201d Mitchell wrote. \u201cThe student editors and members on the Law Review were told that this was done intentionally to promote the careers of these black women academics because of their race and sex.\u201d<\/p>\n<h3><strong>Remedy in Court<\/strong><\/h3>\n<p>FASORP is asking the court to require Northwestern to establish a new hiring process \u201cthat is based entirely on academic and scholarly merit and that explicitly disavows any consideration of race, sex, sexual orientation, or gender identity or expression,\u201d along with other relief. <\/p>\n<p>The lawsuit also states that FASORP has standing to sue any other universities that violate federal anti-discrimination statutes. Mitchell is eager to do so. <\/p>\n<p>\u201cEvery university is doing this, and our client has standing to sue any university we want,\u201d Mitchell told The Federalist. \u201cAny professor who has incriminating evidence should reach out to us.\u201d<\/p>\n<p>Mitchell sent litigation-hold letters to over 100 colleges and universities Tuesday morning. These schools have been advised to retain records related to decision-making in their hiring processes and on their law reviews, with Mitchell warning FASORP \u201c will be suing other universities\u201d and discarding these records could warrant \u201csignificant penalties.\u201d<\/p>\n<hr>\n<p>      Monroe Harless is a summer intern at The Federalist.
