Alexandria Ocasio-Cortez,\u2062 in response to the Supreme Court&#8217;s ruling on \u200cformer President Donald Trump&#8217;s immunity, vowed to bring articles of impeachment. The ruling stated that presidents are immune from prosecution for official \u2062acts but not unofficial ones. Some critics, like Justice \u2063Sonia Sotomayor, fear the ruling undermines the principle that no one is \u200babove the law. However, \u200dother interpretations, like one from The Nation,\u200d suggest\u2062 that the \u200bruling could allow the president to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dem-senate-frontrunner-fundraises-with-radical-san-francisco-liberals-to-flip-wisconsin\/\" title=\"Dem Senate Frontrunner Fundraises With Radical San Francisco Liberals to Flip Wisconsin\">commit heinous crimes<\/a> without consequences. Despite\u200b this, AOC&#8217;s promise seems like\u200b a political stunt as it&#8217;s unlikely \u200dto\u200c succeed in Congress. Douglas Golden   \u00a0July 2, 2024 at 5:28am      We can say this much about Rep. Alexandria Ocasio-Cortez: The New York Democrat is nothing if not consistent in her denial of reality. In the wake of the Supreme Court\u2019s 6-3 decision that former President Donald Trump had some level of immunity for official decisions taken while he was president \u2014 a decision that almost certainly means special counsel Jack Smith\u2019s case related to the Jan. 6, 2021, Capitol incursion won\u2019t make it to a jury before the November election \u2014 AOC promised on social media to bring articles of impeachment. Against whom or what? One is reminded of Marlon Brando\u2019s answer when asked what his character was rebelling against in the film \u201cThe Wild Ones\u201d: \u201cWhat have you got?\u201d  While the decision Monday sent the left into a state of predictable apoplexy, the ruling in Trump v. United States was a relatively predictable one and not as far-reaching as some on the left claimed. Chief Justice John Roberts\u2019 opinion for the majority said a president \u201cmay not be prosecuted for exercising his core constitutional powers\u201d and \u201cis entitled, at a minimum, to a presumptive immunity from prosecution for all his official acts.\u201d Roberts noted that withholding immunity would create, in his words, \u201can executive branch that cannibalizes itself, with each successive President free to prosecute his predecessors, yet unable to boldly and fearlessly carry out his duties for fear that he may be next.\u201d   As legal analyst Dan McLaughlin wrote at National Review, this didn\u2019t magically grant presidents immunity for anything, simply that which was theirs to do under the purview of Article II of the Constitution. Unofficial acts, including campaign acts, are not immune \u2014 which, as McLaughlin noted, \u201cshould leave most of Smith\u2019s indictment standing.\u201d  The court also rejected Trump\u2019s argument that a president could not be prosecuted if he had been impeached and convicted by the Senate. What constitutes an official and unofficial act would be determined through the court system \u201cin the way that immunity decisions customarily are: as a defense to trial, which can be immediately appealed,\u201d McLaughlin noted. In a scathing dissent written on behalf of the court\u2019s three Democrat-appointed justices, Justice Sonia Sotomayor said the decision \u201cmakes a mockery of the principle, foundational to our Constitution and system of Government, that no man is above the law.\u201d \u201cWith fear for our democracy, I dissent,\u201d she wrote. The President Can Now Assassinate You, Officially | The Nation https:\/\/t.co\/uKGYgZtl6L \u2014 Imani Gandy (Orca\u2019s Version) \u2693\ufe0f (@AngryBlackLady) July 1, 2024    This headline derives from a reductio ad absurdum (emphasis on absurdum) of what the immunity ruling meant in Sotomayor\u2019s dissent:  \u201cImagine a President states in an official speech that he intends to stop a political rival from passing legislation that he opposes, no matter what it takes to do so (official act). He then hires a private hitman to murder that political rival (unofficial act). Under the majority\u2019s rule, the murder indictment could include no allegation of the President\u2019s public admission of premeditated intent to support the mens rea of murder\u2026When he uses his official powers in any way, under the majority\u2019s reasoning, he now will be insulated from criminal prosecution. Orders the Navy\u2019s Seal Team 6 to assassinate a political rival? Immune. Organizes a military coup to hold onto power? Immune. Takes a bribe in exchange for a pardon? Immune. Immune, immune, immune.\u201d Never mind the fact that this presupposes no separation of powers, chain of command or other mechanisms to stop and\/or punish the president: Are we to understand that a 6-3 ruling of whether the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-rages-that-jack-smith-keeps-prosecution-efforts-going-as-ex-president-hits-the-campaign-trail\/\" title=\"Trump angrily accuses Jack Smith of persisting with prosecution efforts while he campaigns as an ex-president\">president enjoys immunity<\/a> for official acts under Article II of the Constitution would stop this?  \u201cOh,\u201d you can hear Joe Biden celebrating from the Oval Office. \u201cI was just gonna leave Corn Pop alone, even though he was a bad dude! But now Chief Justice Roberts says I can send SEAL Team 6 after him! Release the hounds!\u201d Amid all this thorough uncertainty over who the president is going to kill first, though, never fear: AOC is on the job. \u201cThe Supreme Court has become consumed by a corruption crisis beyond its control,\u201d the congresswoman wrote on X. \u201cToday\u2019s ruling represents an assault on American democracy,\u201d she said. \u201cIt is up to Congress to defend our nation from this authoritarian capture.  \u201cI intend on filing articles of impeachment upon our return.\u201d  The Supreme Court has become consumed by a corruption crisis beyond its control. And on whom? Presumably, anyone on the Supreme Court who was appointed by a Republican. Who knows, though?  Are you voting for Trump?     Because this isn\u2019t serious talk. Even if the Democrats controlled the House, where impeachments happen \u2014 they don\u2019t \u2014 getting the two-thirds vote needed for conviction in the Senate has less than zero chance of happening. If such articles were filed and Ocasio-Cortez were to magically get some GOP votes to get a majority for them, all they would do is gum up the works of the lower and upper chambers of Congress in the months before the election for a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-bidens-supporters-go-on-the-offensive\/\" title=\"Hunter Biden\u2019s Supporters Go on  the Offensive\">partisan political exercise<\/a> in dismantling checks and balances, one that almost certainly would fail.  With the polls not trending the Democrats\u2019 way and Thursday\u2019s debate performance by Biden confirming the uphill battle AOC\u2019s party faces, this would be another self-inflicted wound going into November. But, chances are, she didn\u2019t think about this before she sent out this missive. Chances are she won\u2019t think about it afterward, either. In the moment, it felt right. However, when it comes to promising absurd, pyrrhic stands she has no intention of really making, maybe Ocasio-Cortez should take her own advice: Oh\u00a0girl, baby girl, don\u2019t even play.
