Thies<\/a><\/div>\n<\/div>\n<div class=\"tdb-block-inner td-fix-index\"><time class=\"entry-date updated td-module-date\" datetime=\"2024-07-01T18:36:26-04:00\">July 1, 2024 6:36 pm<\/time><\/div>\n<div class=\"tdb-block-inner td-fix-index\">\n<div id=\"Brid_1692621\" class=\"tpd-featured-video bridtv\"><\/div>\n<p>When the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\" target=\"_blank\" rel=\"noopener\" title>Supreme Court<\/a> overruled <em>Chevron<\/em> deference on Friday, it may have also stripped the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title>Biden<\/a> administration\u2019s only line of defense for overhauling <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/title-ix\/\" target=\"_blank\" rel=\"noopener\" title>Title IX<\/a>, experts say.<\/p>\n<p>The Title IX rewrite, which is set to take effect Aug. 1, redefined sex to include expansive claims of gender identity and, many critics say, foreclosed sex-specific facilities in schools such as restrooms and locker rooms. However, with the overturn of <em>Chevron<\/em>, the Biden administration may have lost the only way it could have defended the highly controversial rules governing the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-blue-state-claw-back\/\" title=\"Biden\u2019s Blue State Claw Back\">civil rights law<\/a>.<\/p>\n<p>\u201cFor a multitude of reasons, all of the Title IX litigants are virtually guaranteed success by the Supreme Court, but with <em>Chevron<\/em>\u2018s death knell, I would say that that is now doubly virtually guaranteed: Any deference that would have been automatically given to the Biden administration has just been completely eliminated,\u201d Sarah Parshall Perry, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/senator-josh-hawleys-wife-describes-frightening-evening-of-assault-on-family-home\/\" title=\"Senator Josh Hawley\u2019s Wife Describes \u201cFrightening\u201d Evening Of \u201cAssault\u201d On Family Home\">senior legal fellow<\/a> at the Heritage Foundation, told the <em>Washington Examiner<\/em>. <\/p>\n<p>The Title IX overhaul by the Department of Education is being challenged in court by 26 states through multiple lawsuits and has been blocked in 10 so far. Under <em>Chevron<\/em>, executive agencies were given deference by courts to their interpretations of \u201csilent or ambiguous\u201d statutes, but now courts will once again have the authority to interpret whether an agency has overstepped the meaning of the law rather than allowing agencies to define statutes for themselves.<\/p>\n<p>Prior to Title IX being finalized and <em>Chevron<\/em> being overturned, the Alliance Defending Freedom filed an <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/22\/22-451\/272674\/20230724105732487_22-451%20Merits%20Amicus%20Brief%20of%20Christian%20Employers%20Alliance.pdf\" target=\"_blank\" rel=\"noopener\" title>amicus brief<\/a> in <em>Loper Bright Enterprises v. Raimondo<\/em>, the Supreme Court case that overturned <em>Chevron<\/em>, arguing <em>Chevron<\/em> would have been used to defend the redefined statute, saying, \u201cThe agency will likely inevitably [invoke] <em>Chevron<\/em> deference\u201d in its legal defense of the new Title IX.<\/p>\n<p>\u201cNo court should be forced by <em>Chevron<\/em> to defer to the Department\u2019s claim that Title IX means the opposite of what it says,\u201d the brief stated. \u201cThe statute deals with discrimination on the basis of sex, not gender identity, and Title IX\u2019s direct reference to a male-female binary excludes any gender identity interpretation.\u201d<\/p>\n<p>Such deference, ADF argued, would have allowed the government to invoke harm on women and girls who would be forced to compete against males, compel speech through requiring teachers and students to use programs and names that are not consistent with biological sex, or have schools facilitate child gender transitions without the knowledge or consent of parents.<\/p>\n<p>\u201cAs things stand, <em>Chevron<\/em> remains a shield for executive-branch officials seeking to impose these harms,\u201d the ADF brief said.<\/p>\n<p>Perry said the Biden administration was relying on an argument that Title IX, a 37-word statute meant to protect women\u2019s educational opportunities, was ambiguous, as Biden administration officials believe sex could mean any multitude of things.<\/p>\n<p><em>Chevron<\/em> deference has only been invoked one time by the Department of Education, in a 2007 <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/550\/81.html\" target=\"_blank\" rel=\"noopener\" title>case<\/a> regarding the distribution of federal impact aid, but it has reentered the conversation amid all the changes the Biden administration made to Title IX.<\/p>\n<p>\u201cConceivably, the only reason that it\u2019s never been invoked is because the Department of Education has never taken such extensive liberties within an illegal interpretation of the law,\u201d Perry said, calling the overturn of <em>Chevron<\/em> as it relates to Title IX a \u201cform of insurance\u201d in the success of the legal challenges.<\/p>\n<p>Moreover, U.S. District Judge Danny C.
