The court\u2019s opinion written by Chief Justice John Roberts extended this to mean that the president\u2019s actions in an official capacity also can\u2019t be used as evidence that a crime was committed. <\/p>\n<p>While ruling with the majority on this case, Barrett released a concurring opinion in which she states that this is too far reaching and certain circumstances can arise where official actions can be used as evidence. <\/p>\n<p>\u201cA president facing prosecution may challenge the constitutionality of a criminal statute as applied to official acts alleged in the indictment,\u201d Barrett wrote. \u201cIf that challenge fails, however, he must stand trial.\u201d<\/p>\n<p>Barrett said sufficient procedures already exist in courts when dealing with official actions that indicate a crime was committed. <\/p>\n<p>\u201cIf the evidence comes in, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-yanks-trump-backed-hispanic-nominee-to-federal-appeals-court\/\" title=\"Biden Yanks Trump-Backed Hispanic Nominee to Federal Appeals Court\">trial court<\/a> can instruct the jury to consider it only for lawful purposes,\u201d Barrett wrote. \u201cI see no need to depart from that familiar and time-tested procedure here.\u201d<\/p>\n<p>Barrett pulled from Sotomayor, who wrote the court\u2019s dissenting opinion.<\/p>\n<p>\u201cThe Constitution does not require blinding juries to the circumstances surrounding conduct for which Presidents can be held liable,\u201d Barrett wrote.<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>The Supreme Court fell short of ruling directly on Trump\u2019s actions during the Jan. 6 Capitol riot.
