The first category includes acts that fall \u201cwithin his conclusive and preclusive constitutional authority\u201d and are therefore subject to \u201cabsolute immunity.\u201d The second category encompasses those actions for which a president is entitled to \u201cat least presumptive immunity from prosecution for all his official acts.\u201d Those actions are then to be litigated in court to determine whether they constitute an official or unofficial act before any prosecution can take place. The third category pertains to \u201cunofficial acts\u201d for which \u201cthere is no immunity.\u201d<\/p>\n<p>The ruling severely hampers Special Counsel Jack Smith\u2019s efforts to prosecute Trump ahead of the election by remanding several key questions back to the lower courts while outright rejecting other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/reality-tv-can-serve-a-purpose-but-last-week-it-failed\/\" title=\"Reality TV Can Serve A Purpose, But Last Week, It Failed\">claims made<\/a> by the DOJ. Congress is still permitted to hold a president accountable for official acts so that he can be removed from office. It\u2019s exactly what happened when the House impeached Trump for Jan. 6. The Senate voted to acquit.<\/p>\n<p>As Marc Thiessen <a href=\"https:\/\/x.com\/marcthiessen\/status\/1807798424193913275\">explained<\/a>, the DOJ is \u201cseeking to effectively retry him in the courts\u201d because they did not get their desired outcome in the Senate. <\/p>\n<p>But how would these leftist bootlickers know any different when Supreme Court Justice Sonia Sotomayor fanned the flames of hysteria by deliberately misrepresenting the majority\u2019s holding in her dissent?<\/p>\n<p>\u201cWhen [the president] uses his official powers in any way, under the majority\u2019s reasoning, he now will be insulated from criminal prosecution. Orders the Navy\u2019s Seal Team 6 to assassinate a political rival? Immune,\u201d Sotomayor falsely claims. \u201cOrganizes a military coup to hold onto power? Might set \u2018dangerous precedents\u2019 or whatever, but since conservatives have had to scramble to assert the president as king, legally he\u2019s in the clear. He could also bomb SCOTUS. Nothing of value there.\u201d<\/p>\n<p>Lawyer Bradley P. Moss had an unmitigated meltdown over the decision, suggesting Biden could execute Steve Bannon. Bannon was sent to prison on Monday by Biden\u2019s Department of Justice. <\/p>\n<p>\u201cAccording to the Supreme Court, President Biden can have the military execute Bannon in the prison showers tonight and be immune from prosecution,\u201d Moss <a href=\"https:\/\/x.com\/BradMossEsq\/status\/1807804756540211408\">posted<\/a> to X.
