href=\"https:\/\/www.washingtonexaminer.com\/tag\/law\/\" target=\"_blank\" rel=\"noopener\" title>law<\/a>, suspend electronic media transmission.\u201d<\/p>\n<p>If signed into law, the bill will establish \u201ca reasoned and balanced measure\u201d that addresses both the public\u2019s right to information and the concerns of emergency management agencies, according to the Big Island Press Club.<\/p>\n<p>\u201cThe governor or mayors\u2019 ability to suspend any and all \u2018electronic media transmissions\u2019 during a state of emergency creates a clear prior restraint on lawful <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/free-speech\/\" target=\"_blank\" rel=\"noopener\" title>free speech<\/a> and publication and violates the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/first-amendment\/\" target=\"_blank\" rel=\"noopener\" title>First Amendment<\/a> as upheld by the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/united-states\/\" target=\"_blank\" rel=\"noopener\" title>United States<\/a> <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\" target=\"_blank\" rel=\"noopener\" title>Supreme Court<\/a>,\u201d <a href=\"https:\/\/apnews.com\/us-news\/hawaii-josh-green-censorship-general-news-02a1a825beb8da8093b14894f22275a6\" target=\"_blank\" rel=\"noopener\" title>said<\/a> Chris Leonard, president of the Hawaii Association of Broadcasters. <\/p>\n<p>\u201cThe current statute clearly <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gop-says-surgeon-general-chilling-free-speech-via-big-tech\/\" title=\"GOP Says Surgeon General Chilling Free Speech Via Big Tech\">represents government overreach<\/a> in granting the state and county government a \u2018blank check\u2019 to shut down all electronic media transmission without providing an explanation for why this is necessary, what systems are affected, for how long, and how decisions would be made,\u201d he added. <\/p>\n<p>In a letter to Green, the Public First Law Center said state law provides Hawaii\u2019s governor with \u201ca robust array of powers\u201d to respond to emergencies.<\/p>\n<p>Brian Black, the center\u2019s executive director, said the bill \u201cdoes not limit any of these extraordinary powers\u201d but instead \u201cremoves <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/language\/\" target=\"_blank\" rel=\"noopener\" title>language<\/a> that is overly broad, vague, and very likely unconstitutional if exercised.\u201d<\/p>\n<p>However, in his veto-intent message on June 21, Green said the state \u201cmust still guard against acts of extreme violence or acts of <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/terrorism\/\" target=\"_blank\" rel=\"noopener\" title>terrorism<\/a> which can use <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/social-media\/\" target=\"_blank\" rel=\"noopener\" title>social media<\/a> or other electronic media to communicate and activate crowds or destructive devices.\u201d<\/p>\n<p>The bill passed both chambers unanimously.<\/p>\n<p>\u201cThe hunger for fact\u2010based information is never more intense than during an emergency, and when that information is hard to come by, people often resort to rumors and speculation,\u201d Big Island Press Club President Tiffany Edwards Hunt said. \u201cOne would think that\u2019s the last thing the government would want in a declared emergency.\u201d<\/p>\n<p>James Barros, Hawaii Emergency Management Agency administrator, acknowledged concerns to the <em>Associated Press<\/em> about possible suppression of free speech. <\/p>\n<p>But he also said, \u201cWe\u2019re pretty confident that this current governor wouldn\u2019t do that.\u201d <\/p>\n<p>He argued the agency wants to provide an amendment aimed at preventing any future governor from exercising these powers \u201cin a very negative manner\u201d while still providing \u201cthe governor with some flexibility.\u201d<\/p>\n<p><a to sign, veto, or let the bill become law without his signature.
