The Justice Department\u200d declined to explore criminal charges against Garland, prompting\u200b House Republicans to\u200c take\u2062 the matter to court. The next step in the process will be for the Justice Department to file a response to the lawsuit.<\/p>\n<p>The House voted to <a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/3039546\/merrick-garland-criminal-referral-contempt-congress\/\" target=\"_blank\" rel=\"noopener\" title=\"hold Garland in contempt of Congress\">hold Garland in contempt of Congress<\/a> in June, sending a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/grassley-demands-doj-fbi-update-status-of-investigation-into-kavanaughs-fraudulant-accusers\/\" title=\"Grassley Demands DOJ, FBI Update Status Of Investigation Into Kavanaugh\u2019s \u2018Fraudulant\u2019 Accusers\">criminal referral<\/a> to the DOJ. However, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tuberville-wants-biden-to-retaliate-against-china-for-sanctions-against-trump-officials\/\" title=\"Tuberville Wants Biden to Retaliate Against China for Sanctions Against Trump Officials\">department declined<\/a> to explore criminal charges against its leader, angering House Republicans who said they would take the matter to court.<\/p>\n<p>Garland was held in contempt after he rejected a subpoena from House Republicans in February to provide access to the audio recordings. The DOJ has already published the full transcripts of those interviews, arguing they are sufficient for Republicans\u2019 impeachment inquiry. The White House has also <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-denies-donald-trumps-request-to-block-white-house-records-from-january-6-committee\/\" title=\"Supreme Court Denies Donald Trump\u2019s Request To Block White House Records From January 6 Committee\">cited executive privilege<\/a>.<\/p>\n<p>Republicans have insisted that the audio recording is necessary to assess the integrity of Hur\u2019s investigation into Biden\u2019s handling of classified documents. Though the president\u2019s conduct posed \u201cserious risks to <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/national-security\/\" target=\"_blank\" rel=\"noreferrer noopener\">national security<\/a>,\u201d Hur said in his report that he did not charge Biden because he believed a jury would find him a \u201csympathetic, well<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hur-report-portrays-biden-as-elderly-man-with-poor-memory\/\" title=\"Report depicts Biden as &#039;aging individual&#039; with &#039;impaired recollection\">-meaning elderly man<\/a> with a poor memory\u201d and likely not convict him for this reason.<\/p>\n<p>In the lawsuit, the Judiciary Committee is asking the court to overrule the \u201cfrivolous\u201d and \u201cself-serving\u201d assertion of executive privilege, arguing that the audio recording would allow committee members to determine the way Biden \u201cpresented himself during the interview\u201d \u2014 including voice inflection, tone, and pace of speech. <\/p>\n<p>\u201cThe audio recordings, not the cold transcripts, are the best available evidence of how President Biden presented himself during the interview,\u201d the lawsuit states. \u201cThe Committee thus needs those recordings to assess the Special Counsel\u2019s characterization of the President, which he and White House lawyers have forcefully disputed, and ultimate recommendation that President Biden should not be prosecuted.\u201d<\/p>\n<p>On the other side, <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/House-Democrats\/\" target=\"_blank\" rel=\"noreferrer noopener\">House Democrats<\/a> have blasted Republicans for politicizing the issue and wanting the audio recording for \u201cDonald Trump\u2019s campaign commercials\u201d or to use Biden\u2019s stutter to \u201csmear\u201d him.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>The lower chamber has <a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/3059740\/house-gop-sue-access-biden-hur-tapes-next-week-johnson\/\" target=\"_blank\" rel=\"noopener\" title>floated a vote<\/a> on an \u201cinherent contempt\u201d resolution led by Rep. Anna Paulina Luna (R-FL) as another pathway toward obtaining the recording. Some GOP lawmakers have called her measure unnecessary, while others believed it would pass if it was brought to the floor.
