Hur&#8217;s report, released in February, \u2062had\u200c been controversial\u2062 for addressing Biden&#8217;s \u2064memory issues\u2063 as observed during\u200d an investigation on\u2063 mishandling classified documents.\u2062 Critics,\u2064 such as Tom Fitton \u200bfrom Judicial Watch, argue \u2064that the debate underscores the need to \u2064<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-under-pressure-to-produce-audio-of-biden-interview-with-hur\/\" title=\"Department of Justice urged to release recording of Biden&#039;s discussion with Hur\">release audio recordings<\/a> of Biden&#8217;s interview with \u200bHur to provide contextual evidence \u2063of his condition. Hur had ultimately decided against prosecuting Biden, \u2063citing his poor memory as a\u2064 factor indicating that Biden may not\u200d have intentionally mishandled\u200c classified information. This decision \u200cand \u2064the report&#8217;s mention of Biden&#8217;s\u200c memory issues, especially related to\u200b his late \u200cson Beau&#8217;s death, were heavily criticized by the White House. Republicans and other advocates are now \u200bpushing for \u2064the \u2063release of the interview recordings, asserting that their contents are of public\u200b interest and criticizing \u200cany resistance as political shielding.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\" target=\"_blank\" rel=\"noopener\" title=\"Joe Biden\">Joe Biden<\/a>&rsquo;s struggling debate performance Thursday night sent shock waves of anxiety across the Democratic Party, but it also served as a vindicating moment for former special counsel <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/robert-k-hur\/\" target=\"_blank\" rel=\"noopener\" title>Robert Hur<\/a>.<\/p>\n<p>As Biden, 81, stumbled over his words, speaking incoherently at times or staring blankly as his opponent spoke, viewers pointed out that his mental fitness was foreshadowed in Hur&rsquo;s report on the president&rsquo;s handling of classified documents.<\/p>\n<p>At the time of the report&rsquo;s release in February, Hur was sharply criticized by the White House and Democrats for including details in it about Biden&rsquo;s declining memory.<\/p>\n<p>Some, such as Tom Fitton, president of the conservative watchdog Judicial Watch, found the debate placed newfound importance on the Department of Justice releasing audio recordings of the interview Hur conducted with Biden last year as part of his investigation.<\/p>\n<p>&ldquo;Obviously the manner and the tone can only be ascertained by the audio, and as we saw last night, that helps one draw certain conclusions,&rdquo; Fitton said, adding that the debate &ldquo;highlights why there&rsquo;s a public interest in the release of the tapes.&rdquo;<\/p>\n<p>Hur declined to prosecute Biden for mishandling classified material, in part because he said the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-tells-house-speaker-garland-wont-be-prosecuted-for-contempt\/\" title=\"DOJ informs House speaker that Garland will not face prosecution for contempt\">president displayed memory problems<\/a> during their interview. Biden came off as a &ldquo;sympathetic, well-meaning, elderly man with a poor memory&rdquo; who could give a jury pause as to whether he acted intentionally, Hur wrote.<\/p>\n<p>White House counsel at the time said those details were &ldquo;inflammatory&rdquo; and asked for them to be revised.<\/p>\n<p>Biden himself <a href=\"https:\/\/www.google.com\/search?q=how+in+the+hell+dare+he+raise+that&amp;rlz=1C5GCCM_en&amp;oq=how+in+the+hell+dare+he+raise+that&amp;gs_lcrp=EgZjaHJvbWUyBggAEEUYOTIKCAEQABgKGBYYHjINCAIQABiGAxiABBiKBTINCAMQABiGAxiABBiKBTINCAQQABiGAxiABBiKBTIKCAUQABiABBiiBDIKCAYQABiABBiiBNIBCDMwNDJqMGo0qAIAsAIB&amp;sourceid=chrome&amp;ie=UTF-8#fpstate=ive&amp;vld=cid:5e6ffc94,vid:LMyO_rNMzpA,st:0\" target=\"_blank\" rel=\"noopener\" title>rebuked<\/a> Hur, particularly for the special counsel&rsquo;s observation that the president did not remember when his son Beau died.<\/p>\n<p>&ldquo;How in the hell dare he raise that,&rdquo; Biden said. &ldquo;Frankly, when I was asked the question, I thought to myself it wasn&rsquo;t any of their damn business.&rdquo;<\/p>\n<p>Republican-led House committees took particular interest in obtaining Hur&rsquo;s interview recordings, and as they <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2986747\/doj-under-pressure-to-produce-audio-of-biden-interview-with-hur\/\" target=\"_blank\" rel=\"noopener\" title>ramped up<\/a> pressure on the DOJ for them, Biden last month made an eleventh-hour assertion of executive privilege over the tapes. Republicans have since vowed to file a lawsuit to obtain them.<\/p>\n<p>Fitton&rsquo;s group has joined other entities, including a CNN-led <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/soros-gives-another-32-million-to-groups-calling-for-pre-midterms-censorship\/\" title=\"Soros Gives Another  Million to Groups Calling for Pre-Midterms Censorship\">media coalition<\/a>, in taking their own legal measures to obtain recordings of the interview.<\/p>\n<p>&ldquo;They don&rsquo;t like what the consequence politically of the tapes&rsquo; release will be,&rdquo; Fitton said. &ldquo;The transcript obviously doesn&rsquo;t tell the full story.&rdquo;<\/p>\n<p>Rep. Anna Paulina Luna (R-FL), who is pushing to hold Attorney General Merrick Garland in &ldquo;inherent contempt&rdquo; over his refusal to provide the recordings to Congress, indicated her efforts to use the obscure congressional procedure are more relevant after the debate.<\/p>\n<p>&ldquo;Garland is actually engaging now in what I believe is a cover-up, and we need access to the tapes,&rdquo; Luna told reporters Friday. &ldquo;A lawsuit can take months to years.&rdquo;<\/p>\n<p>Former Trump White House press secretary Kayleigh McEnany was among many who commented on X about Hur during the debate.<\/p>\n<p>&ldquo;Biden is worse than anyone knew. Robert Hur must have been truly shocked,&rdquo; McEnany said. &ldquo;Now the country is.&rdquo;<\/p>\n<p>Several other commentators <a href=\"https:\/\/x.com\/redsteeze\/status\/1806520178848534885\" target=\"_blank\" rel=\"noopener\" title>said<\/a> Hur was owed an apology for making an accurate assessment about Biden at the expense of the special counsel&rsquo;s reputation among Democrats.<\/p>\n<p>Rep.
