This situation \u2064underscores the ongoing contentious nature of Trump&#8217;s legal\u2064 battles and the \u200cpolarized responses they evoke among\u2063 public and legal \u200bcommentators.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/%20\"><span>Jack Davis<\/span><\/a> <\/span> <span>   June 27, 2024 at 5:09pm <\/span> <\/span>  <\/header>\n<section>\n<p>A major court ruling that went against former President Donald Trump in his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-asks-supreme-court-to-reject-trump-request-in-fbi-classified-documents-case\/\" title=\"DOJ Asks Supreme Court to Reject Trump Request in FBI Classified Documents Case\">classified documents case<\/a> will be re-examined and could be reversed.<\/p>\n<p>The ruling against Trump was described by <a href=\"https:\/\/www.nytimes.com\/2024\/06\/27\/us\/politics\/trump-lawyer-documents-case.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a> as a \u201chugely consequential legal victory\u201d and one of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-is-an-american-legal-giant\/\" title=\"Sidney Powell Is an American Legal Giant\">special counsel<\/a> Jack Smith\u2019s \u201cmost significant legal successes.\u201d<\/p>\n<p>Should U.S. District Court Judge <a href=\"https:\/\/www.westernjournal.com\/judge-presiding-trump-documents-case-smacks-special-counsel-jack-smith\/\" target=\"_blank\" rel=\"noopener\">Aileen Cannon<\/a> reverse the ruling, the Times said such a ruling \u201ccould deal a serious blow to the obstruction charges in the indictment of Mr. Trump.\u201d<\/p>\n<p>The ruling centers around what is known as the crime-fraud exception, in which the government is allowed to end run attorney-client privilege if it can prove legal advice was used to commit a crime.<\/p>\n<p>Last year, a federal judge in Washington ruled that advice from Trump lawyer M. Evan Corcoran was used by Trump to obstruct efforts to secure classified documents in Trump\u2019s possession.<\/p>\n<p>Trump\u2019s <a href=\"https:\/\/www.westernjournal.com\/judge-cannon-issues-ruling-trump-prosecutors-big-order\/\" target=\"_blank\" rel=\"noopener\">legal team<\/a> sought to push back against that ruling.<\/p>\n<p>\u201cThere is nothing unduly prejudicial or legally erroneous about Defendant Trump\u2019s fact-development request as brought in the Motion to Suppress,\u201d Cannon wrote Thursday <a href=\"https:\/\/www.washingtonpost.com\/documents\/a7e46b7f-826c-4243-a148-4bf1a517674d.pdf?itid=lk_inline_manual_4\" target=\"_blank\" rel=\"noopener\">in her ruling<\/a>.<\/p>\n<p>She said Trump\u2019s motion \u201cmakes clear that he disputes important factual findings reached by the United States District Court for the District of Columbia in the grand jury proceeding\u201d connected with the case.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Should Judge Cannon nullify the prosecution\u2019s earlier victory?<\/p>\n<\/p><\/div>\n<p>Cannon wrote that \u201calthough the Special Counsel may wish to avoid any cross-examination of any of its witnesses in a pre-trial evidentiary hearing\u2014and although the Court acknowledges that prosecutorial interest\u2014that position cannot overcome a defendant\u2019s right to make a proper, even if tailored, factual record on an important claim of privilege with constitutional dimensions.\u201d<\/p>\n<p>Noting Smith\u2019s objections, she wrote that there was \u201ca difference between a resource-wasting and delay-producing \u2018mini-trial,\u2019 on the one hand, and an evidentiary hearing geared to adjudicating the contested factual and legal issues on a given <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jury-selection-resumes-in-derek-chauvin-trial-half-chosen\/\" title=\"Jury selection resumes in Derek Chauvin trial, half chosen\">pre-trial motion<\/a> to suppress, on the other.\u201d<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">Judge Aileen Cannon gives Donald Trump more chances to challenge key evidence in his classified documents case and pushes back on the idea that more hearings delay the case <a href=\"https:\/\/t.co\/YJn8Ev0ZCU\">https:\/\/t.co\/YJn8Ev0ZCU<\/a><\/p>\n<p>\u2014 CNN (@CNN) <a href=\"https:\/\/twitter.com\/CNN\/status\/1806396406355140824?\">June 27, 2024<\/a><\/p>\n<\/blockquote>\n<p>\u201cBut it is an evidentiary hearing nonetheless, and it is before this Court\u2014in this post-indictment context\u2014 to make factual findings on contested questions pertinent to the \u2026 crime-fraud exception,\u201d she wrote.<\/p>\n<p>Cannon also said a hearing should be held on concerns from the Trump team that terms surrounding the<a href=\"https:\/\/www.westernjournal.com\/just-biden-admin-authorized-deadly-use-force-mar-lago-raid\/\" target=\"_blank\" rel=\"noopener\"> search of Mar-a-Lago<\/a> in 2022 were too vague.<\/p>\n<p>She wrote that \u201cthe Court determines that some of the terms in that document (e.g., \u2018national defense information\u2019 and \u2018Presidential Records\u2019), do not carry \u2018generally understood meaning[s]\u2019 such that a law enforcement agent, without further clarification, would have known to identify such material as \u2018seizable\u2019 property.\u201d<\/p>\n<p>Cannon did not set dates for the hearing.<\/p>\n<p>Trump campaign spokesman Steven Cheung said Cannon is simply acknowledging the flaws in the Justice Department\u2019s case against Trump.<\/p>\n<p>\u201cThe entire documents case was a political sham from the very beginning, and it should be thrown out entirely,\u201d Cheung said, according to <a href=\"https:\/\/www.cnn.com\/2024\/06\/27\/politics\/aileen-cannon-trump-mar-a-lago-search-warrant-hearing\/index.html\" target=\"_blank\" rel=\"noopener\">CNN<\/a>.<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>\u201cWe don\u2019t even know if an election will be held in 2024.\u201d Those 12 words have been stuck in my head since I first read them. <\/span><\/i><\/p>\n<p><i><span>Former Lt.
