Jarkesy. The ruling emphasizes that \u2063<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/philadelphia-d-a-begins-restorative-justice-program-that-may-keep-people-arrested-during-2020-uprisings-out-of-jail\/\" title=\"Philadelphia D.A. Begins Restorative Justice Program That May Keep People Arrested During 2020 Uprisings Out Of Jail\">individuals accused<\/a> by the Securities and \u200cExchange Commission\u200c (SEC)\u2064 of\u2064 fraud are entitled to be judged by a jury of their peers. Chief Justice John Roberts\u2062 stressed the necessity for separation of powers, criticizing any setup where the\u2062 roles \u200dof prosecutor,\u200b judge, and jury are combined\u200b within\u200b the executive branch, contrary to constitutional \u200cmandates. Justice\u200c Sonia \u2064Sotomayor, in dissent, expressed concerns that this decision undermines the administrative state, which she believes plays a\u2062 vital role \u200din upholding the\u200b rule of law.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<div>\n<div>\n<figure>                         <\/figure>\n<\/p><\/div>\n<p>The Supreme Court affirmed the constitutional right to trial by jury on Thursday in a decision kneecapping the administrative state\u2019s ability to go around throwing people in jail with no checks.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mississippi-supreme-court-strikes-down-voter-approved-medical-marijuana-initiative\/\" title=\"Mississippi Supreme Court Strikes Down Voter-Approved Medical Marijuana Initiative\">high court ruled 6-3<\/a> in <em>SEC v. Jarkesy<\/em> that individuals accused by the SEC of fraud have a constitutional right to a trial by jury.<\/p>\n<p>\u201cA defendant facing a fraud suit has the right to be tried by a jury of his peers before a neutral adjudicator,\u201d Chief Justice John Roberts <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-859_1924.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> for the majority. \u201cRather than recognize that right, the dissent would permit Congress to concentrate the roles of prosecutor, judge, and jury in the hands of the Executive Branch. That is the very opposite of the separation of powers that the Constitution demands.\u201d<\/p>\n<p>Justice Sonia Sotomayor, dissenting, lamented that the ruling would hinder the administrative state. <\/p>\n<p>\u201cLitigants seeking further dismantling of the \u2018administrative state\u2019 have reason to rejoice in their win today, but those of us who cherish the rule of law have nothing to celebrate,\u201d Sotomayor wrote, adding that a \u201cscheme like the SEC\u2019s\u201d is \u201cgood\u201d because apparently letting the government serve as both the jury and prosecutor can result in \u201cgreater efficiency and expertise, transparency and reasoned decisionmaking.\u201d<\/p>\n<p>Notably, the majority cited a 1957 Supreme Court case that found the right to a trial by jury is to protect individuals \u201cagainst the passing demands of expediency or convenience.\u201d<\/p>\n<p>The case was brought forward by hedge fund manager George R. Jarkesy, who was charged for alleged violations of the Dodd-Frank Act. The SEC, per the Supreme Court, \u201cmay bring an enforcement action in one of two forums\u201d by either filing a suit in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-is-fast-tracking-sidney-powells-request-for-a-forensic-exam-of-dominion-voting-machines\/\" title=\"Federal Court Is Fast-Tracking Sidney Powell\u2019s Request For A Forensic Exam Of Dominion Voting Machines\">federal court<\/a> or adjudicating the matter in-house. A jury is used in cases that go to federal court. The SEC chose to charge Jarkesy and his firm, Patriot28, in-house, which led to a $300,000 civil fine.<\/p>\n<p>A panel for the 5th U.S. Circuit Court of Appeals threw out the financial penalties against Jarkesy and his firm, ruling the case  should have been heard in federal court rather than before the SEC\u2019s in-house judge. <\/p>\n<p>The appeals court also <a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/20\/20-61007-CV0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">found<\/a> Congress acted unconstitutionally when it gave the SEC \u201cunfettered authority\u201d to decide whether to try a case in-house or in a court of law, finding that adjudicating the matter in-house violated the Seventh Amendment right to a trial by jury.
