They argued \u2064that the\u2064 law denied\u200c legal protections\u200b to people whose <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-has-signed-40-executive-orders-and-actions-since-taking-office\/\" title=\"Biden has signed 40 executive orders and actions since taking office\">gender identity<\/a> did not conform\u200d to the traditional definitions \u2064of male or female.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div data-td-block-uid=\"tdi_79\">\n<p>A <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/montana\/\" target=\"_blank\" rel=\"noopener\" title>Montana<\/a> judge deemed a<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/law\/\" target=\"_blank\" rel=\"noopener\" title> law<\/a> defining sex in terms of only male or female to be in violation of the state\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/constitution\/\" target=\"_blank\" rel=\"noopener\" title>constitution<\/a> since the legislation\u2019s description did not clearly state its purpose. <\/p>\n<p>Members of the LGBT community filed a lawsuit against the bill, which was passed last year, claiming it denied legal protections to people who did not fit into either male or female. <\/p>\n<p>District Court Judge Shane Vannatta in Missoula struck down the bill \u2014 but not on the grounds that it ignored the protections of transgender and nonbinary individuals. Rather, she said it was unclear if the bill\u2019s title was referring to \u201csex\u201d as either sexual intercourse or gender. In addition, Vannatta stated that the bill\u2019s title failed to indicate the words \u201cfemale\u201d and \u201cmale\u201d in the bill\u2019s body. <\/p>\n<p>\u201cThe title does not give general notice of the character of the legislation in a way that guards against deceptive or misleading titles,\u201d Vannatta wrote.<\/p>\n<p>Sen. Carl Glimm (R-MT) sponsored the legislation in\u00a0response to a 2022 court ruling in which a state judge said transgender people could change the gender listed on their birth certificates.<\/p>\n<p>The bill looked to \u201cprovide a common definition for the word sex when referring to a human,\u201d the text reads. <\/p>\n<p>Sedan Southard, spokesman for Gov. Greg Gianforte (R-MT), <a href=\"https:\/\/montanafreepress.org\/2024\/06\/26\/judge-strikes-down-montana-law-defining-sex-as-only-male-or-female-for-procedural-reasons\/\" target=\"_blank\" rel=\"noopener\" title>told<\/a> the <em>Associated Press<\/em> the governor stands by the law which legally defines what has always been the understanding of what a male and female are.<\/p>\n<p>\u201cWords matter.
