United States decided to send the Biden administration\u2019s legal challenge against Idaho&#8217;s restrictive abortion laws back to the lower courts, stating the case was &#8220;improvidently granted&#8221; and will not receive a decision on\u2063 merit at this time. The court had previously issued a stay favoring Idaho,\u2062 allowing the state to enforce\u2063 its strict abortion regulations \u2062which only allow exceptions in cases \u200bof rape, \u2062incest, or when the mother&#8217;s life is at risk. The legal battle centers around the interpretation\u200d of the Emergency Medical Treatment and Labor Act (EMTALA), which mandates hospitals\u2062 to provide\u200d necessary stabilizing treatments to patients, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/briefing-readout-no-mention-of-abortion-in-joe-bidens-meeting-with-pope-francis\/\" title=\"Briefing Readout: No Mention of Abortion in Joe Biden\u2019s Meeting with Pope Francis\">including unborn children<\/a>, without consideration of state laws. This \u2062case raised questions about whether\u2062 the EMTLA can override state laws that strictly limit abortion. The ruling \u2064means\u200c that the Ninth Circuit Court of Appeals, known \u200bfor its liberal\u200d leanings,\u2063 will ultimately decide the issue. The Justices offered differing reasons in their concurring opinions, \u200cwith some\u2064 highlighting changes in the case&#8217;s context and others \u2062discussing the implications of the court&#8217;s refusal to fully engage with the broader questions regarding state\u200b abortion bans and federal laws.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The U.S. Supreme Court decided in a <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-726_6jgm.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">6-3 ruling<\/a> in <em>Moyle v. United States<\/em> on Thursday to toss the Biden administration\u2019s attempt to force its abortion activism on pro-life states such as Idaho back to lower courts. The majority of justices agreed that, despite issuing a previous stay that\u00a0favored Idaho, the case was \u201cimprovidently granted\u201d and will not receive a merit judgment at this time.<\/p>\n<p>Chief Justice John Roberts, Justices Amy Coney Barrett, Brett Kavanaugh, Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson did not technically side with the Biden administration\u2019s drastic expansion of the Emergency Medical Treatment and Labor Act (EMTALA), which the Centers for Medicare and Medicaid Services redefined at the bidding of  <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2022-07-13\/pdf\/2022-15138.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">President Joe Biden<\/a> shortly after the <em>Dobbs v. Jackson<\/em> ruling. They did, however, keep with a <a href=\"https:\/\/archive.ph\/t5VF3\" target=\"_blank\" rel=\"noreferrer noopener\">leaked<\/a> version of their decision when they refused to curb the bureaucracy\u2019s abortion activism. <\/p>\n<p>EMTALA was enacted in 1986 to stop hospitals from turning away patients based on their inability to pay for their expenses. The law not only mandates adequate treatment for the <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/1395dd\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cunborn child\u201d<\/a> but also explicitly does \u201cnot preempt any State or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-department-sues-to-block-idaho-pro-life-law-in-first-suit-since-dobbs-ruling\/\" title=\"Justice Department Sues To Block Idaho Pro-Life Law In First Suit Since Dobbs Ruling\">local law requirement<\/a>, except to the extent that the requirement\u00a0directly\u00a0conflicts with\u201d EMTALA.<\/p>\n<p>CMS, however, <a href=\"https:\/\/www.cms.gov\/files\/document\/qso-22-22-hospitals.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a> that\u00a0EMTALA, which on its face poses no conflict to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-vice-president-mike-pence-joins-the-heritage-foundation\/\" title=\"Former Vice President Mike Pence Joins The Heritage Foundation\">pro-life policies<\/a>, was broad enough to include abortion as a \u201cstabilizing\u201d procedure \u201cirrespective of any state laws or mandates that apply to specific procedures.\u201d <\/p>\n<p>Idaho\u2019s Defense of Life Act, which went into effect in August 2022, prohibits abortion except in cases of rape or incest, or if a physician deems it necessary to save the mother\u2019s life. Despite the fact that Idaho, <a href=\"https:\/\/lozierinstitute.org\/pro-life-laws-protect-mom-and-baby-pregnant-womens-lives-are-protected-in-all-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">like every pro-life state<\/a>, included lifesaving provisions in its <a href=\"https:\/\/idahofamily.org\/new-poll-results-idaho-voters-on-abortion\/\" target=\"_blank\" rel=\"noreferrer noopener\">popular<\/a> law, the Biden administration sued Idaho using its reinterpretation of the\u00a0Reagan-era act.<\/p>\n<p>The Supreme Court issued a stay in January that allowed the enforcement of the life-saving law throughout the judicial process.\u00a0On Thursday, however, the court majority ruled to lift the stay, giving the <a href=\"https:\/\/www.law.com\/nationallawjournal\/2023\/04\/13\/how-liberal-is-the-9th-circuit-new-study-takes-deep-dive\/#:~:text=For%20decades%2C%20the%20U.S.%20Court,extremely%20liberal%20federal%20appellate%20court.\" target=\"_blank\" rel=\"noreferrer noopener\">leftist<\/a> San Francisco-based Ninth Circuit Court of Appeals the final say on the matter.<\/p>\n<p>The court did not offer a majority opinion explaining the reasoning behind the decision. Instead, the six justices who ruled to punt the case offered vastly different reasons for doing so in several separately written concurring opinions.<\/p>\n<p>In her concurring opinion, Barrett, joined by Roberts and Kavanaugh, claimed the case required dismissal because \u201cthe shape \u2026 has substantially shifted since we granted certiorari.\u201d<\/p>\n<p>Justice Elena Kagan was more forward in her concurring commentary, celebrating that the court\u2019s refusal to rule \u201cwill prevent Idaho from enforcing its abortion ban when the termination of a pregnancy is needed to prevent serious harms to a woman\u2019s health.\u201d<\/p>\n<p>Justice Ketanji Brown Jackson, who <a href=\"https:\/\/thefederalist.com\/2022\/03\/23\/judge-nominated-to-supreme-court-on-the-basis-of-her-sex-cant-define-woman\/\" target=\"_blank\" rel=\"noreferrer noopener\">famously refused<\/a> to define woman during her 2022 confirmation hearing, sided with the majority but lamented in her <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-deals-blow-to-epas-power-to-regulate-waters\/\" title=\"Supreme Court limits EPA's authority over water regulation.\">separate concurring opinion<\/a> that the court\u2019s decision was a \u201cdelay\u201d instead of the \u201cvictory for pregnant patients in Idaho\u201d that she hoped for.<\/p>\n<p>\u201cWhile this court dawdles and the country waits, pregnant people experiencing emergency medical conditions remain in a precarious position, as their doctors are kept in the dark about what the law requires,\u201d Jackson wrote.<\/p>\n<p>In his dissent with Justices Clarence Thomas and Neil Gorsuch, Justice Samuel Alito noted that he believes \u201cthe Court has simply lost the will to decide the easy but emotional and highly politicized question that the case presents.\u201d Because of the court\u2019s refusal, Alito said, \u201can important and unsettled question\u201d remains.<\/p>\n<p>\u201cEven if the Court is unwilling to decide the statutory interpretation question, there is no excuse for vacating the stay of the preliminary injunction,\u201d he wrote. <\/p>\n<p>During arguments, U.S. Solicitor General Elizabeth Prelogar <a href=\"https:\/\/thefederalist.com\/2024\/04\/24\/biden-admins-top-lawyer-cant-explain-to-scotus-how-a-1986-law-suddenly-mandates-abortion\/\" target=\"_blank\" rel=\"noreferrer noopener\">struggled to explain<\/a> to Alito how a federal law that promotes preserving the health of the mother and her \u201cunborn child\u201d in medical emergencies should require Idaho hospitals to perform abortions against exceptions outlined in its state law.<\/p>\n<p>Alito confirmed on Thursday that the \u201ctext of EMTALA shows clearly that it does not require hospitals to perform abortions in violation of Idaho law.\u201d <\/p>\n<p>\u201cTo the contrary, EMTALA obligates Medicare-funded hospitals to <em>treat<\/em>, not abort, an \u2018unborn child,\u2019\u201d he concluded.<\/p>\n<hr>\n<p>      Jordan Boyd is a staff writer at The Federalist and producer of The Federalist Radio Hour.
