The\u200b decision was\u200c closely split with a 5-4 vote. The EPA&#8217;s &#8220;good\u2064 neighbor&#8221; plan aimed to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/epa-emergency-waiver-lifts-restrictions-in-ethanol-gasoline-in-desperate-attempt-to-lower-prices\/\" title=\"EPA Emergency Waiver Lifts Restrictions in Ethanol Gasoline in Desperate Attempt to Lower Prices\">limit emissions<\/a> from power plants and other industrial \u2063sources in\u200c 11 states,\u200c addressing\u200b pollutants that affect air quality across state lines. \u2062However, the \u200cplan, \u200boriginally \u200daffecting 23 states,\u200c faced legal\u2064 challenges led by Republican\u2062 states including Ohio, Indiana, and West Virginia. These \u200bstates claimed the EPA exceeded its authority and imposed costly, ineffective \u2062measures. Justices Sonia \u200bSotomayor,\u2062 Elena Kagan, Amy Coney Barrett, and Ketanji Jackson\u2062 dissented against the majority decision.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The <a href=\"http:\/\/washingtonexaminer.com\/tag\/supreme-court\/\" target=\"_blank\" rel=\"noopener\" title>Supreme Court<\/a> on Thursday<a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23a349_0813.pdf\" target=\"_blank\" rel=\"noopener\" title=\" struck down\"> struck down<\/a> an <a href=\"http:\/\/washingtonexaminer.com\/tag\/epa\/\" target=\"_blank\" rel=\"noopener\" title>Environmental Protection Agency<\/a> rule cracking down on power plant pollution, in yet another blow to the Biden administration as it looks to deliver on its decarbonization goals.<\/p>\n<p>Justices <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2866858\/supreme-court-ready-block-good-neighbor-pollution-rule\/\" target=\"_blank\" rel=\"noopener\" title=\"voted 5-4 to block \">voted 5-4 to block <\/a>the EPA\u2019s so-called \u201cgood neighbor\u201d plan, which sought to strictly limit <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-epa-puts-americas-biggest-oil-field-in-its-regulatory-crosshairs\/\" title=\"Biden\u2019s EPA Puts America\u2019s Biggest Oil Field in its Regulatory Crosshairs\">ozone pollution<\/a> from power plants and other industrial sources in 11 U.S. states, including air pollutants that the agency said can drift downwind into other states and cause additional harm.<\/p>\n<p>Justices Sonia Sotomayor, Elena Kagan, Amy Coney Barrett, and Ketanji Jackson dissented.<\/p>\n<p>The EPA\u2019s plan, which originally applied to 23 states and was intended to provide a national solution to ozone pollution, was met instead with litigation from Republican-led lawsuits.<\/p>\n<p>In September 2023, Ohio, Indiana, and West Virginia filed an emergency request to the Supreme Court, arguing that the EPA had overstepped its authority in imposing the plan and that it imposed costly and ineffective burdens on their states.<\/p>\n<p>Plaintiffs further argued that the EPA rule should not be enforceable because it relied on the assumption that all 23 states the agency put on notice in the rule would participate in the \u201cgood neighbor\u201d plan.<\/p>\n<p>Because <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-supreme-court-rules-that-democrats-in-legislature-can-be-arrested-to-compel-attendance\/\" title=\"Texas Supreme Court Rules That Democrats In Legislature Can Be Arrested To Compel Attendance\">lower court action<\/a> is pending in 12 states, it is on pause there \u2014 prompting complaints by the remaining 11 states that they are unfairly tasked with bearing the brunt of the burden.<\/p>\n<p>The ruling comes as the Supreme Court\u2019s 6-3 conservative majority has taken a more skeptical view of the discretion that administrative agencies should have on the rulemaking process, including regulations related to matters on climate and the environment.<\/p>\n<p>In 2022, the Supreme Court issued a sweeping decision that limited the EPA\u2019s ability to regulate carbon emissions from power plants. Last year, the court weakened the Clean Water Act by limiting the agency\u2019s ability to regulate wetlands.<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a> <\/p>\n<p>The Supreme Court is poised to soon determine whether to overturn <em>Chevron<\/em> deference, a decades-old court doctrine giving administrative agencies broad discretion to write rules, which could expose the <a href=\"http:\/\/washingtonexaminer.com\/tag\/biden-administration\/\" target=\"_blank\" rel=\"noopener\" title=\"Supreme Court\">Biden administration<\/a>\u2018s climate and clean energy regulations to further legal challenges.<\/p>\n<p>At issue is the legal test <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/rules\" target=\"_blank\" rel=\"noopener\" title=\"established\">established<\/a> by the Supreme Court in its 1984 <em>Chevron U.S.A. v.
