The decision was \u2064made by\u200c the \u2062Bipartisan\u2062 Legal Advisory Group, which includes House leaders and whips\u200c from\u200b both \u200bmajor parties. The decision to file was passed\u200b by a \u200cvote\u2064 of 3-2 along\u200b party lines, with Republican leaders in favor and Democratic leaders \u2064opposed.<\/p>\n<p>The brief itself will be submitted to the D.C.\u2063 Circuit court after Bannon seeks a rehearing, and it\u2062 will\u200d be neutral, supporting \u200dneither party involved in the case. This move comes\u200c as House Republican leadership expresses continued belief that former Speaker Nancy Pelosi\u2062 had misused her authority in the organization of the Select Committee tasked with investigating the January\u200d 6 attack on the U.S. Capitol. The \u2062brief\u200c will \u2062also retract some arguments previously made by the House regarding the organization \u2062of the committee during the last Congress.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p><a href=\"http:\/\/washingtonexaminer.com\/tag\/house-republicans\/\" target=\"_blank\" rel=\"noopener\" title>House Republican<\/a> leaders announced on Wednesday they will file an amicus brief to the D.C. Circuit court overseeing the case against former <a href=\"http:\/\/washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noopener\" title>Donald Trump<\/a> adviser <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/steve-bannon\/\" target=\"_blank\" rel=\"noreferrer noopener\">Steve Bannon<\/a> as he awaits a sentence for his contempt of Congress conviction.<\/p>\n<p>The Bipartisan Legal Advisory Group, comprised of majority and minority whips and leaders, voted along party lines, 3-2, to file the brief that will be submitted after Bannon files for rehearing and will be \u201cin support of neither party.\u201d Speaker <a href=\"http:\/\/washingtonexaminer.com\/tag\/mike-johnson\/\" target=\"_blank\" rel=\"noopener\" title>Mike Johnson<\/a> (R-LA), Majority Leader <a href=\"http:\/\/washingtonexaminer.com\/tag\/steve-scalise\/\" target=\"_blank\" rel=\"noopener\" title>Steve Scalise<\/a> (R-LA), and Majority Whip <a href=\"http:\/\/washingtonexaminer.com\/tag\/tom-emmer\/\" target=\"_blank\" rel=\"noopener\" title>Tom Emmer<\/a> (R-MN) voted in favor, while House Democratic leadership voted against.<\/p>\n<p>The brief \u201cwill withdraw certain arguments made by the House earlier in the litigation about the organization of the Select Committee to Investigate the January 6 Attack on the U.S. Capitol during the prior Congress.\u201d<\/p>\n<p>\u201cHouse Republican Leadership continues to believe Speaker Pelosi abused her authority when organizing the Select Committee,\u201d majority leadership wrote in a release.<\/p>\n<p>Last week, Bannon <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3054811\/bannon-requests-supreme-court-delay-prison-sentence\/\" target=\"_blank\" rel=\"noopener\" title>filed an emergency petition<\/a> to the Supreme Court requesting that his prison sentence be delayed as he appeals his contempt of Congress charges. He was found guilty of defying a subpoena from the House Jan. 6 committee and is scheduled to report to prison by July 1 for a four-month sentence at a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ghislaine-maxwell-moved-to-low-security-florida-prison\/\" title=\"Ghislaine Maxwell Moved To Low-Security Florida Prison\">low-security prison<\/a> in Connecticut.<\/p>\n<p>The brief will stand as a legal test to see whether Congress can effectively discredit previous actions that were conducted under <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nancy-mace-takes-credit-for-historic-mccarthy-ouster-i-just-booted-out-the-old-speaker-and-got-a-new-speaker\/\" title=\"Nancy Mace claims credit for ousting McCarthy: 'I replaced the old speaker with a new one.'\">opposing party leadership<\/a>. During interviews with Fox News and CNN on Tuesday, Johnson called the work of the Jan. 6 select committee \u201ctainted.\u201d<\/p>\n<p>\u201cWe\u2019re working on filing an amicus brief in his appellate work there in his case because the Jan. 6 committee was, we think, wrongfully constituted,\u201d Johnson said to Fox News\u2019s Sean Hannity. \u201cWe think the work was tainted.
