Missouri, which upheld actions by the Biden administration that Alito considered violations of the First Amendment. The court decided \u20626-3 that the plaintiffs lacked\u200c standing, as the administration \u2062had seemingly stopped its censorship efforts from 2022. Alito,\u200c joined by \u200bJustices Clarence Thomas and Neil Gorsuch \u2062in dissent, argued that the decision overlooked\u200b serious <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/quebec-is-now-under-the-equivalent-of-covid-martial-law-no-one-is-allowed-on-the-streets-after-8pm-till-5am\/\" title=\"Quebec Is Now Under the Equivalent of COVID \u2018Martial Law\u2019 \u2013 No One is Allowed on the Streets after 8pm Till 5am\">constitutional abuses<\/a>\u2062 which could set a\u200c dangerous precedent. In\u2063 their \u200dopinion, the \u200bdissenters\u2063 described the administration&#8217;s \u2064coordination with\u200b Big Tech\u2063 to suppress online speech as \u2062a significant threat to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/using-wrong-pronouns-should-be-criminal-offense-say-almost-half-of-millennials-survey-2\/\" title=\"Almost half of millennials believe that using incorrect pronouns should be considered a \"criminal offense,\" according to a survey.\">free \u200cspeech<\/a>, especially highlighted during the Covid-19 pandemic. However, the majority declined\u2064 to address these fundamental issues directly, a stance Alito condemned, \u200cfearing it could encourage\u2063 future governmental overreach.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Justice Samuel Alito minced no words in his <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-411_3dq3.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">public evisceration<\/a> of the Supreme Court\u2019s 6-3 <em>Murthy v. Missouri <\/em>decision to greenlight the Biden administration\u2019s flagrant First Amendment violations.<\/p>\n<p>Justice Amy Coney Barrett, joined by Chief Justice John Roberts and Justices Brett Kavanaugh, Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson, officially endorsed the federal government\u2019s widespread attempt to silence dissidents on Wednesday when she concluded that the plaintiffs who brought the case lacked standing because the White House seemingly backed off of its censorship campaign after its 2022 infractions.<\/p>\n<p>Alito, joined in his dissent by Justices Clarence Thomas and Neil Gorsuch, wrote that Americans, however, will likely regret the high bench\u2019s decision to rubber stamp \u201c<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-dems-pass-massive-voting-rights-bill-conservatives-claim-it-will-chill-speech-demolish-election-integrity\/\" title=\"House Dems Pass Massive\u00a0\u2018Voting Rights\u2019 Bill; Conservatives Claim It Will Chill Speech, Demolish\u00a0Election Integrity\">blatantly unconstitutional<\/a>\u201d abuses, which are likely to continue since they were not punished.<\/p>\n<p>\u201cWhat the officials did in this case was more subtle than the ham-handed censorship found to be unconstitutional in<em> Vullo<\/em>, but it was no less coercive,\u201d he began. \u201cAnd because of the perpetrators\u2019 high positions, it was even more dangerous. It was blatantly unconstitutional, and the country may come to regret the Court\u2019s failure to say so.\u201d<\/p>\n<p>While most of his colleagues <a href=\"https:\/\/x.com\/seanmdav\/status\/1805971634236366983\" target=\"_blank\" rel=\"noreferrer noopener\">mocked self-censorship<\/a>, Alito and his fellow dissidents accurately classified Big Tech and the Biden administration\u2019s coordinated attempt to suppress online speech, especially during the media-fueled panic over Covid-19, as a \u201cserious threat to the First Amendment\u201d that warrants intervention. <\/p>\n<p>The plaintiffs, he wrote, were \u201cindisputably injured\u201d and met the traceability and redressability standards the court requires to weigh in. Yet, they were denied justice when the majority of the court\u2019s bench declined to see the value in ruling on the merits of \u201cone of the most important free speech cases to reach this Court in years.\u201d<\/p>\n<p>\u201cWe are obligated to tackle the free speech issue that the case presents. The Court, however, shirks that duty and thus permits the successful campaign of coercion in this case to stand as an attractive model for future officials who want to control what the people say, hear, and think,\u201d Alito wrote. <\/p>\n<p>The dissenting justice noted that there is a <a href=\"https:\/\/thefederalist.com\/2022\/09\/01\/bombshell-emails-show-the-biden-administration-colluded-with-big-tech-to-censor-covid-misinformation\/\" target=\"_blank\" rel=\"noreferrer noopener\">trove of evidence and communications<\/a> proving that Americans\u2019 free speech right to discuss their opinions online was routinely infringed to satisfy the wishes of the federal government. He spent pages of his dissent rehashing all the ways the White House leveraged its power to coerce Big Tech into shutting up Americans with any opinions the president\u2019s team deemed unsavory.  <\/p>\n<p>Alito determined that Missouri and Louisiana adequately demonstrated that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ga-poll-watcher-it-expert-non-trump-supporter-affidavit-sudden-surge-of-20000-mail-in-votes-for-biden-in-early-hours-on-nov\/\" title=\"GA Poll Watcher, IT Expert, Non-Trump Supporter Affidavit: Sudden Surge of 20,000 Mail-In-Votes For Biden In Early Hours On Nov\">social media companies<\/a>, unlike newspapers, \u201chave a powerful incentive to please important federal officials.\u201d<\/p>\n<p>\u201c[A]nd the record in this case shows that high-ranking officials skillfully exploited Facebook\u2019s vulnerability. When Facebook did not heed their requests as quickly or as fully as the officials wanted, the platform was publicly accused of \u2018killing people\u2019 and subtly threatened with retaliation,\u201d he wrote. <\/p>\n<p>Alito concluded his written thrashing with a warning that the threat of government censorship \u201cdid not come with expiration dates\u201d or lose steam \u201cmerely because White House officials opted not to renew them on a regular basis.\u201d <\/p>\n<p>On the contrary, he wrote that Facebook and other Big Tech companies\u2019 publicized promise to \u201ccontinue reporting to the White House and remain responsive to its concerns for as long as the officials requested\u201d suggests this will be an ongoing losing battle for Americans who want to speak their minds on social media.<\/p>\n<hr>\n<p>      Jordan Boyd is a staff writer at The Federalist and producer of The Federalist Radio Hour.
