The evidence was collected from Trump&#8217;s Mar-a-Lago residence \u200cafter \u2063the FBI executed\u200d a search warrant in August 2022, retrieving\u2062 numerous\u2062 documents, some of which \u2063were classified. Trump&#8217;s attorneys \u2062had called\u200d for a Frank&#8217;s hearing to assess whether the Department of Justice&#8217;s prosecutors had misled the magistrate judge \u200bwho authorized the search warrant. They \u200bargued \u200dthat the search \u200dviolated\u2064 Trump&#8217;s\u2062 constitutional\u2064 rights and claimed the warrant was overly \u2062broad, allowing for an excessively \u200dwide-ranging search. Judge Cannon, however, appeared unconvinced that the warrant lacked necessary specifics, questioning the\u2062 need for further detail in \u2063the warrant documentation.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Judge Aileen Cannon appeared skeptical on Tuesday at a hearing of <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noopener\" title=\"Donald Trump\">Donald Trump<\/a>\u2018s arguments that key evidence in the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/classified-documents\" target=\"_blank\" rel=\"noopener\" title=\"classified documents\">classified documents<\/a> case against the former president should be tossed out.<\/p>\n<p>Cannon listened as Trump\u2019s attorneys argued that <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/justice-department\" target=\"_blank\" rel=\"noopener\" title=\"Department of Justice\">Department of Justice<\/a> prosecutors misled a magistrate judge when they requested authorization for a search warrant to obtain the evidence. The FBI executed the warrant in August 2022 at Trump\u2019s Mar-a-Lago residence, where agents obtained boxes full of documents, including some with classified markings.<\/p>\n<p>Trump\u2019s attorneys had asked Cannon for a Frank\u2019s hearing, a proceeding that would allow for a review of whether the DOJ used misleading warrant documents.<\/p>\n<p>Cannon designated Tuesday\u2019s hearing, which came at the end of a three-day marathon of proceedings in the Florida courtroom, to listen to arguments from Trump\u2019s attorneys about how they believed the Mar-a-Lago search violated the former president\u2019s constitutional rights and how a Frank\u2019s hearing was warranted.<\/p>\n<p>Trump attorney Emil Bove said part of the issue with the warrant was that it was too broad and had allowed investigators to search for more than what was necessary, according to CNN.<\/p>\n<p>\u201cI have a hard time seeing what more needed to be included\u201d on the warrant documents, Cannon <a href=\"https:\/\/www.cnn.com\/2024\/06\/25\/politics\/trump-mar-a-lago-search-warrant\/index.html\" target=\"_blank\" rel=\"noopener\" title>responded<\/a> to Bove.<\/p>\n<p>When Bove <a href=\"https:\/\/www.foxnews.com\/live-news\/june-25-donald-trump-classified-documents-trial\" target=\"_blank\" rel=\"noopener\" title>argued<\/a> that investigators should not have been permitted to search Trump\u2019s massive estate in its entirety, Cannon replied, \u201cWhat\u2019s your point? It\u2019s a property,\u201d according to Fox News.<\/p>\n<p>While Cannon seemed poised to side with prosecutors on Trump\u2019s requests to invalidate evidence obtained through the search warrant, she seemed more sympathetic to Trump\u2019s other arguments, which his attorneys made in hearings during the two prior days.<\/p>\n<p>In one of those hearings, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-is-an-american-legal-giant\/\" title=\"Sidney Powell Is an American Legal Giant\">special counsel<\/a> Jack Smith urged Cannon to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/youtubes-demonetization-of-russell-brand-inspires-flight-to-rumble\/\" title=\"YouTube's demonetization of Russell Brand sparks migration to Rumble.\">impose speech restrictions<\/a> on Trump, but the judge scrutinized the request. Cannon <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3057590\/judge-cannon-scolds-trump-prosecutor\/\" target=\"_blank\" rel=\"noopener\" title>said<\/a> she needed more evidence of a connection between Trump\u2019s speech and threats being made to Trump\u2019s targets, and she gave prosecutors an opportunity to follow up with additional evidence by Wednesday if they had any and wanted to.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>In another hearing, she <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3056824\/judge-cannon-grills-attorneys-special-counsel-budget\/\" target=\"_blank\" rel=\"noopener\" title>gave<\/a> unexpectedly thorough consideration to Trump\u2019s argument that Smith\u2019s appointment as special counsel was unlawful. Legal experts critical of Cannon have argued the hearing was unnecessary because disputes about special counsels have been thoroughly sorted out by other courts already.<\/p>\n<p>Cannon did not issue any rulings on the various arguments she has heard over the last three days in Trump\u2019s case from the bench.
