The statutes cited include 8 U.S.C. \u2064\u00a7 1373(c),\u2064 which mandates DHS to verify citizenship\u2064 status upon\u2064 request, \u200cand 8 U.S.C. \u00a7\u200d 1644,\u2063 which allows state and\u2063 local governments\u2064 to send and receive immigration status information from DHS without restriction. AFL recommends \u2064that \u200dstates use these provisions to scrutinize voter rolls for non-citizen voters based on\u2062 reliable indicators.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<div>\n<div>\n<figure>                         <\/figure>\n<\/p><\/div>\n<p>To find foreign nationals on their voter rolls, states can use two little-known federal statutes to verify whether a registered voter is an American citizen through the Department of Homeland Security (DHS), according to America First Legal (AFL).<\/p>\n<p>AFL sent <a href=\"https:\/\/media.aflegal.org\/wp-content\/uploads\/2024\/06\/24150622\/Combined-Letter.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">letters<\/a> on Monday to each state\u2019s chief election official \u2014 along with a copy to their respective governors and attorneys general \u2014 highlighting two statutes that the legal group says allow states and localities to request information about a person\u2019s citizenship and <a href=\"https:\/\/thefederalist.com\/2024\/06\/19\/bidens-amnesty-plan-could-turn-500000-illegal-aliens-into-future-voters\/\" target=\"_blank\" rel=\"noreferrer noopener\">immigration status<\/a>. If requested, AFL contends, DHS is required to provide such information.<\/p>\n<p>AFL first points to <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/8\/1373\" target=\"_blank\" rel=\"noreferrer noopener\">8 U.S.C. \u00a7 1373(c)<\/a>, which requires the former Immigration and Naturalization Service \u2014 which was replaced by the DHS \u2014 to \u201crespond to an inquiry by a Federal, State, or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/us-ends-use-of-2-immigration-jails-accused-of-mistreatment\/\" title=\"US Ends Use of 2 Immigration Jails Accused of Mistreatment\">local government agency<\/a>, seeking to verify or ascertain the citizenship or immigration status of any individual within the jurisdiction of the agency for any purpose authorized by law, by providing the requested verification or status information.\u201d<\/p>\n<p>AFL also points to <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/8\/1644\">8 U.S.C. \u00a7 1644<\/a>, which states:<\/p>\n<blockquote>\n<p>Notwithstanding any other provision of Federal, State, or local law, no State or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/oklahoma-lawmakers-pass-texas-style-pro-life-bill\/\" title=\"Oklahoma Lawmakers Pass Texas-Style Pro-Life Bill\">local government entity<\/a> may be prohibited, or in any way restricted, from sending to or receiving from the Immigration and Naturalization Service information regarding the immigration status, lawful or unlawful, of an alien in the United States.<\/p>\n<\/blockquote>\n<p>\u201cAccordingly, States and localities should submit requests to DHS to verify the citizenship or immigration status of registered voters on voter rolls where there are any reliable indicators that a voter may not be a U.S. citizen,\u201d AFL summarized in a press release.<\/p>\n<p>AFL President Stephen Miller <a href=\"https:\/\/aflegal.org\/america-first-legal-sends-all-50-states-a-plan-for-how-to-use-existing-federal-law-to-prevent-foreign-nationals-from-illegally-voting-in-american-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">pointed to<\/a> the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pelosi-extends-proxy-voting-policy-that-republicans-sued-her-over-last-year\/\" title=\"Pelosi Extends Proxy Voting Policy That Republicans Sued Her Over Last Year\">record-high number<\/a> of illegal aliens crossing the border under President Joe Biden, calling it an \u201cextraordinary threat to our elections.\u201d<\/p>\n<p>\u201cAny leader who wishes to protect the franchise of their citizens must act to implement these recommendations with haste,\u201d Miller said in a statement. \u201cPatriotic officials must act at once to stop Biden\u2019s illegals from voting \u2014 and this action plan from AFL tells them exactly what they must do.\u201d<\/p>\n<p>Alien voting in federal elections is illegal, but the federally-mandated registration process doesn\u2019t meaningfully prevent it. A potential voter who registers via a federal registration form simply must check a box affirming he is a U.S. citizen. Republicans have introduced the Safeguarding American Voter Eligibility (SAVE) Act which would require documentary proof of citizenship in order to register to vote.<\/p>\n<p>Currently, Arizona is the only state that has some mechanism in place besides the honor system to keep foreign nationals from registering to vote. The state requires potential voters to provide documentary proof of citizenship to register to vote in state elections.
