These crashes claimed 346 lives and led to the\u200d grounding of the 737 Max \u2064models, severely damaging Boeing&#8217;s \u2063reputation.<\/p>\n<p>Further complicating matters, the U.S. Department\u2064 of Justice (DOJ) found Boeing had breached a 2021 agreement that shielded it from criminal prosecution over these crashes. \u200cThis breach may lead \u2064to Boeing facing criminal charges as prosecutors have recommended that the company be charged with fraud. This \u2064development is part \u2063of \u2062a broader \u200bissue of systemic \u2063problems within Boeing&#8217;s safety culture, which has \u2062allegedly deteriorated since Boeing&#8217;s\u200b 1997 merger with \u2064McDonnell Douglas.<\/p>\n<p>Additional\u200d incidents, including one involving a Boeing 787-9 and \u2062another with a 777-300ER, suggest \u200bongoing safety challenges beyond the 737 Max. Douglas Golden<\/span><\/a> <\/span> <span>   June 25, 2024 at 7:28am <\/span> <\/span>  <\/header>\n<section>\n<p>If there were ever an American company I would have thought would be too big to fail, it would be Boeing.<\/p>\n<p>There are two companies on this planet capable of manufacturing a wide range of large, state-of-the-art airliners: Airbus and Boeing. To challenge them would make taking on Microsoft and Apple for the desktop PC market look like a walk in the park.<\/p>\n<p>And then Boeing planes started falling out of the sky.<\/p>\n<p>Then, after its best-selling jet was grounded and whistleblowers began sounding alarms regarding the <a href=\"https:\/\/www.westernjournal.com\/ap-boeing-didnt-tell-airlines-that-safety-alert-wasnt-on\/\" target=\"_blank\" rel=\"noopener\">safety culture<\/a> \u2014 or lack thereof \u2014 at the company, its reputation did roughly the same thing.<\/p>\n<p>And now it\u2019s likely going to find itself falling into a defendant\u2019s chair in a federal courtroom.<\/p>\n<p>According to a <a href=\"https:\/\/www.reuters.com\/legal\/us-prosecutors-recommend-doj-criminally-charge-boeing-deadline-looms-2024-06-23\/\" target=\"_blank\" rel=\"noopener\">Reuters<\/a> report on Monday, U.S. prosecutors have recommended to the Department of Justice that Boeing be charged with fraud for violating an agreement regarding the two crashes that led to the grounding of the 737 Max.<\/p>\n<p>The DOJ must decide whether to pursue the case by July 7.<\/p>\n<p>In May, the department said in a court filing that Boeing had breached a 2021 agreement shielding it from criminal repercussions over the crashes of <a href=\"https:\/\/www.nbcnews.com\/news\/world\/indonesia-report-finds-fatal-lion-air-jet-crash-due-boeing-n1071796\" target=\"_blank\" rel=\"noopener\">Lion Air Flight 610<\/a> and <a href=\"https:\/\/www.seattletimes.com\/business\/boeing-aerospace\/boeings-737-max-aircraft-and-the-crash-of-ethiopian-airlines-flight-302-explained-through-graphics\/\" target=\"_blank\" rel=\"noopener\">Ethiopian Airlines Flight 302<\/a> in 2018 and 2019, respectively. The two crashes claimed a total of 346 lives.<\/p>\n<p>Both accidents were caused by the Maneuvering Characteristics Augmentation System,\u00a0a flawed piece of software implemented in the 737 Max designed to make the plane\u2019s flight characteristics similar to prior 737 models despite newer engines changing the center of gravity and making the plane prone to <a href=\"https:\/\/www.theverge.com\/2019\/5\/2\/18518176\/boeing-737-max-crash-problems-human-error-mcas-faa\" target=\"_blank\" rel=\"noopener\">dangerous handling tendencies<\/a> in certain situations.<\/p>\n<p>The similarity of flying the 737 Max to prior 737 models with a minimum of additional training for pilots and crews was a selling point to airlines, given that the 737 was already the best-selling <a href=\"https:\/\/web.archive.org\/web\/20140416231815\/http:\/\/www.businessweek.com\/articles\/2014-04-16\/boeing-s-737-turns-8-000-the-best-selling-plane-ever-isn-t-slowing\" target=\"_blank\" rel=\"noopener\">jet airliner in history<\/a>.<\/p>\n<p>However, a lack of crew training regarding what the <a href=\"https:\/\/www.westernjournal.com\/ap-united-ceo-vows-to-be-aboard-737-max-when-its-cleared-to-fly\/\" target=\"_blank\" rel=\"noopener\">MCAS<\/a> did and limited autonomy for pilots to override dangerous commands issued by MCAS, among many <a href=\"https:\/\/www.theverge.com\/2019\/5\/2\/18518176\/boeing-737-max-crash-problems-human-error-mcas-faa\" target=\"_blank\" rel=\"noopener\">other problematic issues<\/a> with the system\u2019s development too numerous to detail, led to both the Lion Air and Ethiopian Airlines crashes \u2014 and the plane\u2019s grounding for nearly two years.<\/p>\n<p>Not only that, but the safety culture of the aviation giant quickly came under federal scrutiny \u2014 for once, a truly bipartisan issue that transcended Republican and Democrat.<\/p>\n<p>As numerous whistleblowers and other company officials testified, it quickly became apparent that the safety culture at Boeing had deteriorated since a 1997 merger with McDonnell Douglas, and there were questions surrounding the safety of all three airliners still in production at Boeing: the 737, 777 and 787.<\/p>\n<p>To avoid criminal prosecution over the 737 Max crashes, Boeing was supposed to \u2014 among other things \u2014 \u201cdesign, implement, and enforce a compliance and ethics program to prevent and detect violations of the U.S. fraud laws throughout its operations,\u201d the DOJ said in the May court filing.<\/p>\n<p>You may not be shocked to learn that the <a href=\"https:\/\/www.westernjournal.com\/attorney-general-merrick-garland-lambasted-threatening-americans-criticism-biden-doj-must-stop\/\" target=\"_blank\" rel=\"noopener\">Justice Department<\/a> found the company had breached these obligations, according to <a href=\"https:\/\/www.reuters.com\/business\/aerospace-defense\/us-says-boeing-breached-2021-deferred-prosecution-737-max-agreement-2024-05-14\/\" target=\"_blank\" rel=\"noopener\">Reuters<\/a>.<\/p>\n<p>This was not a recommendation of prosecution, however \u2014 although the filing did come as the company was still reeling over a fuselage panel blowing out on an Alaska Airlines 737 Max 9 in January.<\/p>\n<p>While that flight was able to land safely, the incident highlighted yet more deficiencies in the safety processes for <a href=\"https:\/\/www.westernjournal.com\/ap-us-airline-grounds-boeing-737-max-9-jetliners-frightening-inflight-failure\/\" target=\"_blank\" rel=\"noopener\">737 Max<\/a> contractors. In May, Reuters noted that DOJ officials were \u201cweighing that incident as part of a broader probe into whether Boeing violated the deal, known as a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-muscles-out-chicago-prosecutor-hot-on-the-heels-of-powerful-dems\/\" title=\"Biden Muscles Out Chicago Prosecutor Hot on the Heels of Powerful Dems\">deferred prosecution agreement<\/a>, or DPA.\u201d<\/p>\n<p>It now appears that, no matter how much weight was given to it, prosecutors still feel that Boeing belongs in a criminal courtroom over its compliance with the 737 Max agreement.<\/p>\n<p>The company claimed it had \u201chonored the terms\u201d of the 2021 deferred prosecution agreement, while the DOJ declined to comment. In addition, the two sides were reportedly in discussions that could keep this out of a courtroom yet again.<\/p>\n<p>In the meanwhile, that\u2019s hardly the only bad news for Boeing over the past few months.<\/p>\n<p>In March, LATAM Airlines Flight 800, a <a href=\"https:\/\/www.westernjournal.com\/airlines-fleet-777s-reportedly-prone-spontaneous-mid-air-explosions-boeing-scrambles-deny-risk\/\" target=\"_blank\" rel=\"noopener\">Boeing<\/a> 787-9, plunged precipitously during a flight from Australia to New Zealand on its way to Santiago, Chile, injuring 50 people, according to the <a href=\"https:\/\/www.bbc.com\/news\/world-asia-68488418\" target=\"_blank\" rel=\"noopener\">BBC<\/a>.<\/p>\n<p>While the cause wasn\u2019t directly a flaw with the plane\u2019s manufacture, <a href=\"https:\/\/edition.cnn.com\/2024\/03\/15\/business\/latam-airlines-flight-cause\/index.html\" target=\"_blank\" rel=\"noopener\">CNN<\/a> reported that an exposed switch on the pilot\u2019s seat may have been activated while a flight attended was serving the meal, leading to the unintentional plunge. <a href=\"https:\/\/www.westernjournal.com\/airlines-fleet-777s-reportedly-prone-spontaneous-mid-air-explosions-boeing-scrambles-deny-risk\/\" target=\"_blank\" rel=\"noopener\">Boeing<\/a> sent an advisory to 787 operators \u201cwhich included instructions for inspecting and maintaining (cockpit seat) switches\u201d and was \u201crecommending operators perform an inspection at the next maintenance opportunity.\u201d<\/p>\n<p>In May, a Singapore Airlines <a href=\"https:\/\/www.westernjournal.com\/one-passenger-dead-dozens-injured-boeing-jet-hits-severe-turbulence\/\" target=\"_blank\" rel=\"noopener\">Boeing 777-300ER<\/a> on its way from London\u2019s Heathrow Airport to Singapore\u2019s Changi Airport experienced violent turbulence in flight, killing one passenger and injuring dozens of others; the plane landed in Bangkok and was eventually flown back to its home base.<\/p>\n<p>Furthermore, in the last month, two close calls were reported on Southwest Airlines 737s.<\/p>\n<p>In one, a 737 Max entered a dangerous aerodynamic oscillation known as a \u201c<a href=\"https:\/\/www.westernjournal.com\/faa-investigating-boeing-737-suffers-dangerous-dutch-roll-incident-midair\/\" target=\"_blank\" rel=\"noopener\">Dutch roll<\/a>\u201d that modern computer software should be able to avert.<\/p>\n<p>In another, a 737-800 <a href=\"https:\/\/www.westernjournal.com\/southwest-boeing-737-unexpectedly-dives-toward-neighborhood-scares-residents-terrifying-scene\/\" target=\"_blank\" rel=\"noopener\">passed within 500 feet of a high school<\/a> during what appeared to be a botched approach to Will Rogers Oklahoma City Airport.<\/p>\n<p>While the latter incident leads more toward suspicion of pilot error of some sort, the former indicated yet another 737 Max with a technical issue \u2014 although Boeing chief engineer Howard McKenzie tried to assure Congress during his June 18 testimony that it was a problem unique to the individual aircraft and not germane to the 737 Max.<\/p>\n<p>According to <a href=\"https:\/\/www.flightglobal.com\/airframers\/southwest-dutch-roll-not-caused-by-737-production-or-design-boeing-chief-engineer\/158820.article#:~:text=The%20NTSB%20is%20investigating%20the,about%20the%20incident%20remains%20unknown.\" target=\"_blank\" rel=\"noopener\">Flight Global<\/a>, McKenzie said it was a \u201cunique circumstance \u2026 that has nothing to do with design or manufacturing\u201d but that needs further investigation.<\/p>\n<p>\u201cWe are pulling together the data that we have, and it does not indicate that there is anything that is of fleet concern here,\u201d he said.<\/p>\n<p>Whether there\u2019s something of greater concern, however, will soon be seen.<\/p>\n<p>One thing is for sure, though: A brand once thought to be way too big to fail is crashing to earth, metaphorically <a href=\"https:\/\/www.westernjournal.com\/ap-french-aviation-experts-see-clear-links-in-2-boeing-crashes\/\" target=\"_blank\" rel=\"noopener\">and literally<\/a>.<\/p>\n<hr>\n<div>\n<p><b><i>An Important Message from Our Staff:<\/i><\/b><\/p>\n<p><i><span>In just a few months, the world is going to change forever.
