His attorneys are challenging\u2063 the conviction with various arguments, including questioning the\u200b impact of his\u200c past drug use on his right to own\u2064 a firearm, as well as asserting that no violent behavior linked to gun use was ever demonstrated by Biden. Additionally, they pointed out that \u2064no sentencing date has been set, while also highlighting a forthcoming trial on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/team-biden-says-the-hunter-story-is-ending-but-his-2024-rivals-say-otherwise\/\" title=\"Biden's team claims the Hunter story is fading, but his 2024 opponents disagree.\">federal tax charges<\/a> in \u2064California scheduled for September. He faces a maximum sentence of 25 years in prison and fines of up to $750,000.<\/p>\n<p>Federal guidelines propose sentences of 15 to 21 months in prison in cases such as that of Hunter Biden, according to <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4737588-hunter-biden-request-new-trial\/\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>.<\/p>\n<p>No sentencing date has been set.<\/p>\n<p>On Monday, Hunter Biden\u2019s attorneys tried a new tactic by claiming that the first son needs a new trial altogether.<\/p>\n<p>In one filing, attorneys said the trial began before the paperwork on the latest failed appeal that would have forestalled the trial had been formally filed, according to <a href=\"https:\/\/abcnews.go.com\/US\/hunter-biden-requests-new-trial-after-conviction-gun\/story?id=111381641\" target=\"_blank\" rel=\"noopener\">ABC<\/a>.<\/p>\n<p>That argument does not dispute <a href=\"https:\/\/www.westernjournal.com\/juror-reveals-damning-text-thread-led-hunter-bidens-conviction-training-get-drugs\/\" target=\"_blank\" rel=\"noopener\">Hunter Biden\u2019s guilt<\/a>.<\/p>\n<p>\u201cHere, no mandate was issued during the trial or even now,\u201d the filing said. \u201cConsequently, the conviction must be vacated.\u201d<\/p>\n<p>\u201cNaturally, any district court action taken after it has been divested of jurisdiction by an appeal must be vacated. Mr Biden\u2019s convictions should be vacated because the court lacked jurisdiction to proceed to trial,\u201d the filing said, according to <a href=\"https:\/\/www.theguardian.com\/us-news\/article\/2024\/jun\/24\/hunter-biden-requests-new-trial\" target=\"_blank\" rel=\"noopener\">The Guardian<\/a>.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Should Hunter Biden get a lengthy prison sentence?<\/p>\n<\/p><\/div>\n<p>\u201cThat the Third Circuit may later issue a mandate returning jurisdiction to this Court, after a 7-day trial resulting in a three-count conviction, does not change the fact that the trial proceeded before jurisdiction was returned to this Court,\u201d the motion said, per the <a href=\"https:\/\/www.nationalreview.com\/news\/hunter-biden-requests-new-trial-following-gun-conviction\/\" target=\"_blank\" rel=\"noopener\">National Review<\/a>.<\/p>\n<p>Hunter Biden\u2019s attorneys also used a Supreme Court ruling that upheld a ban on <a href=\"https:\/\/www.westernjournal.com\/judge-crushes-hunter-bidens-claim-federal-gun-charge-politically-motivated-refuses-dismiss-case\/\" target=\"_blank\" rel=\"noopener\">guns<\/a> for domestic violence perpetrators, saying that because Hunter Biden never showed violence toward anyone, his Second Amendment rights were intact.<\/p>\n<p>\u201cHere, the jury did not find Mr. Biden ever terrorized anyone with a gun in public, or anywhere else, or used it dangerously in any way,\u201d attorneys wrote. \u201cThat requires Mr. Biden\u2019s acquittal.\u201d<\/p>\n<p>A filing also raised the question of timing, asking how soon before a gun purchase a person would need to use drugs for that to count against them.<\/p>\n<p>\u201cWhere is this line that separates not only what is legal from what is illegal, but where the exercise of a constitutionally protected right becomes a felony?\u201d the filing said.<\/p>\n<p>\u201cHow does a person have fair notice of when he or she is allowed to possess a firearm if they used a prohibited substance a day, a week, a month or, as the Special Counsel argued, years before? This Court has not said,\u201d the filing said.<\/p>\n<p>\u201cWe do not quarrel with the Special Counsel\u2019s claims and statistics that many users of crack are violent and have misused guns, but \u2014 while the Special Counsel has extensively chronicled Mr. Biden\u2019s conduct over several years of crack use \u2014 the Special Counsel has not identified a single time in which Mr. Biden became violent. Not one,\u201d the filing said, per what <a href=\"https:\/\/www.axios.com\/2024\/06\/24\/hunter-biden-new-gun-trial-conviction\" target=\"_blank\" rel=\"noopener\">Axios<\/a> reported.<\/p>\n<p>Hunter Biden will face a trial in California in September on <a href=\"https:\/\/www.westernjournal.com\/federal-judge-gives-hunter-biden-exactly-wanted-tax-trial\/\" target=\"_blank\" rel=\"noopener\">federal tax charges<\/a>.<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>\u201cWe don\u2019t even know if an election will be held in 2024.\u201d Those 12 words have been stuck in my head since I first read them. <\/span><\/i><\/p>\n<p><i><span>Former Lt.
