The opinion views these efforts as a misguided attempt to support a dwindling number of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/labor-board-dismisses-union-misconduct-complaints-following-biden-purge\/\" title=\"Labor Board Dismisses Union Misconduct Complaints Following Biden Purge\">unionized workers<\/a>, at \u2063the expense of \u200dbroader economic health and individual worker\u200c freedom.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The Supreme Court just quashed a bid for pro-union favoritism in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-367_f3b7.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Starbucks v. McKinney<\/em><\/a>. Writing for his colleagues, Justice Clarence Thomas held that, to win injunctions against employers allegedly engaged in unfair labor practices, the National Labor Relations Board (NLRB) must meet the same legal standards as anybody else.<\/p>\n<p>Thomas\u2019 opinion reverses a ruling from the 6th U.S. Circuit Court of Appeals that required the agency merely to demonstrate \u201creasonable cause\u201d and that injunctive relief is \u201cjust and proper.\u201d Under this standard, Thomas wrote, \u201cThe Board \u2018need not convince the court of the validity of [its] theory of liability, as long as the theory is substantial and not frivolous.\u2019\u201d<\/p>\n<p>Ordinarily, however, a plaintiff seeking an injunction must demonstrate (among other things) a likelihood of success on the merits of their case \u2014 a significantly more rigorous test than the 6th Circuit\u2019s. \u201cA preliminary injunction is an \u2018extraordinary\u2019 equitable remedy that is \u2018never awarded as of right,\u2019\u201d Thomas noted. The court\u2019s ruling clarifies that the NLRB has no special exemption or legal fast lane through which it can impose its will on employers. \u201cThe reasonable-cause standard goes far beyond simply fine-tuning the traditional criteria to the [statutory] context,\u201d he argued, \u201cit substantively lowers the bar for securing a preliminary injunction by requiring courts to yield to the Board\u2019s preliminary view of the facts, law, and equities.\u201d<\/p>\n<p>Faithful judicial interpretations do not always produce desirable public policy outcomes. But in this case, Thomas\u2019 sound legal reasoning did just that, removing judicially manufactured life support that arbitrarily aided a phylum of corrupt and dying institutions. In incremental fashion, at least, the court reinvigorated freedom of association.<\/p>\n<p>Too often, however, government officials purporting to bolster this fundamental American freedom instead deploy the state\u2019s coercive powers to strengthen whatever kinds of associations they personally prefer. But freedom of association necessitates the freedom to dissociate \u2014 to join certain groups and to avoid others.<\/p>\n<p>Far from allowing American workers to choose either to negotiate solo or to bargain collectively, Washington has systematically aided organized labor, corralling workers \u2014 irrespective of their wishes \u2014 into the purportedly benevolent clutches of Big Labor. This bias has manifested in copious regulation, <a href=\"https:\/\/www.wsj.com\/articles\/cemex-national-labor-relations-board-biden-administration-unions-elections-d7dbe232\" target=\"_blank\" rel=\"noreferrer noopener\">tilting unionization votes<\/a> in favor of organizing, <a href=\"https:\/\/dailycaller.com\/2023\/12\/04\/mcgarry-infrastructure-davis-bacon-act-prevailing-wage\/\" target=\"_blank\" rel=\"noreferrer noopener\">conditioning federal contracts<\/a> on union-friendly wage policies, <a href=\"https:\/\/www.protectingtaxpayers.org\/innovation\/taxpayers-protection-alliance-statement-on-bidens-ai-executive-order\/\" target=\"_blank\" rel=\"noreferrer noopener\">regulating technology<\/a> to protect union jobs,<a href=\"https:\/\/reason.com\/2024\/03\/11\/bidens-independent-contractor-rule-threatens-the-evolution-of-work\/\" target=\"_blank\" rel=\"noreferrer noopener\"> hamstringing gig work<\/a>, and much more.<\/p>\n<p>In reality, unions are flailing \u2014 even with Washington\u2019s assistance. Most Americans choose to work free of organized labor\u2019s ideological radicalism and costly dues. In 2023, only 6 percent of private-sector workers belonged to unions, which have become an <a href=\"https:\/\/unionstats.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">ever-thinning sliver<\/a> of the workforce.<\/p>\n<p>To the lucky few, unions provide large paychecks and generous benefit plans. This undoubtedly helps those to whom these perks accrue. But for others, Big Labor\u2019s excesses mean lost jobs, subpar productivity, and higher consumer prices. Companies and jobs have fled union-dominated states for friendlier regulatory environments in the <a href=\"https:\/\/www.investopedia.com\/terms\/r\/righttowork-law.asp\" target=\"_blank\" rel=\"noreferrer noopener\">right-to-work<\/a> south \u2014 fracturing erstwhile union towns. Unions also often lobby employers to eschew efficient new technologies \u2014 a self-interested habit of organized labor <a href=\"https:\/\/www.aier.org\/article\/adam-smith-provided-a-moral-foundation-for-workers-freedoms\/\" target=\"_blank\" rel=\"noreferrer noopener\">dating back<\/a> to medieval guilds \u2014 hobbling unionized firms\u2019 competitive efforts against both American and foreign rivals.<\/p>\n<p>Worse still, the union dues funding this decline all too often disappear into labor leaders\u2019 social-policy side projects \u2014 or their personal pocketbooks. United Auto Workers (UAW) has seen multiple leaders <a href=\"https:\/\/www.justice.gov\/usao-edmi\/pr\/former-uaw-official-sentenced-57-months-prison-embezzling-over-2-million-union-funds#:~:text=The%20following%20other%20individuals%20have,Analyst%20Jerome%20Durden%20(15%20months\" target=\"_blank\" rel=\"noreferrer noopener\">receive<\/a> prison sentences for embezzlement. As National Review\u2019s Dominic Pino <a href=\"https:\/\/www.nationalreview.com\/2024\/06\/uaw-president-shawn-fain-is-under-investigation-for-financial-misconduct-and-workplace-retaliation\/\" target=\"_blank\" rel=\"noreferrer noopener\">writes<\/a>, \u201cCorruption is so integral to the UAW that the Department of Justice doesn\u2019t trust it to operate without a monitor,\u201d prompting a federal court to appoint Neil Barofsky as an ombudsman in 2021. Now Barofsky says that UAW President Shawn Fain \u2014 pro-union America\u2019s favorite son \u2014 has <a href=\"https:\/\/www.nationalreview.com\/2024\/06\/uaw-president-shawn-fain-is-under-investigation-for-financial-misconduct-and-workplace-retaliation\/\" target=\"_blank\" rel=\"noreferrer noopener\">slow-rolled<\/a> an investigation into Fain\u2019s own alleged financial misconduct.<\/p>\n<p>Ultimately, the government\u2019s efforts to support unions amount to social and economic planning. \u201cThe morality and intelligence of a democratic people would risk no fewer dangers than its business and its industry if the government came to take the place of associations everywhere,\u201d Tocqueville <a href=\"https:\/\/press.uchicago.edu\/Misc\/Chicago\/805328.html\" target=\"_blank\" rel=\"noreferrer noopener\">warned<\/a>. This danger looms whether government officials outright replace private associations or cajole citizens into state-favored associations, usually ones whose leaders <a href=\"https:\/\/www.opensecrets.org\/industries\/indus?ind=P\" target=\"_blank\" rel=\"noreferrer noopener\">finance<\/a> those officials\u2019 reelection campaigns.<\/p>\n<p>Most Americans have the horse sense to distance themselves from organized labor\u2019s foibles. The government shouldn\u2019t gainsay them.<\/p>\n<hr>\n<p>      David B.
