The controversy unfolds \u2062amidst broader national\u200c debates over the conduct of the 2020 elections and subsequent legal and political fallout.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Lawfare leftists lost another round in their bogus \u201cfake electors\u201d scheme to imprison Trump supporters, this time in Nevada where the state\u2019s Democrat attorney general is pushing an 11th-hour political prosecution. <\/p>\n<p>Clark County District <a href=\"http:\/\/www.clarkcountycourts.us\/departments\/judicial\/civil-criminal-divison\/department-xviii\/\" target=\"_blank\" rel=\"noreferrer noopener\">Judge Mary Kay Holthus<\/a> on Friday shut down a trial slated for early next year in the case of six grassroots conservatives charged with <a href=\"https:\/\/ag.nv.gov\/uploadedFiles\/ag.nv.gov\/Content\/News\/PR\/PR_Docs\/2022(1)\/Indictment%20-%20SIgned-Hindle.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">felony forgery counts<\/a> for serving as contingent electors for then-President Donald Trump in the disputed 2020 election. The judge found prosecutors for far-left <a href=\"https:\/\/ag.nv.gov\/About\/AG_Aaron_Ford\/\" target=\"_blank\" rel=\"noreferrer noopener\">Attorney General Aaron Ford<\/a> erred in choosing Democrat bastion Clark County, home to Las Vegas, as the venue for the trial. As the Nevada Independent <a href=\"https:\/\/thenevadaindependent.com\/article\/judge-dismisses-nevada-fake-electors-case-over-lack-of-jurisdiction\" target=\"_blank\" rel=\"noreferrer noopener\">reported,<\/a> the judge agreed with the defendants\u2019 attorneys, who argued the a northern venue should have been selected, particularly within Carson City \u2014 where the alternate elector signing ceremony actually took place in the weeks after the presidential election in which Democrat Joe Biden <a href=\"https:\/\/ballotpedia.org\/Presidential_election_in_Nevada,_2020\" target=\"_blank\" rel=\"noreferrer noopener\">narrowly<\/a> claimed victory in the swing Silver State. <\/p>\n<p>\u201cYou have literally, in my opinion, a crime that has occurred in another jurisdiction,\u201d Holthus reportedly <a href=\"https:\/\/thenevadaindependent.com\/article\/judge-dismisses-nevada-fake-electors-case-over-lack-of-jurisdiction\" target=\"_blank\" rel=\"noreferrer noopener\">said.<\/a> \u201cIt\u2019s so appropriately up north and so appropriately not here.\u201d (Holthus is the same judge who <a href=\"https:\/\/abcnews.go.com\/US\/video\/judge-attacked-defendant-sentencing-106097233\">was attacked<\/a> in January by a defendant during sentencing.)<\/p>\n<p>Ford\u2019s political prosecution against Jim DeGraffenreid, Durward James Hindle III, Jesse Law, Shawn Meehan, Michael McDonald, and Eileen Rice can no longer be taken up in a northern jurisdiction because the three-year statute of limitations expired in December, as the Nevada Independent notes. <\/p>\n<p>But Ford isn\u2019t giving up. He reportedly claimed the \u201cjudge got it wrong\u201d and plans to appeal the ruling to the Nevada Supreme Court. <\/p>\n<p>As the Nevada Independent noted, Ford told lawmakers at a hearing in May 2023 that state law \u201cdid not directly address the conduct in question.\u201d The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-trump-jr-blast-ny-ag-letitia-james-for-political-persecution-this-is-banana-republic-stuff\/\" title=\"Trump, Trump Jr. Blast NY AG Letitia James For \u2018Political Persecution\u2019: \u2018This Is Banana Republic Stuff\u2019\">attorney general made<\/a> the comments as legislators considered \u201ca bill that would have criminalized\u201d attempts to put up alternate presidential electors. The legislation was ultimately vetoed by <a href=\"https:\/\/gov.nv.gov\/AboutUs\/Biography_Joe_Lombardo\/\" target=\"_blank\" rel=\"noreferrer noopener\">Gov. Joe Lombardo<\/a>, a Republican. <\/p>\n<p>But Ford brought charges seven months later, insisting that \u201chis office had been conducting an investigation into the scheme for years and denying that it was politically motivated,\u201d the publication reported. <\/p>\n<h2>\u2018Political Persecution\u2019<\/h2>\n<p><a href=\"https:\/\/www.heritage.org\/staff\/hans-von-spakovsky\" target=\"_blank\" rel=\"noreferrer noopener\">Hans von Spakovsky<\/a>, constitutional law expert and former member of the Federal Election Commission, said it\u2019s the highly partisan attorney general who has erred in bringing the \u201cabusive prosecution\u201d of Trump supporters. He\u2019s confident Ford will lose his appeal. <\/p>\n<p>\u201cIt\u2019s a political persecution,\u201d von Spakovsky, manager of The <a href=\"https:\/\/www.heritage.org\/staff\/hans-von-spakovsky\" target=\"_blank\" rel=\"noreferrer noopener\">Heritage Foundation\u2019s Election Law Reform Initiative<\/a>, told me in an interview. \u201cThe only reason he would file this now after all these years is because he wanted to interfere in the upcoming election.\u201d <\/p>\n<p>The same could be said for swing state Wisconsin, where far-left state Attorney General Josh Kaul <a href=\"https:\/\/thefederalist.com\/2024\/06\/05\/wisconsin-ag-files-phony-fake-elector-charges-anyway-after-admitting-gop-plan-was-legal\/\" target=\"_blank\" rel=\"noreferrer noopener\">earlier this month<\/a> filed phony \u201cfake electors\u201d charges months after his own Department of Justice said there was no crime. As I <a href=\"https:\/\/thefederalist.com\/2024\/06\/05\/wisconsin-ag-files-phony-fake-elector-charges-anyway-after-admitting-gop-plan-was-legal\/\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> at the time, the Democrat\u2019s charges against Trump attorneys Kenneth Chesebro and Jim Troupis, as well as political operative Michael Roman, curiously arrived just a few days after a <a href=\"https:\/\/thefederalist.com\/2024\/06\/04\/chuck-schumers-brother-works-for-law-firm-behind-braggs-get-trump-indictment\/\" target=\"_blank\" rel=\"noreferrer noopener\">Manhattan kangaroo court<\/a> found Trump guilty in a Soviet-style show trial. <\/p>\n<p>As I reported: <\/p>\n<p><em>The leftist AG was taking a lot of heat for failing to deliver the heads of Trump\u2019s allies on a political platter, despite the fact that the Wisconsin Elections Commission had <\/em><a href=\"https:\/\/apnews.com\/article\/wisconsin-fake-electors-trump-2020-062c7b6638b945f816185bdf1f231195\" target=\"_blank\" rel=\"noreferrer noopener\"><em>twice rejected complaints<\/em><\/a><em>  from a leftist lawfare group about the Republican alternate electors. Interestingly, the Wisconsin Department of Justice said the Republicans who attempted to cast electoral votes for Trump did not violate any election laws. <\/em><\/p>\n<p><em>Kaul\u2019s agency \u201cconcluded that Republicans were legitimately trying to preserve Trump\u2019s legal standing as courts were deciding if he or Biden won the election,\u201d the Associated Press <\/em><a href=\"https:\/\/apnews.com\/article\/wisconsin-fake-electors-trump-2020-062c7b6638b945f816185bdf1f231195\" target=\"_blank\" rel=\"noreferrer noopener\"><em>reported<\/em><\/a><em>.<\/em><\/p>\n<p>Von Spakovsky said either Kaul is now saying his own DOJ lawyers were incompetent or he\u2019s overriding them for political reasons. The constitutional law expert believes it\u2019s the latter. <\/p>\n<h2>Civil Rights Violations<\/h2>\n<p>Arizona, Georgia, and Michigan also are targeting Trump supporters in similar politically driven prosecutions. All are being led by Democrat prosecutors, including Fulton County, Georgia\u2019s <a href=\"https:\/\/thehill.com\/homenews\/4516182-fulton-county-ethics-board-fani-willis\/\" target=\"_blank\" rel=\"noreferrer noopener\">legally and ethically suspect<\/a> district attorney <a href=\"https:\/\/fedsoc.org\/commentary\/fedsoc-blog\/the-georgia-fake-electors-scheme-what-does-legal-and-political-history-tell-us-about-these-charges#:~:text=Five%20of%20the%2019%20defendants,to%20show%20up%20at%20their\" target=\"_blank\" rel=\"noreferrer noopener\">Fani Willis<\/a>. <\/p>\n<p>In each case, the alternate electors have argued they were not breaking the law, but protecting Trump\u2019s rights should his campaign prevail in legal challenges in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/zuckerberg-used-a-tax-exempt-foundation-to-help-biden-fix-the-2020-election\/\" title=\"Zuckerberg Used a Tax-Exempt Foundation to Help Biden Fix the 2020 Election\">hotly contested battleground states<\/a>. <\/p>\n<p>Von Spakovsky said the Nevada prosecution is more of the same from Democrats who have tried every trick in the book to politically take out Trump, including the unconstitutional scheme to <a href=\"https:\/\/thefederalist.com\/2024\/02\/06\/meet-the-two-groups-behind-plot-to-kick-trump-off-the-ballot-and-he-isnt-the-only-target\/\">remove the Republican<\/a> from the primary ballot. <\/p>\n<p>He also noted there should be a legal reckoning for the kinds of civil rights abuses going on in left-led prosecutors\u2019 offices in recent years. <\/p>\n<p>\u201cThere are federal Civil Rights statutes that the Justice Department has the ability to enforce, to go after state judges and state prosecutors and others who are abusing the legal process to interfere with individual civil rights and others under the constitution,\u201d the former DOJ counsel to the Assistant Attorney General for Civil Rights said. \u201cI hope if Donald Trump wins the election that his DOJ goes after <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dems-include-money-for-abortion-providers-in-1-9-trillion-covid-aid-package\/\" title=\"Dems Include Money for Abortion Providers in .9 Trillion COVID Aid Package\">state attorneys general<\/a> and prosecutors for what they\u2019ve been doing.\u201d <\/p>\n<hr>\n<p>      Matt Kittle is a senior elections correspondent for The Federalist.
