Trump\u2019s defense argues \u200cthat his 40 charges of retaining \u2062national defense information should be dismissed, claiming Smith\u2019s appointment was unvetted and improperly funded.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div data-td-block-uid=\"tdi_79\">\n<p>Judge Aileen Cannon spent Monday morning in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/florida\" target=\"_blank\" rel=\"noopener\" title=\"Florida\">Florida<\/a> questioning attorneys in former President Donald Trump\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/classified-documents\/\" target=\"_blank\" rel=\"noopener\" title=\"Florida\">classified documents<\/a> case about the funding for special counsel <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/jack-smith\" target=\"_blank\" rel=\"noopener\" title=\"Florida\">Jack Smith<\/a>\u2018s office.<\/p>\n<p>Cannon\u2019s questions came during a continuation of a hearing that began on Friday in which the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/u-s-district-judge-hears-arguments-over-latest-eviction-ban-extension\/\" title=\"U.S. district judge hears arguments over latest eviction ban extension\">judge heard arguments<\/a> about whether Smith was lawfully appointed to his position as special counsel.<\/p>\n<p>Trump\u2019s defense team has argued the former president\u2019s 40 charges of retaining national defense information should be dismissed on the grounds that Smith\u2019s appointment was both unvetted and improperly funded.<\/p>\n<p>Trump attorney Emil Bove <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3055544\/judge-questions-trump-claim-smith-shadow-government\/\" target=\"_blank\" rel=\"noopener\" title>argued<\/a> on Friday that unlike almost every special counsel of the last 40 years, Smith was not previously a Senate-confirmed U.S. attorney. Smith was therefore not vetted by the Senate before Attorney General Merrick Garland appointed him, Bove said.<\/p>\n<p>The hearings have been dense as Cannon entertains weedy legal theories about the constitutional provisions and statutes that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-questions-trump-claim-that-smith-is-part-of-shadow-government\/\" title=\"Judge scrutinizes Trump's assertion that Smith belongs to a 'shadow government\">govern <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-blitzkrieg-on-bill-barr-and-john-durham-is-just-beginning\/\" title=\"The Blitzkrieg On Bill Barr And John Durham Is Just Beginning\">special counsel appointments<\/a><\/a>, according to courtroom reports.<\/p>\n<p>On Monday, Cannon <a href=\"https:\/\/x.com\/KlasfeldReports\/status\/1805268246808928605\" target=\"_blank\" rel=\"noopener\" title>gave<\/a> Smith\u2019s team a \u201crough reception\u201d as she examined the funding the special counsel had received through Congress, according to <em>Just Security. <\/em>Smith was in the courtroom for the hearing.<\/p>\n<p>Cannon, a Trump appointee, did not appear satisfied by what she perceived was the Biden administration\u2019s \u201climitless\u201d funding for Smith\u2019s office, saying it created concerns for her about the separation of powers, <em>Just Security<\/em> reported.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>The judge did not rule from the bench on Trump\u2019s motion to dismiss his charges, but she has surprised some legal observers with how much time and consideration she has given to Trump\u2019s argument, as courts have already exhaustively examined other special counsel appointments.
