Anna Paulina Luna of Florida said she will push for a vote putting Garland in what is called inherent contempt of Congress over the Department of Justice\u2019s refusal to provide the audio tape of special counsel Robert Hur\u2019s interviews with President Joe Biden during Hur\u2019s probe of Biden\u2019s possession of classified documents, <a href=\"https:\/\/www.foxnews.com\/politics\/anna-paulina-luna-force-vote-garlands-arrest-week-after-doj-refuses-criminal-referral\" target=\"_blank\" rel=\"noopener\">Fox News<\/a> reported Monday.<\/p>\n<p>Garland has said he will not make the <a href=\"https:\/\/www.westernjournal.com\/doj-refuses-comply-congressional-subpoena-hand-biden-audio-despite-threat-contempt\/\" target=\"_blank\" rel=\"noopener\">tapes public<\/a> because of Biden\u2019s claim of executive privilege.<\/p>\n<p>\u201cThe only option to ensure compliance with our subpoena is to use our constitutional authority of inherent contempt,\u201d Luna said in a letter to other members of the House.<\/p>\n<p>\u201cIn the next few days, I will call up my resolution holding Attorney General Merrick Garland in inherent contempt of Congress, and I look forward to each of you voting in favor of it,\u201d she wrote.<\/p>\n<p>\u201cThe urgency of this situation cannot be overstated. Our ability to legislate effectively and fulfill our constitutional duties is at stake. We must act now to protect the integrity and independence of the legislative branch,\u201d the congresswoman said.<\/p>\n<p>Inherent contempt allows the House sergeant at arms to take an individual into custody for congressional action, according to the <a href=\"https:\/\/constitutioncenter.org\/blog\/the-houses-contempt-powers-explained\" target=\"_blank\" rel=\"noopener\">Constitution Center<\/a>.<\/p>\n<p>Fox News\u2019 Chad Pergram said a contempt vote could come Wednesday or Thursday.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">1) House sources are expecting Rep. Anna Paulina Luna (R-FL) to force a vote to hold Attorney General Merrick Garland in \u201cinherent contempt\u201d of Congress sometime in the middle of next week. It declined to act upon the House\u2019s request.<\/p>\n<p>Luna\u2019s letter said that was the last straw, according to Fox News.<\/p>\n<p>\u201cThe Department of Justice\u2019s blatant disregard for Congress as an institution, exemplified by its refusal to prosecute Attorney General Merrick Garland, is a direct threat to this legislative body. Attorney General Garland\u2019s defiance of two lawful subpoenas is a clear violation of our authority,\u201d she wrote.<\/p>\n<p>The <a href=\"https:\/\/www.westernjournal.com\/gop-rep-luna-tears-hearing-witness-starts-laughing-child-trafficking-border\/\" target=\"_blank\" rel=\"noopener\">congresswoman<\/a> said Congress needs to use its teeth, not just show them.<\/p>\n<p>\u201cThe executive branch will continue to withhold information from Congress if there are no consequences for their actions,\u201d Luna said.<\/p>\n<p>\u201cIt is imperative that Congress uses its inherent contempt powers and instructs the Sergeant at Arms to bring Attorney General Garland to the House for questioning and compel him to produce the requested evidence,\u201d she wrote.<\/p>\n<p>\u201cThe Department of Justice and the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-ag-barr-authorizes-federal-prosecutors-to-pursue-substantial-allegations-of-voting-irregularities-before-2020-election-is-certified\/\" title=\"BREAKING: AG Barr Authorizes Federal Prosecutors to Pursue \"Substantial Allegations\" of Voting Irregularities Before 2020 Election is Certified\">attorney general<\/a> cannot be the ultimate deciders of whether or not a congressional subpoena is enforced.
