This decision follows the Justice Department&#8217;s \u2063refusal to prosecute Garland after the House voted to hold\u200c him in \u200ccontempt of Congress. The\u200d contempt \u200dcharge \u2063was based on Garland&#8217;s refusal to release an audio recording of an interview conducted with President Joe Biden by special counsel Robert \u200bHur\u200c regarding classified \u200cdocuments.<\/p>\n<p>Luna criticizes the Department of Justice&#8217;s decision as a disregard for congressional authority and warns that it sets a concerning precedent, where\u2064 the executive branch might continue to withhold information from Congress without facing consequences. Luna&#8217;s resolution is distinguished by its reliance on the seldom-used inherent\u200d contempt power, which permits \u200dCongress to\u2062 imprison\u200c individuals who \u200ddefy its demands until they comply. However, the move all but fell on deaf ears after the DOJ said it would <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3045860\/doj-garland-wont-be-prosecuted-for-contempt\/\" target=\"_blank\" rel=\"noopener\" title>not seek to charge Garland <\/a><a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3045860\/doj-garland-wont-be-prosecuted-for-contempt\/\" target=\"_blank\" rel=\"noopener\" title>criminally<\/a>.<\/p>\n<p>In a \u201cDear Colleague\u201d letter on Monday, Luna blasted the DOJ\u2019s decision not to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/officials-wont-seek-charges-against-capitol-officer-for-ashli-babbitt-shooting\/\" title=\"Officials Won\u2019t Seek Charges Against Capitol Officer For Ashli Babbitt Shooting\">seek criminal charges<\/a> as \u201cblatant disregard for Congress as an institution.\u201d<\/p>\n<p>\u201cWhile that response was expected, it set a dangerous precedent,\u201d Luna wrote in the letter obtained by the <em>Washington Examiner.<\/em> \u201cThe executive branch will continue to withhold information from Congress if there are not consequences for their actions.\u201d<\/p>\n<p>Differing from the <a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/3006451\/judiciary-committee-passes-merrick-garland-contempt-resolution\/\" target=\"_blank\" rel=\"noopener\" title>resolution from the Judiciary Committee<\/a>, Luna\u2019s resolution relies on a <a href=\"https:\/\/sgp.fas.org\/crs\/misc\/RL34097.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">long-dormant \u201cinherent contempt\u201d power<\/a> that allows the House to imprison someone until compliant with the congressional demand.<\/p>\n<p>Under the process, which hasn\u2019t been used since 1935, the person being held in contempt could be arrested by the sergeant-at-arms and brought to the House floor for trial and can be imprisoned or detained in the Capitol.<\/p>\n<p>House GOP leaders have been persistent in their requests for the audio recording, believing it can shed insight into Biden\u2019s mental faculties, while Garland and House Democrats have claimed the<a href=\"https:\/\/www.washingtonexaminer.com\/news\/house\/3006451\/judiciary-committee-passes-merrick-garland-contempt-resolution\/\" target=\"_blank\" rel=\"noreferrer noopener\"> recording is unnecessary<\/a> because the \u201cverbatim\u201d transcript is already public.<\/p>\n<p>\u201cWe can proceed with criminal, civil, or inherent contempt\u201d to respond to Garland\u2019s refusal to turn the recording over, Luna wrote, but \u201cboth criminal and civil contempt rely on the other branches for enforcement, a situation that would have been unimaginable to our founding fathers.\u201d<\/p>\n<p>\u201cThe Department of Justice and the attorney general cannot be the ultimate deciders of whether or not a congressional subpoena is enforced,\u201d the Florida congresswoman continued. \u201cIf Congress allows this to happen, we risk being subordinated to the attorney general and being completely neutered in our ability to legislate.\u201d<\/p>\n<p>The House will return from its weeklong recess on Tuesday. If Luna decides to file her resolution as privileged on Tuesday or Wednesday, it could set up a vote on inherent contempt of Garland this week.<\/p>\n<p>All Democrats had voted against the contempt resolution led by the Judiciary and Oversight committees. Several accused Republicans of politicizing the matter and wanting the audio recording for \u201cDonald Trump\u2019s campaign commercials\u201d or to use Biden\u2019s stutter to \u201csmear\u201d him.<\/p>\n<p>\u201cRepublicans seem to be OK when, you know, if Democrats are held to account by the legal system, but if a Republican is held to account, they cry, you know, \u2018Sham, rigged system, undue influence by, you know, the administration,&#8217;\u201d Rules Committee ranking member Jim McGovern (D-MA) told the <em>Washington Examiner<\/em> ahead of the vote on June 12. \u201cI mean the hypocrisy is stunning.\u201d<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>Republicans have argued that Biden\u2019s assertion of executive privilege over the audio recording further supported GOP claims that the tape is critical to their impeachment inquiry of the president and broader investigation into the Biden family.<\/p>\n<p>\u201cTranscripts do not and cannot capture things like tone, inflection, pace, and pauses that fully convey a person\u2019s message,\u201d House Majority Whip Tom Emmer (R-MN) said. \u201cThe audio recordings are necessary to adequately evaluate Special Counsel Hur\u2019s assessment about President Biden\u2019s memory and to determine whether the DOJ is engaging in a two-tiered application of justice by refusing to indict Joe Biden.\u201d<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rep.
