Douglas Golden<\/span><\/a> <\/span> <span>   June 23, 2024 at 6:30am <\/span> <\/span>  <\/header>\n<section>\n<p>If you\u2019re an entrepreneur and you\u2019re looking for a surefire business success, I have an idea for you: open a bakery in Colorado.<\/p>\n<p>This is because, nearest I can tell, there\u2019s only one and it\u2019s owned by a devout Christian. And \u2014 wouldn\u2019t you know it? \u2014 there\u2019s apparently this incredible demand for cakes celebrating occasions that are directly opposed to this baker\u2019s deeply held religious values. Also, apparently nobody can bake out there.<\/p>\n<p>So, get there quick and open up your cake shop, and I guarantee you that you\u2019ll be rolling in the cash in the gay marriage and gender transition confection market.<\/p>\n<p>To be fair, I haven\u2019t done market research \u2014 but this is the only conclusion I can draw from the fact that baker Jack Smith finds himself in court <em>again<\/em> as part of a decade-long battle over his refusal <a href=\"https:\/\/www.westernjournal.com\/colorado-court-rules-christian-baker-jack-phillips-plan-already-motion\/\" target=\"_blank\" rel=\"noopener\">to make cakes<\/a> for occasions that violate his First Amendment right to exercise his religion.<\/p>\n<p>According to the <a href=\"https:\/\/www.washingtontimes.com\/news\/2024\/jun\/18\/jack-phillips-goes-colorado-supreme-court-over-ref\/?utm_medium=SocialFlow&#038;utm_source=Twitter&#038;utm_campaign=twtnl_x\" target=\"_blank\" rel=\"noopener\">Washington Times<\/a>, the latest case \u2014 Scardina v. Masterpiece Cakeshop, Smith\u2019s bakery \u2014 involves his refusal to bake a blue-and-pink gender transition cake. The state Supreme Court heard <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admin-asks-supreme-court-to-cancel-asylum-border-wall-arguments\/\" title=\"Biden Admin Asks Supreme Court to Cancel Asylum, Border Wall Arguments\">oral arguments<\/a> in the case on Tuesday, which involved a request to bake a cake from seven years ago. You read that correctly.<\/p>\n<p>\u201cInside the courtroom, the seven judges focused on the cake \u2014 blue on the outside, pink on the inside \u2014 that Autumn Scardina requested in 2017 to celebrate the first anniversary of her gender transition,\u201d the Times reported.<\/p>\n<p>\u201cMasterpiece declined to make the custom cake after learning what it represented.\u201d<\/p>\n<p>And boy, if you thought now-Supreme Court Justice Ketanji Brown-Jackson was dense when she couldn\u2019t <a href=\"https:\/\/www.westernjournal.com\/biden-scotus-nominee-says-cant-define-word-woman-not-biologist\/\" target=\"_blank\" rel=\"noopener\">answer what a woman was<\/a> during her confirmation hearings, let me introduce you to Colorado Supreme Court Justice Melissa Hart, who came up with a hypothetical that has to be heard to be believed and may not be believed even then.<\/p>\n<p>According to the Times, the justice \u201clisted examples of how identical blue-pink cakes could be used for four different occasions, including a gender transition; the birthday of boy-and-girl twins; the loss in utero of fraternal twins, or no occasion at all.\u201d<\/p>\n<div id=\"firefly-poll-container\">\n<p>Should Jack Phillips be allowed to counter-sue for millions every person who put him through this legal hell?<\/p>\n<\/p><\/div>\n<p>\u201cThose four cakes could go to the wrong houses, and it wouldn\u2019t matter,\u201d Justice Hart said.<\/p>\n<p>\u201cIt\u2019s pink cakes with blue icing. And if they go to the wrong houses, such as that the one that was for the fraternal twins went to the transition home, it wouldn\u2019t matter. It\u2019s the same cake.\u201d<\/p>\n<p>Except there weren\u2019t four cakes. There was one cake. It was a gender transition cake. And it done by a transgender activist specifically to troll <a href=\"https:\/\/www.westernjournal.com\/scotus-justices-thomas-alito-urge-court-reconsider-2015-gay-marriage-ruling\/\" target=\"_blank\" rel=\"noopener\">Jack Phillips<\/a> and drag him into court again. This is giving the phrase \u201cjustice is blind\u201d a whole new meaning.<\/p>\n<p>Phillips\u2019 attorney, Jake Warner of the conservative Alliance Defending Freedom, noted that \u201ceven the same words can express different things depending on the context,\u201d quoting the majority opinion of the late Justice <a href=\"https:\/\/www.westernjournal.com\/video-usa-today-fact-checks-babylon-bee-article-joked-rbg-raised-dead\/\" target=\"_blank\" rel=\"noopener\">Ruth Bader Ginsburg<\/a> in 2015\u2019s Yates v. United States.<\/p>\n<p>\u201cFor example, \u2018my body, my rights\u2019 might mean one thing to an abortion advocate, and mean something totally different to an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/medical-kidnapping-hospital-refuses-to-let-daughter-see-her-elderly-mother-for-not-taking-covid-test-crowd-comes-and-gets-mom-released-videos\/\" title=\"\u2018MEDICAL KIDNAPPING\u2019: Hospital Refuses to Let Daughter See Her Elderly Mother for Not Taking COVID Test, Crowd Comes and Gets Mom Released (VIDEOS)\">anti-vaxxer<\/a>,\u201d Warner argued.<\/p>\n<p>\u201cHere, just because Phillips could create an identical-looking cake doesn\u2019t mean that he can create this cake that expresses a message that goes against his beliefs.\u201d<\/p>\n<p>Instead, Warner said, the meaning of the cake was crucial because \u201cthe <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/josh-hammer-will-the-conservative-momentum-at-the-supreme-court-continue-this-term\/\" title=\"Josh Hammer: Will the Conservative Momentum at the Supreme Court Continue This Term?\">compelled speech doctrine<\/a> protects the individual freedom of mind.\u201d<\/p>\n<p>The <a href=\"https:\/\/firstamendment.mtsu.edu\/article\/compelled-speech\/#:~:text=The%20compelled%20speech%20doctrine%20sets,group%20to%20support%20certain%20expression.\" target=\"_blank\" rel=\"noopener\">compelled speech doctrine<\/a> is a principle of <a href=\"https:\/\/www.westernjournal.com\/catholic-group-sues-biden-administration-blatant-violation-first-amendment\/\" target=\"_blank\" rel=\"noopener\">First Amendment<\/a> jurisprudence which states that the government can\u2019t force any individual to support certain forms of expression, verbally or non-verbally.<\/p>\n<p>The case came after the Colorado Civil Rights Commission settled with Phillips after Scardina\u2019s complaint regarding the cake. Scardina was unhappy with the settlement, however, and has won at both trial and appeals court.<\/p>\n<p>Given that all seven justices on the Colorado Supreme Court were appointed by Democrats, too, it\u2019s entirely likely Phillips will lose there \u2014 and the case will go to the Supreme Court after he faces that judicial firing squad.<\/p>\n<p>His chances are better at the high court, considering the precedent of 303 Creative LLC v. Elenis. In that 2023 case, the court said that that Colorado\u2019s anti-discrimination laws involving LGBT individuals did not mean the state could force individuals to create or sell products against their <a href=\"https:\/\/www.westernjournal.com\/judges-rule-christian-web-designers-beliefs-not-supersede-colorado-law-refuses-promote-gay-marriage\/\" target=\"_blank\" rel=\"noopener\">religious beliefs<\/a>.<\/p>\n<p>In that case, a Christian web designer was sued because she wouldn\u2019t create wedding sites for same-sex couples. During oral arguments, attorneys for Scardina argued that, because that content creator would \u201cproduce a final story for each couple using her own words and her own original artwork,\u201d it differed from this case.<\/p>\n<p>Whatever the matter, one thing is clear: Either there\u2019s one cake shop in the entire state of Colorado or the left is basically intent on targeted lawfare to bankrupt a Christian businessman.<\/p>\n<p>Phillips, however, isn\u2019t bending the knee to the woke mob.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">\u201cOver the last 10 years, Colorado officials and activists have tried to punish me for my religious beliefs. They have even tried to change my beliefs. Through all this, I believe firmly that free speech is for everyone, and no one should be forced to express a message that they don\u2019t believe.\u201d<\/p>\n<p>Enough is enough.
