The dismissal by Judge Mary\u2063 Kay Holthus in Clark\u2063 County was based on a lack \u200cof jurisdiction; the case was filed in an inappropriate county, according \u200cto \u2064the judge. The Nevada attorney general,\u200c a Democrat, filed the charges in\u200b Clark County,\u2063 but the alleged activities occurred in Carson\u2062 City or Douglas County, \u2063which the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/changes-in-public-legal-perception-ahead-of-derek-chauvin-trial\/\" title=\"Changes in public, legal perception ahead of Derek Chauvin trial\">defense argued<\/a> were the proper \u2062venues. While the \u2063current ruling prevents re-filing of charges in another jurisdiction due to statutes of limitations, the \u200dNevada Attorney General&#8217;s office plans to challenge the dismissal.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>A judge in <a href=\"http:\/\/www.washingtonexaminer.com\/tag\/nevada\" target=\"_blank\" rel=\"noopener\" title=\"Nevada\">Nevada<\/a> dismissed a case Friday involving six defendants who faced charges of illegally claiming they were the state\u2019s electors in the wake of former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noopener\" title=\"Donald Trump\">Donald Trump<\/a>\u2018s defeat in the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/2020-elections\/?utm_source=google&#038;utm_medium=cpc&#038;utm_campaign=Pmax_USA_Magazine_21-June-Intent-Audience-Signals&#038;gad_source=1&#038;gclid=CjwKCAjwydSzBhBOEiwAj0XN4OCzFLO74FzNjfOc-NFVdq40JVm6yHyWltSXC216nCNpsnQkIyrIXxoCBZgQAvD_BwE\" target=\"_blank\" rel=\"noopener\" title=\"\">2020<\/a> presidential election.<\/p>\n<p>Judge Mary Kay Holthus of Clark County <a href=\"https:\/\/thenevadaindependent.com\/article\/judge-dismisses-nevada-fake-electors-case-over-lack-of-jurisdiction\" target=\"_blank\" rel=\"noopener\" title=\"\">said<\/a> at a hearing that the Nevada attorney general, a Democrat, filed the charges in a county that lacked jurisdiction over the case, according to the website the Nevada Independent.<\/p>\n<p>\u201cYou have literally, in my opinion, a crime that has occurred in another jurisdiction,\u201d Holthus said. \u201cIt\u2019s so appropriately up north and so appropriately not here.\u201d<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-jury-reaches-partial-verdict-in-gretchen-whitmer-kidnapping-plot-trial\/\" title=\"BREAKING: Jury Reaches Partial Verdict In Gretchen Whitmer Kidnapping Plot Trial\">defendants\u2019 attorneys argued<\/a> the charges should be dropped, claiming that other venues, such as Carson City or Douglas County, were more appropriate because activities cited in the indictment had taken place in those locations.<\/p>\n<p>While statutes of limitations prevent the state from being able to bring charges again in a different jurisdiction, a spokesman for Nevada Attorney General Aaron Ford said in a statement to the <em>Washington Examiner<\/em> that his office will challenge Holthus\u2019s ruling.<\/p>\n<p>\u201cWe disagree with the judge\u2019s decision and will be appealing immediately,\u201d the spokesman said.<\/p>\n<p>The six defendants charged included Michael McDonald, Nevada GOP chairman and a loyal <a href=\"https:\/\/www.nytimes.com\/2024\/02\/08\/us\/politics\/nevada-trump-michael-mcdonald.html\" target=\"_blank\" rel=\"noopener\" title=\"\">supporter<\/a> of Trump since 2015.
