The case \u2064involved\u2062 Zackey \u200bRahimi, who violated federal law by possessing firearms while under \u200ca restraining order,\u2062 and is currently jailed for related offenses. \u2064The Biden Administration, emphasizing the need to protect domestic\u200c violence victims, successfully \u2062argued that\u2062 historical precedent supports disarmament of &#8220;not responsible citizens&#8221;\u200b to\u200c ensure public safety.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\" target=\"_blank\" rel=\"noopener\" title=\"Supreme Court\">Supreme Court<\/a> on Friday upheld federal prohibitions on possession of <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/firearms\" target=\"_blank\" rel=\"noopener\" title=\"Supreme Court\">firearms<\/a> for those who are subjected to domestic violence restraining orders.<\/p>\n<p>\u201cWhen an individual has been found by a court to pose a credible threat to the physical safety of another, that individual may be temporarily disarmed consistent with the Second Amendment,\u201d Chief Justice John Roberts wrote in the 8-1 decision.<\/p>\n<p>The decision marks the high court\u2019s first major <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/second-amendment\/\" target=\"_blank\" rel=\"noopener\" title=\"Second Amendment\">Second Amendment<\/a> decision since its landmark ruling in <em>New York State Rifle &#038; Pistol Association v. Bruen, <\/em>which held that courts must look at whether a gun law is consistent with America\u2019s \u201chistory and tradition\u201d of firearm regulation. The test became a point of contention for some lower court judges who said it was difficult to apply, in part due to an array of different interpretations of the test that have been applied since 2022.<\/p>\n<figure><figcaption>Zackey Rahimi (Tarrant County Texas).<\/figcaption><\/figure>\n<p>The case known as <em>Rahimi v. U.S.<\/em> involved plaintiff Zackey Rahimi, who previously pleaded guilty to possessing firearms while under a civil protective order that banned him from harassing, stalking, or threatening his ex-girlfriend and their child and also banned him from having guns. Rahimi remains in jail as he faces separate gun charges, including for his participation in a string of five different shootings between December 2020 and January 2021.<\/p>\n<p>Separate from his state criminal charges, a grand jury indicted Rahimi on charges of violating 18 <a href=\"https:\/\/www.justice.gov\/archives\/jm\/criminal-resource-manual-1116-prosecutions-under-18-usc-922g8\" target=\"_blank\" rel=\"noopener\" title>U.S.C. \u00a7 922(g)(8)<\/a>, a federal law that prohibits a person under such an order from having a gun, an offense punishable by up to 10 years in prison. Mr. Rahimi argued the law violated the Second Amendment.<\/p>\n<p>Last year, the U.S. Court of Appeals for the 5th Circuit ruled in favor of Rahimi over his bid to challenge the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-upholds-prohibitions-on-guns-for-domestic-violence-offenders-washington-examiner\/\" title=\"Supreme Court maintains gun bans for domestic violence offenders - Washington Examiner\">federal statute surrounding gun ownership<\/a> for individuals under a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-biden-gun-rights-appeal-could-place-president-in-awkward-political-position\/\" title=\"Hunter Biden's gun rights appeal may create a tricky political situation for the president\">civil domestic violence restraining order<\/a>. The 5th Circuit ultimately found the federal statute was unconstitutional under the Second Amendment and the <em>Bruen <\/em>precedent. <\/p>\n<p>The appeals court\u2019s decision was met with strong opposition from the Biden administration, prompting U.S. Attorney General <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/merrick-garland\/\" target=\"_blank\" rel=\"noopener\" title=\"Merrick Garland\">Merrick Garland<\/a> to appeal to the Supreme Court. The Biden administration argued that the law is necessary to protect victims of domestic violence, citing statistics that show a significant proportion of domestic homicides involve firearms.<\/p>\n<p>In <em>Bruen<\/em>, the court established that firearms regulations must align with the nation\u2019s \u201chistorical tradition.\u201d This precedent was set when the justices, in a 6-3 decision written in 2022 by Justice Clarence Thomas, overturned New York\u2019s handgun licensing requirements.<\/p>\n<p>The <em>Rahimi<\/em> case ultimately posed a significant challenge for the Supreme Court\u2019s delicate balancing act between adhering to Second Amendment rights and upholding the rule of law.<\/p>\n<p>During the oral arguments, Solicitor General Elizabeth Prelogar emphasized the risks posed by allowing individuals deemed dangerous to possess guns. She argued that people under restraining orders fall into a category of \u201cnot responsible citizens\u201d who historically have been subject to disarmament for public safety reasons.<\/p>\n<p>Roberts and other justices questioned the appropriate legal test to balance the Second Amendment rights with public safety concerns. Justices Brett Kavanaugh and Amy Coney Barrett, who joined the court\u2019s majority in <em>Bruen<\/em>, highlighted that the Second Amendment permits various gun regulations, including disarmament of individuals who pose a danger to society.<\/p>\n<p>The outcome of <em>Rahimi<\/em> will likely provide some clarity on how the historical framework established in <em>Bruen<\/em> applies to modern gun control measures, though <a href=\"https:\/\/sufficientlyanalogous.libsyn.com\" target=\"_blank\" rel=\"noopener\" title>legal experts have suggested<\/a> the decision is unlikely to redesign the two-year-old Second Amendment test.<\/p>\n<p>Meanwhile, President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\" target=\"_blank\" rel=\"noopener\" title=\"Joe Biden\">Joe Biden<\/a>\u2018s son Hunter Biden was found guilty by a jury this month for violating a subcomponent of \u00a7 922(g) which prohibits people who are under the influence of illicit drugs or have been addicted to such substances from owning a firearm. The jury convicted the younger Biden on Tuesday of lying on a federal form to purchase a gun by asserting he was not a drug user, lying to a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-strategy-for-combating-surge-in-crime-focuses-largely-on-combating-gun-violence\/\" title=\"Biden\u2019s Strategy For Combating Surge In Crime Focuses Largely On Combating \u2018Gun Violence\u2019\">federally licensed firearm dealer<\/a>, and illegally owning the gun\u00a0for 11 days.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>As Hunter Biden\u2019s attorneys have vowed to appeal the conviction, the 5th Circuit recently found that <a href=\"https:\/\/www.justice.gov\/sites\/default\/files\/usao-ut\/legacy\/2013\/06\/03\/guncard.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Section 922(g)(3)<\/a>, which punishes anyone who is an \u201cunlawful user of or addicted to any controlled substance,\u201d is unconstitutional under the <em>Bruen <\/em>framework.
