The defense argues that Special Counsel Jack Smith was unlawfully appointed by Attorney General Merrick Garland, violating the \u2063Appointments Clause, which they claim requires \u2063Senate confirmation for such an appointment. Trump&#8217;s team is supported by \u2063an amicus brief from two former Republican attorneys general and two law professors, asserting that the legal basis for Smith&#8217;s \u200dappointment is outdated and not supported by recent precedent. Smith&#8217;s defense maintains that his appointment was in accordance with the Appointments\u200c Clause and appropriately funded by\u200c Congress. \u2062The \u200dhearing is part of ongoing pre-trial procedures, with additional hearings also scheduled.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\" target=\"_blank\" rel=\"noopener\" title=\"Donald Trump\">Donald Trump<\/a>\u2018s defense team will have an opportunity to argue at a hearing in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/florida\" target=\"_blank\" rel=\"noopener\" title=\"Florida\">Florida<\/a> on Friday that the classified documents case should be dismissed on the grounds that <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/jack-smith\" target=\"_blank\" rel=\"noopener\" title=\"Jack Smith\">Jack Smith<\/a> was allegedly unlawfully appointed special counsel.<\/p>\n<p>Judge Aileen Cannon scheduled a hearing on the matter as she addresses one by one the various legal motions Trump has filed to challenge the case, a methodical approach by the judge that has drawn criticism from some and praise from others.<\/p>\n<p>Friday\u2019s hearing will entertain a request Trump filed in February that his case should be dismissed on the grounds that Attorney General Merrick Garland defied an Appointments Clause when he chose Smith to lead two prosecutions against Trump.<\/p>\n<p>\u201cThe Appointments Clause does not permit the Attorney General to appoint, without Senate confirmation, a private citizen and like-minded political ally to wield the prosecutorial power of the United States,\u201d Trump\u2019s defense attorneys argued. \u201cAs such, Jack Smith lacks the authority to prosecute this action.\u201d<\/p>\n<p>In an amicus brief, also known as a \u201cfriend of the court\u201d filing, that was submitted in favor of Trump by two former Republican attorneys general and two law professors, the group of four <a href=\"https:\/\/www.courtlistener.com\/docket\/67490069\/618\/united-states-v-trump\/\" target=\"_blank\" rel=\"noopener\" title>noted<\/a> how only two special counsels in the past 40 years, Jack Smith and Robert Mueller, were appointed without having ever been confirmed by the Senate as U.S. attorneys.<\/p>\n<p>\u201cContrary to Smith\u2019s attempt to portray the authority underlying his appointment as supported by longstanding precedent, in fact the legal basis for his appointment is a vestigial holdover of a bygone jurisprudential era,\u201d the four legal scholars wrote. \u201cAnd that legal flaw likely went unaddressed because, with only one exception, each special prosecutor for more than forty years before Smith\u2019s appointment was in fact duly authorized by statute.\u201d<\/p>\n<p>Smith\u2019s team, for its part, has argued that Smith taking the position of special counsel was, in fact, compatible with the Appointments Clause and that his office is funded through a proper channel from Congress.<\/p>\n<p>Trump\u2019s trial on the 40 charges he is facing for allegedly retaining national defense information was initially scheduled for May this year.<\/p>\n<p>Cannon scrapped that date, however, and has not yet scheduled a new trial as she faces a logjam of disputes to settle between the parties and other pre-trial steps that still must be followed. She could address some of them after Friday\u2019s hearing or additional hearings she has scheduled beginning Monday, but it has become increasingly unlikely that the pace of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-fbi-paid-for-russian-disinformation-to-frame-trump-and-7-other-takeaways-from-durhams-latest-court-filing-2\/\" title=\"The FBI Paid For Russian Disinformation To Frame Trump\u2014And 7 Other Takeaways From Durham\u2019s Latest Court Filing\">pre-trial process<\/a> would allow for a trial before the presidential election.<\/p>\n<p>Bradley Moss, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jordan-investigates-trump-special-counsel-prosecutor-over-abusive-tactics\/\" title=\"Jordan probes Trump special counsel prosecutor for 'abusive' tactics.\">national security attorney<\/a>, said in a statement to the <em>Washington Examiner<\/em> that the issue of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-stefanik-cawthorn-support-appointing-special-counsel-on-biden-family-china-ties\/\" title=\"Exclusive -- Stefanik, Cawthorn Support\u00a0Appointing Special Counsel on Biden Family China Ties\">special counsel appointment<\/a> has been litigated exhaustively and that Cannon was wasting time by scheduling a hearing on it.<\/p>\n<p>\u201cJudge Cannon continues to go well beyond what is typical or necessary in a criminal matter for addressing pre-trial options, especially for an issue (such as authority to appoint a special counsel) that the courts have repeatedly addressed since the 70s,\u201d Moss said. \u201cThis can and should have been resolved weeks ago on the papers alone. There is no need for a lengthy hearing stretching over a day and a half.\u201d<\/p>\n<p>Cannon\u2019s hearings are small victories for Trump\u2019s team, though, regardless of the outcome of them.
