Twelve years too long.<\/p>\n<p>On Tuesday, June 18, 2024, the Colorado Supreme Court heard oral arguments in <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/MasterpieceScardinaCOOpeningBrief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Masterpiece Cakeshop v. Scardina<\/em><\/a>. At issue is whether the state of Colorado can force Phillips to create a custom-designed cake \u2014 pink on the inside and blue on the outside \u2014 to celebrate and symbolize an impossible \u201cgender transition\u201d from male to female.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-320776013\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-ba5673bffa4bb03b01bfd3cf3933b67d fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-ba5673bffa4bb03b01bfd3cf3933b67d\"><\/div>\n<p>The case is also known as <em>Masterpiece III<\/em> since this is Phillips\u2019 third attempt to preserve his First Amendment rights in the American judicial system. On the very day the U.S. Supreme Court announced it would take up Phillips\u2019 first case, a transgender-identifying activist attorney named Autumn Scardina <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/MasterpieceScardinaOnePageSummary.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">called<\/a> Phillips\u2019 shop and requested he create the custom pink-and-blue cake. As a Christian who believes God created human beings male and female, Phillips politely declined. This led Scardina to file a civil lawsuit (<em>Masterpiece III<\/em>) against Phillips.<\/p>\n<p>Jack Phillips serves <em>all people<\/em>. He will gladly sell anything in his shop to anyone \u2014 including people who identify as LGBT.<\/p>\n<p>But what he won\u2019t do is propagate messages that violate his core beliefs. That\u2019s why he\u2019s also <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/MasterpieceScardinaOnePageSummary.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">refused<\/a> to create custom cakes celebrating Halloween or cakes advocating for the use of marijuana. He\u2019s even declined to create cakes that denigrate people, including people who identify as LGBT.<\/p>\n<p>But that hasn\u2019t stopped some, including Scardina, from disparaging and persecuting Phillips. Scardina has <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/MasterpieceScardinaOnePageSummary.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">called<\/a> Phillips a \u201cbigot\u201d and a \u201chypocrite\u201d \u2014 but he is neither. Phillips is a Christian who refuses to place profit and political correctness over his faith and conscience. He chooses the narrow gate, not the wide one. Now, why did Scardina call <em>Phillips\u2019<\/em> shop, and not one of the hundreds of other bakeries located in the Denver area? And why did he happen to call Phillips on the exact day the U.S. Supreme Court announced it would take his first case?<\/p>\n<div class=\"fdrlst__b89e9-e551aee7af11ba81a77533061ffcd0d0 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-e551aee7af11ba81a77533061ffcd0d0\"><\/div>\n<p>Jack Phillips is being targeted by his ideological opponents to create controversial cakes because they<em> know<\/em> it is something he cannot do. Scardina even <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/MasterpieceScardinaOnePageSummary.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a> Phillips to create a custom cake depicting Satan smoking marijuana and has <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/MasterpieceScardinaOnePageSummary.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">admitted<\/a> to requesting the cakes to \u201ctest\u201d Phillips and to \u201ccorrect the errors of [his] thinking.\u201d<\/p>\n<p>Phillips\u2019 antagonists have deliberately gone after him to ruin his life, destroy his livelihood, and run him out of business. The left often accuses Christians of being intolerant. But the record clearly shows that the bullies going after Phillips are the intolerant ones, determined to prosecute their prejudiced crusade.<\/p>\n<p>With a record like the one described above, you\u2019d think <em>Masterpiece III<\/em> would be an open-and-shut case in Phillips\u2019 favor. But you\u2019d be wrong. Phillips has already lost at both the trial court level and the Colorado Court of Appeals, which <a href=\"https:\/\/dailycitizen.focusonthefamily.com\/not-again-colorado-court-rules-against-jack-phillips-in-a-transgender-cake-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> 3-0 against him on Jan. 26, 2023. Nothing is for certain, but it\u2019s more likely than not that the eventual ruling from the Colorado Supreme Court will be more of the same.<\/p>\n<p>During oral arguments on Tuesday, several of \u201c<a href=\"https:\/\/dailycitizen.focusonthefamily.com\/justice-for-jack-christian-cakebaker-jack-phillips-asks-court-to-protect-his-free-speech-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">the justices used female pronouns to refer to Scardina<\/a>,\u201d who is a man. And all seven justices were <a href=\"https:\/\/www.cnn.com\/2023\/12\/20\/politics\/facts-first-colorado-supreme-court-justices-unelected\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">appointed<\/a> by Democrat governors. Should Phillips lose again at the Colorado Supreme Court, he\u2019ll likely need to appeal \u2014 once again \u2014 to the U.S. Supreme Court. He refuses to cave.<\/p>\n<div class=\"fdrlst__b89e9-8e8a0a7269708fcfb0941a579b8499a0 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-8e8a0a7269708fcfb0941a579b8499a0\"><\/div>\n<p>Thankfully, the current Supreme Court has ruled repeatedly in favor of free speech. Just last year, the <a href=\"https:\/\/dailycitizen.focusonthefamily.com\/landmark-victory-for-free-speech-at-the-u-s-supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">court ruled<\/a> in favor of Christian graphic artist and website designer Lori Smith in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/21-476_c185.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>303 Creative v. Elenis<\/em><\/a>, protecting her from a Colorado law that would have forced her to use her artistic talents to convey messages that violate her beliefs about marriage. If the need arises, we can hope the U.S. Supreme Court will rule in Phillips\u2019 favor once again.<\/p>\n<p>In concluding his argument before the Colorado Supreme Court on Tuesday, Phillips\u2019 lawyer Jake Warner <a href=\"https:\/\/dailycitizen.focusonthefamily.com\/justice-for-jack-christian-cakebaker-jack-phillips-asks-court-to-protect-his-free-speech-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>, \u201cFor over a decade, in lawsuit after lawsuit, Phillips has advocated for the right of every American to express what they believe without fear of government punishment.\u201d<\/p>\n<p>\u201cThis freedom protects the LGBT artist as much as the Christian,\u201d Warner added. \u201cIt protects us all. To preserve this freedom, the harassment must stop. This court should reverse.\u201d<\/p>\n<p>Indeed, it should. Until a decision is reached, Christians, conservatives, and all people of goodwill should rally around Jack Phillips and support him.
