Trump&#8217;s attorney, Alina Habba, \u2063claimed that Judge Engoron had prohibited discussions with \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/esther-king-wins-republican-primary-in-key-illinois-u-s-house-district\/\" title=\"Esther King Wins Republican Primary in Key Illinois U.S. House District\">real estate lawyer<\/a> Adam Leitman Bailey about the case before \u200bdelivering\u2062 his verdict. \u2064The call \u2064for recusal\u200d was prompted by an interview given \u200cby Bailey, in which he disclosed having a conversation with Engoron \u200dat the courthouse. Habba argued that this interaction violated the New York Code \u2064of Judicial.checkSelfPermission  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">Donald Trump<\/a>\u2018s lawyers asked the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/new-york\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a> judge who presided over his civil fraud trial to remove himself from the case, claiming the judge engaged in \u201cprohibited\u201d discussions with a real estate lawyer about the case before issuing his ruling.<\/p>\n<p>Trump attorney <a href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/presidential\/3024113\/trump-guilty-alina-habba-says-trump-met-thumbs-up-verdict\/\" target=\"_blank\" rel=\"noopener\" title>Alina Habba<\/a> said Thursday that Judge Arthur Engoron\u2019s alleged communications with attorney Adam Leitman Bailey regarding the case \u201cdirectly violate\u201d the New York Code of Judicial Conduct. \u201cIt is clear that Judge Engoron should recuse himself immediately,\u201d Habba said.<\/p>\n<figure><figcaption>Judge Arthur Engoron sits on the bench inside New York Supreme Court, Tuesday, Oct. 10, 2023, in New York. (AP Photo\/Seth Wenig, File)<\/figcaption><\/figure>\n<p>The 24-page memorandum to recuse Engoron from the now-decided case cited an interview Bailey gave to NBC New York the day of the verdict, which quoted Bailey as saying he had \u201cthe ability to speak to [this Court] three weeks ago \u2026 I saw him in the corner [at the courthouse] and I told my client, \u2018I need to go\u2019 and I walked over and we started talking \u2026 I wanted him to know what I think [about the case] and why \u2026 I really want him to get it right.\u201d<\/p>\n<p>Trump\u2019s lawyers say the alleged ex parte conversation Engoron had with Bailey is \u201cfundamentally incompatible with the responsibilities attendant to donning the black robe and sitting in judgment.\u201d<\/p>\n<p>\u201cSpecifically, this Court has been publicly accused of engaging in prohibited communications regarding the merits of this case, in clear violation of the Code and this Court\u2019s solemn oath. Such conduct is \u2018antithetical to the role of a judge,&#8217;\u201d Trump\u2019s team alleged, according to the memorandum.<\/p>\n<p>The NBC article was published in May, several months after Engoron issued the $454 million judgment against Trump in February. New York Attorney General Letitia James (D) sued Trump and his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fncs-carlson-if-youre-looking-for-election-rigging-look-no-further-than-media-treatment-of-hunter-biden-saga\/\" title=\"FNC's Carlson: 'If You're Looking for Election Rigging, Look No Further' Than Media Treatment of Hunter Biden Saga\">business associates<\/a> in September 2022 over alleged fraudulent business statements inflating the value of assets in order to secure more <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-attorney-calls-letitia-james-fame-hungry-after-raising-fine-in-civil-fraud-lawsuit\/\" title=\"Trump's lawyer slams Letitia James as 'attention-seeking' for increasing fine in fraud lawsuit\">favorable business terms<\/a>. Engoron sided with the state, and Trump is now appealing the verdict.<\/p>\n<p>It\u2019s not immediately clear when Engoron will respond to the latest memorandum from Trump\u2019s lawyers and what would happen to the already-decided case if he did remove himself.
