While a recent headline suggested that possession of such materials was decriminalized, in reality,\u200d the German\u200c Parliament voted to reduce the\u200b minimum\u2063 sentences for possession, not to decriminalize it. According to a May 21 article from Reduxx, German Parliament recently voted to reduce the minimum sentences for possession of child pornography, not decriminalize possession of the material.<\/p>\n<p><span><strong>Fact Check:<\/strong><\/span><\/p>\n<p>Back in April, German Parliament approved a \u201cself-determination\u201d law, which makes it easier for transgender, intersex, and nonbinary people to \u201cchange their name and gender in official records,\u201d according to <a href=\"https:\/\/apnews.com\/article\/germany-name-gender-changes-transgender-parliament-9eb64bbe96b286b71bbc8c4343dae4d0\" target=\"_blank\" rel=\"noopener noreferrer\">The Associated Press<\/a>. The law is set to go into effect on November 1, the outlet reported.<\/p>\n<p>The Facebook image claims German Parliament has purportedly decriminalized possession of child pornography. \u201c\u2018Pro-Pedophile\u2019 Activist Group Celebrates As Germany Decriminalizes Child Pornography,\u201d the headline reads. The claim <a href=\"https:\/\/x.com\/BGatesIsaPyscho\/status\/1792950976413938173\" target=\"_blank\" rel=\"noopener noreferrer\">also circulated on X<\/a>, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/facebook-blocks-republican-senate-candidate-jim-lamons-super-bowl-ad\/\" title=\"Facebook Blocks Republican Senate Candidate Jim Lamon\u2019s Super Bowl Ad\">social media platform previously<\/a> known as Twitter, where it was viewed over 200,000 times.<\/p>\n<p>The claim is misleading, however. The headline appears to originally stem from a May 21 article published by <a href=\"https:\/\/reduxx.info\/pro-pedophile-activist-group-celebrates-as-germany-decriminalizes-child-porn-possession\/\" target=\"_blank\" rel=\"noopener noreferrer\">Reduxx<\/a>. According to the article, the German Parliament recently voted to remove a section of the Criminal Code in relation to \u201cpossession of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/over-700-survivors-advocates-call-on-congress-for-criminal-investigation-into-pornhubs-parent-company\/\" title=\"Over 700 Survivors, Advocates Call On Congress For Criminal Investigation Into Pornhub\u2019s Parent Company\">child sexual abuse materials<\/a>.\u201d The move aims to reduce the minimum sentences for possession of child pornography, which will then be \u201cdowngraded to a misdemeanor,\u201d the same article indicates.<\/p>\n<p>The <a href=\"https:\/\/www.bundestag.de\/presse\/hib\/kurzmeldungen-1002810\" target=\"_blank\" rel=\"noopener noreferrer\">German Parliament\u2019s website<\/a> states that in the future \u201cpossession and acquisition\u201d of child pornography will be \u201cpunishable by a minimum sentence of three months\u2019 imprisonment, and distribution by a minimum sentence of six months\u2019 imprisonment.\u201d The website notes \u201ctightening of the penalty range in 2021\u201d as the German Parliament\u2019s reason for reducing the minimum sentences. <strong><a href=\"https:\/\/checkyourfact.com\/2024\/06\/19\/fact-check-palestine-qualify-world-cup\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Did Palestine Qualify For The World Cup?)<\/a><\/strong><\/p>\n<p>Likewise, Check Your Fact found <a href=\"https:\/\/www.google.com\/search?sca_esv=b176e63ef7d8ad5d&#038;sca_upv=1&#038;q=%22Pro-Pedophile+Activist+Group+Celebrates+As+Germany+Decriminalizes+Child+Porn+Possession&#038;tbm=nws&#038;source=lnms&#038;fbs=AEQNm0DtEUClC-p8k4z1NT3KIGWbbGMTHarV0LXU98jlmvH7eUzzLzq7ZJGqgQ4Rzg1fJoZJP42rx-gNey_uHkCcK9kx6_NurpyWFk4eLqjD4yA7hkjMb5fq2tJztMsntn-XTQ7o74oZFMYuJBILzOiX_TTuziYT9UOODl6m609DFniqoHENRbMNHqqNY0T51y6ZRbcqioeuW3c0n7cU1ZeYhtA6p9UGIA&#038;sa=X&#038;ved=2ahUKEwjvlsuDr-iGAxXyv4kEHVx6DH4Q0pQJegQIDRAB&#038;biw=1680&#038;bih=871&#038;dpr=2\" target=\"_blank\" rel=\"noopener noreferrer\">no credible news reports<\/a> to support the claim made via the Facebook image. In fact, the opposite is true. On June 19, <a href=\"https:\/\/www.reuters.com\/fact-check\/german-lawmakers-have-not-voted-decriminalise-possessing-child-pornography-2024-06-19\/\" target=\"_blank\" rel=\"noopener noreferrer\">Reuters<\/a> reported the claim was misleading. The outlet cited a February 2024 article from <a href=\"https:\/\/www.independent.co.uk\/news\/germany-ap-berlin-cabinet-b2492115.html\" target=\"_blank\" rel=\"noopener noreferrer\">The Independent<\/a>, which referenced a rule that became effective in July 2021, which made dissemination of child pornography punishable by between one and ten years in prison. The rule caused \u201cunintended problems,\u201d according to the outlet, and did not account for instances where people might receive pornographic material \u201cinvoluntarily,\u201d such as in a WhatsApp group.<\/p>\n<p>Furthermore, the German Parliament has not publicly commented on the claim via its <a href=\"https:\/\/x.com\/search?lang=en&#038;q=%22%22Pro-Pedophile%20Activist%20Group%20Celebrates%20As%20Germany%20Decriminalizes%20Child%20Porn%20Possession%22%20(from%3Ahib_Nachrichten)%20lang%3Aen&#038;src=typed_query\" target=\"_blank\" rel=\"noopener noreferrer\">associated social<\/a> <a href=\"https:\/\/www.instagram.com\/bundestag\/\" target=\"_blank\" rel=\"noopener noreferrer\">media accounts<\/a>.<\/p>\n<p>Check Your Fact has contacted the German Parliament for comment and will update this piece accordingly if one is received.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Facebook post claims the German Parliament decriminalized child pornography possession.
