She also cites his perceived failure to force Justices Samuel Alito and Clarence Thomas to recuse themselves from Donald Trump\u2019s immunity case due to their spouses\u2019 privately held beliefs.<\/p>\n<p>Greenhouse never explicitly defined \u201cspontaneity,\u201d but she suggested it would include a shift from merely deciding cases to embracing judicial activism.<\/p>\n<p>\u201cDeciding cases is indeed the court\u2019s job,\u201d Greenhouse wrote. \u201cBut deciding cases may not be enough these days, when the Supreme Court has plummeted in public esteem to near-historic lows \u2026 and every week seems to bring a new challenge to its image of probity and detachment.\u201d<\/p>\n<p>Greenhouse elaborated on the progressive judicial philosophy she argues Roberts should embrace in a <a href=\"https:\/\/www.historynewsnetwork.org\/article\/the-supreme-court-we-need\" target=\"_blank\" rel=\"noreferrer noopener\">separate article<\/a> for the History News Network.<\/p>\n<div class=\"fdrlst__b89e9-f1aa7a0e31c99eecad7b6e6a7581537f fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-f1aa7a0e31c99eecad7b6e6a7581537f\"><\/div>\n<p>\u201cWe need a Supreme Court that envisions the Constitution as Ruth Bader Ginsburg envisioned it, as an engine of social progress instead of as a roadblock to structural reform,\u201d Greenhouse wrote. She goes on to call the court\u2019s recent protections of religious freedom \u201coff-ramps from civil society for those with religious objections to following the nondiscrimination principles intended to bind us all.\u201d<\/p>\n<p>This push for leftist activism stands in contrast to her condemnation of the court\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/alito-becomes-latest-target-in-anti-trump-lawfare-campaign-undermining-the-judiciary\/\" title=\"Alito Targeted in Anti-Trump Campaign Against Judiciary\">reliably conservative justices<\/a>, whom she calls \u201cfive activist justices to [Roberts\u2019] right.\u201d Greenhouse questioned why Roberts doesn\u2019t exert more power over Justices Samuel Alito and Clarence Thomas in particular, though the justices are not subordinates to Roberts.<\/p>\n<p>\u201cI\u2019ve been asked quite often why Chief Justice Roberts doesn\u2019t just instruct Justices Alito and Clarence Thomas \u2026 to recuse themselves from the cases on Donald Trump\u2019s prosecution arising from the 2020 election and the 2021 attack on the Capitol,\u201d Greenhouse wrote.<\/p>\n<p>Greenhouse does not point to any behavior of the justices that warrants their recusal. She instead\u00a0cites\u00a0recent <a href=\"https:\/\/thefederalist.com\/2024\/06\/12\/washington-post-writers-admit-theres-nothing-to-alito-flag-story-but-partisan-journalism\/\" target=\"_blank\" rel=\"noreferrer noopener\">smear campaigns<\/a> against the justices\u2019 wives, including Martha-Ann Alito\u2019s display of an \u201cAppeal to Heaven\u201d flag previously flown at George <a href=\"https:\/\/repcmiller.com\/2019\/04\/04\/george-washington-appeal-to-heaven-flag-helps-focus-attention-on-national-day-of-prayer-on-may-2nd\/\" target=\"_blank\" rel=\"noreferrer noopener\">Washington\u2019s command<\/a>. But the Supreme Court\u2019s <a href=\"https:\/\/www.supremecourt.gov\/about\/Code-of-Conduct-for-Justices_November_13_2023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">code of conduct<\/a> does not require political neutrality from spouses. <\/p>\n<div class=\"fdrlst__b89e9-bc5e1d237137be53af4fe8aea4e630a0 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-bc5e1d237137be53af4fe8aea4e630a0\"><\/div>\n<p>Greenhouse maintains that Roberts\u2019 failure to \u201cjawbone them\u201d into recusal demonstrates a failure in leadership, comparing him to Chief Justice William Rehnquist.<\/p>\n<p>\u201cWe\u2019ll never know, obviously, but I think [Rehnquist] would have drawn on his deep well of capital inside the court and found a way to let Justices Alito and Thomas know that recusal from the Trump immunity case would be highly advisable even if not required,\u201d Greenhouse wrote. \u201cIf there is a blueprint for addressing the issues now swirling around the court, it has eluded a chief justice who might not have acquired the institutional capital to call on in a time of need.\u201d<\/p>\n<p>Roberts\u2019 inability to force Alito\u2019s and Thomas\u2019 recusal is not a matter of lacking \u201cinstitutional capital\u201d but rather of the <a href=\"https:\/\/www.everycrsreport.com\/reports\/RL32821.html\" target=\"_blank\" rel=\"noreferrer noopener\">parameters of his role<\/a>. Roberts may hold a unique position in terms of administration and presiding over court sessions, but he is not the boss of the other justices. <a href=\"https:\/\/www.acslaw.org\/expertforum\/supreme-court-recusal\/\" target=\"_blank\" rel=\"noreferrer noopener\">Individual justices decide<\/a> their own recusals. <\/p>\n<p>Greenhouse argued for an overreach not only of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democratic-senator-says-rand-paul-may-be-right-about-unconstitutional-impeachment-trial\/\" title=\"Democratic Senator Says Rand Paul May Be Right About \u2018Unconstitutional\u2019 Impeachment Trial\">chief justice\u2019<\/a>s authority but also of the Supreme Court\u2019s. Her assertion that merely \u201cdeciding cases may not be enough these days\u201d contradicts the role of the judicial branch of government.
