Two Vermont residents,\u2063 supported by the legal group Restoring Integrity\u200d and Trust in Elections (RITE), filed the lawsuit against the City of Burlington. They argue the charter change that permits noncitizen voting alters voter qualifications outlined in the Vermont Constitution, thereby diluting the\u200d votes of current registered Burlington \u200cvoters.<\/p>\n<p>In March 2023, Burlington adopted a charter amendment letting legal aliens vote in all local elections, provided they meet certain conditions like age, residency, and\u200c voter registration deadlines. This amendment was \u2064initially vetoed by Governor Phil Scott but was eventually implemented after the General Assembly overrode his veto in June 2023.<\/p>\n<p>The plaintiffs also highlight a discrepancy in the required oath for voting, where foreign nationals pledge allegiance to Burlington\u2019s interests rather than Vermont\u2019s statewide \u200dinterests as mandated by the state constitution. They emphasize that local school budget votes have broader implications on state finances, deeming it unconstitutional to let noncitizens vote on such matters. The residents are supported by <a href=\"https:\/\/thefederalist.com\/tag\/restoring-integrity-and-trust-in-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">Restoring Integrity and Trust in Elections (RITE)<\/a>, an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-ohio-supreme-courts-ballot-amendment-ruling-is-not-the-win-democrats-think-it-is\/\" title=\"Ohio Supreme Court's ballot amendment ruling disappoints Democrats.\">election integrity legal group<\/a>.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1391884579\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-88f55f5a2a4ae6b39721cb09176d13f7 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-88f55f5a2a4ae6b39721cb09176d13f7\"><\/div>\n<p>\u201cThe charter change permitting noncitizen voting has changed the qualifications for voters as defined in [the Vermont Constitution] and the individual Plaintiffs are voters \u2018within the voter pool for which those qualifications have been changed,&#8217;\u201d the lawsuit reads. \u201cBoth individual Plaintiffs are registered voters who have voted and intend to continue voting in Burlington elections. Those votes will be diluted by noncitizen votes made possible by Burlington\u2019s charter change.\u201d<\/p>\n<p>The City of Burlington adopted a charter amendment in March 2023 authorizing aliens who have legal status in the United States \u201cto register and vote in <em>all<\/em> local elections.\u201d In addition to this requirement, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-orders-biden-to-reimplement-key-trump-border-policy-as-bidens-border-catastrophe-worsens\/\" title=\"Judge Orders Biden To Reimplement Key Trump Border Policy As Biden\u2019s Border Catastrophe Worsens\">foreign nationals seeking<\/a> to vote under the amendment must be at least 18 years old, have taken the Voter\u2019s Oath, be a Burlington resident as specified by state law, and be \u201cregistered to vote with the Board of Registration of Voters not later than the deadline established by Vermont law for that election or meeting.\u201d<\/p>\n<p>The amendment was approved by Vermont\u2019s Democrat-controlled General Assembly in May 2023, but was vetoed by liberal Republican Gov. Phil Scott that same month. The General Assembly subsequently overrode Scott\u2019s veto on June 20, 2023, allowing the amendment to take effect.<\/p>\n<p>Plaintiffs note how the city oath foreign nationals must recite before voting in Burlington School District elections \u2014 \u201cwhich includes votes on the annual education budget as well as for members of a Board of School Commissioners\u201d \u2014 conflicts with the Vermont Constitution\u2019s Voter Oath. Rather than require noncitizen electors to pledge to vote in the state\u2019s best interests, as specified by Vermont\u2019s founding document, Burlington\u2019s oath requires them to pledge to vote in the city\u2019s best interests.<\/p>\n<div class=\"fdrlst__b89e9-98c65f60157f2b4b0c02e0a99a1faafd fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-98c65f60157f2b4b0c02e0a99a1faafd\"><\/div>\n<p>Plaintiffs argue this is problematic because \u201c[s]chool budgets and school funding in Vermont are statewide, freeman issues,\u201d meaning \u201cvotes regarding local school budgets directly impact the State budget and thus the financial interests of Vermonters statewide.\u201d<\/p>\n<p>\u201cOnce a school budget is approved by local voters, paying for it becomes the responsibility of the State through the State Education Fund,\u201d the lawsuit reads. \u201cDefendant has now expanded the electorate that determines educational issues to include noncitizens, even though those votes have substantial extra-municipal and statewide implications and thus directly implicate [the Vermont Constitution\u2019s] limitation of the franchise to United States citizens.\u201d<\/p>\n<p>The lawsuit details litigation filed against other Vermont localities for approving noncitizen voting measures in years prior. Montpelier and Winooski\u2019s adoption of charter amendments authorizing alien voting in their local elections in 2021 prompted the Republican National Committee to bring suits against the cities, which <a href=\"https:\/\/www.seattletimes.com\/nation-world\/nation\/burlington-approves-noncitizen-voting\/\" target=\"_blank\" rel=\"noreferrer noopener\">alleged<\/a> that the measures violated the Vermont Constitution. <\/p>\n<p>The Vermont Supreme Court ultimately struck down the RNC lawsuit against Montpelier in January 2023, ruling the state constitution does not \u201ccategorically\u201d bar foreign nationals from voting in local elections. A lower court similarly dismissed the GOP\u2019s challenge to Winooski\u2019s charter amendment. <\/p>\n<div class=\"fdrlst__b89e9-357ee1d90af67dc06b054de582ce164c fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-357ee1d90af67dc06b054de582ce164c\"><\/div>\n<p>According to plaintiffs, however, \u201cwhile the Supreme Court rejected the argument that all municipal elections are now subject to Section 42 [of the Vermont Constitution], it held that specific municipal votes would require United States citizenship if those votes were of statewide concern.\u201d <\/p>\n<p>In other words, plaintiffs are claiming the state Supreme Court left the door open for challenges to be brought against charter amendments permitting alien voting if such voting impacts statewide residents. <\/p>\n<p>\u201cThe non-citizen voting movement achieves the left\u2019s goal of legalizing foreign interference in American elections,\u201d RITE President Derek Lyons <a href=\"https:\/\/riteusa.org\/rite-sues-to-stop-noncitizen-voting-in-vermonts-largest-city\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in a statement. \u201cIt threatens the rule of law and must be stopped before it further infects Vermont and other states in this country.\u201d<\/p>\n<p>Plaintiffs are asking the court to declare Burlington\u2019s charter amendment as it relates to school board elections and education funding unconstitutional.
