This case is directly presented to the state&#8217;s highest court, which currently holds a \u2062liberal majority of\u2062 4-3, overlooking the lower courts. \u200bThe challenge was initiated by the\u200b Wisconsin Manufacturers and Commerce\u2019s Litigation Center, which argues that Governor Evers exceeded his authority with his specific application of the partial veto.<\/p>\n<p>The controversy specifically stems from Governor Eers&#8217;s action where he vetoed parts of the text \u2063in the budget law concerning\u200c school funding. \u2062By striking \u200bthrough a \u200dhyphen and the digits \u201c20\u201d in the reference to the school year 2024-25, he effectively altered the\u2064 duration for the allocation of an additional\u2064 $325 per student per year from just two years to\u2063 extending through\u200c the year 2425\u2014a total of 402 \u2064years. Tony Evers\u2019s<\/a> (D-WI) use of his veto powers, which enabled him to secure funding for K-12 public schools for the next 400 years. <\/p>\n<p>The state\u2019s high court will <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gov-tony-everss-veto-to-extend-school-funding-for-400-years-in-wisconsin-faces-challenge-from-business-lobby\/\" title=\"Business lobby challenges Gov. In April, a Wisconsin business lobbying firm, the Wisconsin Manufacturers and Commerce\u2019s Litigation Center, <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/education\/2966667\/gov-tony-everss-veto-extend-school-funding-400-years-wisconsin-faces-challenge-business-lobby\/\" target=\"_blank\" rel=\"noopener\" title>filed a lawsuit <\/a>to strike down Evers\u2019s use of the partial veto, arguing that he exceeded authority in doing so.<\/p>\n<p>The lawsuit alleged that <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/wisconsin\/\" target=\"_blank\" rel=\"noopener\" title>Wisconsin<\/a> law \u201cforbids the governor from striking individual digits in an enrolled bill to create a new year.\u201d <\/p>\n<p>Last year, Evers used his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wisconsin-republicans-look-to-limit-democratic-governors-veto-power\/\" title=\"Wisconsin GOP seeks to curb Dem governor's veto power\">partial veto powers<\/a> to strike through a hyphen and \u201c20\u201d from a reference to the 2024-25 school year in the state\u2019s budget. Tommy Thompson <a href=\"https:\/\/apnews.com\/article\/evers-veto-400-years-wisconsin-school-funding-67a7847e4a24ea86f7d16123356f770d\" target=\"_blank\" rel=\"noopener\" title>said<\/a> of the Evers veto. \u201cWell, he did it.\u201d<\/p>\n<p>Wisconsin governors from both sides of the aisle have long taken advantage of the partial veto. Former Republican Gov. Scott Walker used his partial veto powers to allow one state program to last indefinitely in a move known as the \u201cthousand-year veto.\u201d<\/p>\n<p>The lawsuit against Evers asked the state\u2019s high court to <a href=\"https:\/\/madison.com\/news\/state-regional\/government-politics\/wisconsin-supreme-court-400-year-partial-veto-gov-tony-evers-lawsuit\/article_d83d273c-2cf0-11ef-a547-233024b71d4e.html\" target=\"_blank\" rel=\"noopener\" title>take up the issue<\/a> instead of having it move through the lower courts, which the Supreme Court agreed to.<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>\u201cIn no uncertain terms, 402 years is not less than or part of the two-year duration approved by the Legislature \u2014 it is far more,\u201d WMC Litigation Center Executive Director Scott Rosenow <a href=\"https:\/\/www.wispolitics.com\/2024\/wmc-taxpayers-challenge-undemocratic-and-unconstitutional-400-year-veto\/\" target=\"_blank\" rel=\"noopener\" title>said<\/a>. \u201cThe governor overstepped his authority with this partial veto, at the expense of taxpayers, and we believe oversight by the Court is necessary.\u201d<\/p>\n<p>The group believes Evers\u2019s use of the veto violates a constitutional amendment Wisconsin voters passed in 1990.
