The court&#8217;s decision, set to prevent the rule&#8217;s implementation on August\u2063 1, 2024, cited excessive overreach by the Department of Education\u200b (DOE) and potential irreparable harm to the plaintiffs.<\/p>\n<p>Additionally, the Alliance Defending\u200b Freedom (ADF),\u2063 a legal nonprofit, supported the litigation leading \u200cto this preliminary\u200c injunction. \u200cADF highlighted a case involving \u2063their client, Adaleia Cross, who reportedly \u200cexperienced harassment in a school setting related \u200bto\u2064 the\u2062 issues at stake. Reeves\u2019 <a href=\"https:\/\/www.ag.ky.gov\/Press%20Release%20Attachments\/Mem%20Op%20and%20Order%20Granting%20PI%20-%206.17%20(002).pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> means that Kentucky, Indiana, Ohio, Tennessee, Virginia, and West Virginia joined the ranks of five other states where the measure has also been blocked.<\/p>\n<p>\u201cThis case concerns an attempt by the executive branch to dramatically alter the purpose and meaning of Title IX through rulemaking,\u201d the <a href=\"https:\/\/www.ag.ky.gov\/Press%20Release%20Attachments\/Mem%20Op%20and%20Order%20Granting%20PI%20-%206.17%20(002).pdf\" target=\"_blank\" rel=\"noreferrer noopener\">decision<\/a> reads. \u201cIf the new rule is allowed to take effect on August 1, 2024, all plaintiffs will suffer immediate and irreparable harm.\u201d <\/p>\n<p>Judge Reeves determined that the Biden Department of Education (DOE) <a href=\"https:\/\/www.theepochtimes.com\/us\/federal-title-ix-transgender-rule-blocked-in-6-more-states-5670096?src_src=RTNews&#038;src_cmp=rtbreaking-2024-06-17-4&#038;est=AAAAAAAAAAAAAAAAa%2B0yVQcEzMfN6LYcv2lQGKA0yEwDRjxnDT8PiSutFoYjw6SRhA%3D%3D\" target=\"_blank\" rel=\"noreferrer noopener\">far exceeded<\/a> the limits of its statutory authority in the rewrite, which expanded the law\u2019s discrimination protections to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-biden-title-ix-order-will-help-schools-push-transgenderism-on-your-kids-behind-your-back\/\" title=\"New Biden Title IX Order Will Help Schools Push Transgenderism On Your Kids Behind Your Back\">include \u201cgender identity<\/a>.\u201d The determination instigated a preliminary injunction, which halts the changes from occurring in the states included in the lawsuit.<\/p>\n<p>The Alliance Defending Freedom (ADF), a non-profit legal organization involved in the litigation of Biden Title IX cases, has aided in securing the second injunction against the rewrite.<\/p>\n<p>\u201cOur client, Adaleia Cross, has already suffered harassment by a male student in the locker room and on her sports team,\u201d ADF <a href=\"https:\/\/x.com\/ADFLegal\/status\/1802706348339044813\" target=\"_blank\" rel=\"noreferrer noopener\">posted<\/a> on X. \u201cNo one else should have to go through that. The court\u2019s decision upholds safety and privacy for students like Adaleia as the litigation continues.\u201d<\/p>\n<p>\u201cThe fight to protect our girls from Biden\u2019s radical Title IX rewrite is just getting started,\u201d <a href=\"https:\/\/x.com\/RepBurgessOwens\/status\/1803102498460254474\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> Rep. Burgess Owens, R-Utah, in reaction to the ruling.<\/p>\n<p>\u201cBeginning in the mother\u2019s womb, women are at a competitive physical disadvantage to men,\u201d <a href=\"https:\/\/x.com\/SenJohnKennedy\/status\/1802757655678607544\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> Sen. John Kennedy, R-La. \u201cThat\u2019s why we have had women\u2019s sports and men\u2019s sports. And that\u2019s why Congress passed Title IX to try to provide equality for both.\u201d<\/p>\n<p>The ruling comes after a U.S. district court in Texas also struck down the change, with District Judge Reed O\u2019Connor <a href=\"https:\/\/thefederalist.com\/2024\/06\/12\/biden-administrations-dangerous-title-ix-rewrite-struck-down-by-texas-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">finding<\/a> that the administration tried to \u201cfunctionally rewrite Title IX in a way that shockingly transforms American education and usurps a major question from Congress.\u201d<\/p>\n<p>The official announcement of the change came in mid-April when the DOE <a href=\"https:\/\/www2.ed.gov\/about\/offices\/list\/ocr\/docs\/t9-final-rule-factsheet.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> that it was expanding the original Title IX language.
