U.S. District\u200b Judge Stephen \u200bLocher, appointed by President \u2063Joe Biden, asserted that Iowa\u2019s \u201cillegal \u2062reentry\u201d law,\u2064 passed as Senate File\u200d 2340, violates \u2064the Supremacy Clause of the Constitution by interfering with the federal government&#8217;s exclusive authority\u2062 to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/newsom-recall-petition-close-to-success\/\" title=\"Newsom Recall Petition Close To Success\">enforce immigration laws<\/a>.\u2063 The Department of Justice had previously challenged the law, emphasizing its disregard for constitutional \u200dprecedents. The law, which was supposed to take effect on\u2062 July 1, would have subjected illegal immigrants \u200bpreviously removed or denied entry into the U.S. to possible imprisonment. Judge Locher cited \u2062a 2012 Supreme Court decision against a \u2063similar Arizona law\u200d to support his\u2062 ruling, reinforcing that\u2064 state-level\u200c immigration policies are preempted by federal law.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>An Iowa bill that was signed into law by Republican Governor Kim Reynolds in April allowing state authorities to arrest and deport some illegal immigrants was blocked by a federal judge, who ruled on Monday that the policy is unconstitutional.<\/p>\n<p>U.S. District Judge Stephen Locher, who was appointed by President Joe Biden, wrote that Iowa\u2019s \u201cillegal reentry\u201d law violates the Supremacy Clause of the Constitution and interferes with the federal government\u2019s authority to enforce immigration laws, the Des Moines Register <a href=\"https:\/\/www.desmoinesregister.com\/story\/news\/crime-and-courts\/2024\/06\/17\/iowa-immigration-law-enforcement-blocked-by-federal-court\/74130393007\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>. The Department of Justice <a href=\"https:\/\/www.dailywire.com\/news\/biden-admin-sues-iowa-over-immigration-law-allowing-state-to-arrest-and-deport-illegal-immigrants\" target=\"_blank\" rel=\"noopener\">sued<\/a> Iowa over the law last month, arguing that the state was \u201cdisregard[ing] the U.S. Constitution and settled Supreme Court precedent.\u201d<\/p>\n<p>The law, which was passed as Senate File 2340, allows state authorities to arrest and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/illegal-immigrants-guilty-of-dui-assault-will-not-be-deported-under-biden-plan\/\" title=\"Illegal Immigrants Guilty of DUI, Assault Will Not Be Deported Under Biden Plan\">deport illegal immigrants<\/a> who had previously been removed from the U.S. or denied entry into the country. It was set to take effect on July 1.<\/p>\n<p>\u201cAs a matter of politics, the new legislation might be defensible. As a matter of constitutional law, it is not,\u201d Locher wrote. \u201cUnder binding Supreme Court precedent, Senate File 2340 is preempted in its entirety by federal law and thus is invalid under the Supremacy Clause.\u201d<\/p>\n<p>Locher pointed to a 2012 Supreme Court ruling on an Arizona law that allowed state authorities to stop and detain people suspected of illegally crossing the border. The Supreme Court <a href=\"https:\/\/www.oyez.org\/cases\/2011\/11-182\" target=\"_blank\" rel=\"noopener\">ruled<\/a> 5-3 \u2014 with Justices Anthony Kennedy and John Roberts joining three liberal justices \u2014 that the Arizona immigration law interfered with federal government enforcement of laws already on the books. Justice Antonin Scalia argued that the Arizona law did not conflict with federal law and even worked to better <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-tells-missouri-they-cant-disregard-federal-gun-laws\/\" title=\"DOJ Tells Missouri They Can\u2019t Disregard Federal Gun Laws\">enforce federal law<\/a>.<\/p>\n<p>Under Iowa\u2019s law, illegal immigrants could face up to 10 years in prison for illegally reentering the U.S. if they were arrested for committing a separate felony. A judge would also be required to submit an order for deportation of an illegal immigrant convicted of unlawfully entering the U.S. Reynolds <a href=\"https:\/\/www.desmoinesregister.com\/story\/news\/politics\/2024\/04\/10\/reynolds-signs-law-letting-iowa-police-arrest-undocumented-immigrants-texas-illegal-reentry\/73279222007\/\">said<\/a> in April that the state law was necessary because President Joe Biden \u201chas failed to enforce our nation\u2019s immigration laws, putting the protection and safety of Iowans at risk.\u201d<\/p>\n<p>Reynolds and Iowa Republican Attorney General Brenna Bird have vowed to appeal Judge Locher\u2019s ruling, according to the Des Moines Register.<\/p>\n<p>\u201cI am disappointed in today\u2019s court decision that blocks Iowa from stopping illegal reentry and keeping our communities safe,\u201d Bird said. \u201cSince Biden refuses to secure our borders, he has left states with no choice but to do the job for him.\u201d<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1700760801843000&#038;usg=AOvVaw2PQrVSrJfhxNb4LcARqniG\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>The Iowa immigration law is similar to legislation passed in other GOP-controlled states such as Texas and Georgia. Texas\u2019 law authorizing state authorities to prosecute migrants for illegally crossing the southern border has also been <a href=\"https:\/\/www.texastribune.org\/2024\/03\/19\/texas-sb-4-illegal-immigration\/\" target=\"_blank\" rel=\"noopener\">blocked<\/a>.<\/p>\n<p>As Reynolds argued in Iowa, Texas Republican Governor Greg Abbott and Attorney General Ken Paxton said that the Biden administration is failing to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sure-a-few-kids-drown-some-get-raped-greg-gutfeld-flames-democrats-for-blowing-off-border-crisis\/\" title=\"\u2018Sure, A Few Kids Drown.
