However, evidence provided by \u2064Martins\u2019 defense, including domestic transactions and a\u2063 corrected U.S. immigration \u2062record, contradicts these claims,\u200c indicating he never left Brazil as \u200dalleged.<\/p>\n<p>Martins&#8217; lawyers argue that the imprisonment \u200cis politically motivated, a tactic by the STF, criticized for overreaching\u200d its powers, to suppress conservative growth. The case has stirred discussions about the fairness and political bias \u2064of the judiciary in Brazil, \u200despecially \u2064in targeting conservative figures.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><span style=\"font-weight: 400\">A prominent Brazilian conservative who was a senior aide to former president Jair Bolsonaro has been imprisoned without trial in the South American country for four months, justified by what appears to have been an error on a U.S. government website.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Lawyers for Filipe Martins, who considers himself a political prisoner of the left-wing Brazilian Supreme Court (STF), say the court is using the error on the U.S. Customs and Border Patrol (CBP) website as proof to imprison him. Martins was arrested on February 8 at the order of STF Minister Alexandre de Moraes, who is using records showing travel to the United States \u2014 and the lack of corresponding Brazilian immigration records \u2014 as evidence that Martins defrauded the immigration system by leaving the country undetected.<\/span><\/p>\n<p><span style=\"font-weight: 400\">According to the incorrect CBP travel history records used to keep Martins imprisoned obtained by The Daily Wire, there was a log of Filipe entering the United States with inconsistencies. But representatives of Martins, who served as the special adviser for international affairs to <\/span><a href=\"https:\/\/www.dailywire.com\/news\/7-things-you-need-know-about-trump-brazil-who-kassy-dillon\"><span style=\"font-weight: 400\">Bolsonaro<\/span><\/a><span style=\"font-weight: 400\">, say he never left his country on the day being alleged. There is evidence showing he made Uber and food purchases in Brazil, and also that he took a domestic flight. <\/span><\/p>\n<p>The prolonged imprisonment comes as the STF faces widespread criticism for overstepping its authority to punish opponents. <span style=\"font-weight: 400\">He has not yet been given a trial and remains imprisoned on the grounds that there is a risk he would flee the country, despite the correction. His lawyers say the government is holding him for political reasons.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cIt has been widely known that de Moraes has been fearing the growth of conservatives,\u201d<\/span> <span style=\"font-weight: 400\"> Martins\u2019 attorney, Ana Barbara Schaffert, told The Daily Wire. \u201cThis extended, unfounded imprisonment indicates that they are trying to torture him into confessing to anything that fits their narrative, because there is nothing legally that can detain him in jail.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">A correction was made to the CBP I-94 website last week after Martins\u2019 defense team submitted additional documentation to officials to prove Martins did not travel to the United States on December 30, 2022, on a presidential flight with Bolsonaro before the inauguration of the next president, as is alleged. New I-94 records show that Martins\u2019 last entry to the U.S. was in September 2022, when he accompanied Bolsonaro to the U.N. General Assembly in New York.<\/span><\/p>\n<div id=\"attachment_751681\" style=\"width: 690px\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-751681\" class=\"wp-caption-text\">An incorrect travel history was used by the Brazilian Supreme Court to show that Filipe Martins traveled to the U.S. on December 30, 2022. Martins\u2019 lawyers and an updated document from CBP dispute he ever left the country on that date.<\/p>\n<\/div>\n<p><span style=\"font-weight: 400\">In a determination letter to Martins\u2019 lawyers, the U.S. Department of Homeland Security stated it conducted a review of the situation and \u201cmade any corrections to records that our inquiries determined were necessary.\u201d<\/span><\/p>\n<p>The lawyers say the update should lead to Filipe\u2019s release.<\/p>\n<p><span style=\"font-weight: 400\">\u201cWe finally have an official document that can be used as a legal basis that Martins never entered the United States on December 30, 2022,\u201d Schaffert said. \u201cWe hope de Moraes takes this into account and releases Filipe immediately.\u201d<\/span><\/p>\n<div id=\"attachment_751679\" style=\"width: 894px\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-751679\" class=\"wp-caption-text\">An updated document from the CBP shows Filipe Martins\u2019 last entry to the U.S. was in September 2022, despite accusations from the STF.<\/p>\n<\/div>\n<p><span style=\"font-weight: 400\">Martins\u2019 legal defense filed a petition for his release and is awaiting an official response.<\/span><\/p>\n<p><span style=\"font-weight: 400\">De Moraes also used as evidence an outdated Microsoft Word file with a list of passengers for the December 30 presidential flight that had been updated numerous times, as well as a blog post speculating he \u201cevaporated\u201d from Brazil, according to Schaffert. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cIt was merely a draft of a supposed list, which would never be used as evidence for an arrest in any normal process,\u201d Schaffert said.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Martins was a popular powerhouse in the Bolsonaro administration due to his youth, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/state-legislatures-push-to-fight-big-tech-but-experts-warn-of-limitations\/\" title=\"State Legislatures Push to Fight Big Tech, but Experts Warn of Limitations\">large social media<\/a> following, and conservative and pro-American ideology. He was nicknamed the \u201cJared Kushner\u201d of the Bolsonaro administration while in his previous diplomatic position, which led to a <\/span><span style=\"font-weight: 400\"><a href=\"https:\/\/x.com\/filgmartin\/status\/1167851207563628545\">meeting wit<\/a><\/span><a href=\"https:\/\/x.com\/filgmartin\/status\/1167851207563628545\"><span style=\"font-weight: 400\">h<\/span><\/a><span style=\"font-weight: 400\">  former President Donald Trump in the Oval Office.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Martins is also being investigated by the STF for allegedly contributing to a document questioning the 2022 Brazilian presidential election that led to the return of socialist Luiz In\u00e1cio Lula da Silva to power after serving a jail term for corruption.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This investigation was not cited as the official reason for Martins\u2019 jailing, according to his lawyers.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Bolsonaro, who was president from January 2019 to December 2022, has been under investigation by the STF for making accusations of voting fraud, and his involvement in orchestrating riots on government buildings in January 2022. He is <\/span><a href=\"https:\/\/www.dailywire.com\/news\/brazil-bans-bolsonaro-from-holding-office-over-election-claims-energizing-his-base\"><span style=\"font-weight: 400\">currently barred<\/span><\/a><span style=\"font-weight: 400\">  from holding or running for office in Brazil until 2030 for casting doubt on its electronic voting system in a meeting with diplomats at the presidential palace, the New York Times <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/06\/30\/world\/americas\/bolsonaro-brazil-banned-office.html\"><span style=\"font-weight: 400\">reported<\/span><\/a><span style=\"font-weight: 400\">. <\/span><\/p>\n<p><span style=\"font-weight: 400\">By using the power of his position, de Moraes has been on <\/span><a href=\"https:\/\/www.dailywire.com\/news\/musk-vows-to-expose-corruption-from-brazils-dictator-who-launched-probes-for-not-restricting-free-speech\"><span style=\"font-weight: 400\">a mission<\/span><\/a><span style=\"font-weight: 400\">  to crack down on conservatives and free speech in the country. <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/01\/22\/world\/americas\/brazil-alexandre-de-moraes.html\"><span style=\"font-weight: 400\">The New York Times accused<\/span><\/a><span style=\"font-weight: 400\">  de Moraes of using \u201ca broad interpretation of the court\u2019s powers\u201d to \u201cinvestigate and prosecute, as well as to silence on social media, anyone he deems a menace to Brazil\u2019s institutions.\u201d De Moraes also signaled to deputies that he fears conservatives will make gains in the Brazilian Congress in 2026, <\/span><a href=\"https:\/\/www.cnnbrasil.com.br\/politica\/moraes-sinaliza-preocupacao-com-bancada-conservadora-em-2026\/\"><span style=\"font-weight: 400\">reported CNN Brazil.<\/span><\/a><\/p>\n<div id=\"attachment_751053\" style=\"width: 889px\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-751053\" class=\"wp-caption-text\">Filipe Martins and his wife Anelise Hauagge. (Photo: Instagram)<\/p>\n<\/div>\n<p><span style=\"font-weight: 400\">De Moraes\u2019 crusade led to a feud with billionaire Elon Musk after demanding the censorship and suspension of users on X accused of \u201cfake news.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cHe demanded that X suspend accounts of people who raised corruption concerns while insisting that X pretend the suspension was for violating our terms of service!\u201d <\/span><a href=\"https:\/\/x.com\/elonmusk\/status\/1777517291736813695\"><span style=\"font-weight: 400\">Musk tweeted<\/span><\/a><span style=\"font-weight: 400\">  in April. \u201cWe obey the laws of countries even if we disagree with them, but this required violating the laws of Brazil.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">De Moraes opened a probe into Musk for \u201cdisobedience\u201d and waging a \u201cdisinformation campaign\u201d against the court.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThe flagrant conduct of obstruction of Brazilian justice, incitement of crime, the public threat of disobedience of court orders and future lack of cooperation from the platform are facts that disrespect the sovereignty of Brazil,\u201d de Moraes <a href=\"https:\/\/apnews.com\/article\/brazil-musk-x-supreme-court-investigation-a645757b95a66ee658832802908466ab\">said<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Judiciary Committee Chairman Jim Jordan <\/span><a href=\"https:\/\/www.dailywire.com\/news\/house-probes-fbis-reported-role-in-brazils-crackdown-on-critics\"><span style=\"font-weight: 400\">demanded answers<\/span><\/a><span style=\"font-weight: 400\">  last month after reports emerged suggesting the FBI assisted in cracking down on critics and journalists.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cIn Brazil, news outlets have recently reported that the FBI, on behalf of the Brazilian government, reached out to two U.S. residents, including a journalist targeted in some of the censorship orders by Brazilian courts,\u201d said Jordan\u2019s letter to FBI Director Christopher Wray.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The STF did not respond to a request for comment.<\/span><\/p>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A former senior aide to ex-president Jair Bolsonaro, prominent Brazilian conservative Filipe Martins has been jailed for four months without trial in Brazil.
