The piece\u2064 suggests that both the interpretation of these laws and their implementation are often excessively liberal, leading to stifling \u200bsituations where normal interactions are overly scrutinized.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><span style=\"font-weight: 400\">Thanks to the flood of so-called \u201cworker\u2019s rights\u201d legislation and case law over the past generation, there are three words that are now music to the ears of every useless employee in the country: \u201chostile work environment.\u201d A claim for a \u201chostile work environment\u201d isn\u2019t hard to put together, but it can result in millions of dollars in damages \u2014 often enough to destroy an entire company. And for that reason, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lizzo-dropped-from-super-bowl-halftime-show-consideration-amid-dancers-sexual-harassment-and-abuse-allegations-report\/\" title=\"Lizzo excluded from Super Bowl Halftime Show due to dancers' misconduct claims: Report.\">hostile work environment claims<\/a> have become the weapon of choice for both workers who are really bad at their jobs, as well as workers who actively want to sabotage their employers.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The underlying idea behind a \u201chostile work environment\u201d claim is that, instead of having to show any single concrete injury, plaintiffs can simply point to a series of minor incidents that occurred over time. Each of these incidents in isolation may mean absolutely nothing. It could be a harmless joke that causes no mental distress whatsoever. But in a hostile work environment claim, plaintiffs are allowed to add up all of these little incidents together, and then make the case that offensive conduct in general was so \u201cpervasive\u201d in their workplace that they couldn\u2019t be expected to perform their jobs.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The exploding popularity of these claims has become a major tool of Left-wing lawfare. And it\u2019s now having a noticeable effect on pretty much every major corporation in the country. It\u2019s slowing productivity and making everything more dull and uninteresting. Companies that actually try to innovate and excel are particularly vulnerable.<\/span><\/p>\n<p><span style=\"font-weight: 400\">You may have seen that eight former SpaceX employees are now suing Elon Musk in Los Angeles, alleging among other things, that he operates a \u201chostile work environment in violation of the Fair Employment and Housing Act.\u201d These are the same former SpaceX employees who, back in 2022, helped distribute an open letter that publicly called Elon Musk\u2019s behavior \u201cembarrassing.\u201d They were fired, unsurprisingly, because attacking your boss in public generally doesn\u2019t go over well.<\/span><\/p>\n<p><span style=\"font-weight: 400\">But the employees, predictably, are back with a lawsuit against Musk and SpaceX that every major mainstream outlet \u2014 from the Wall Street Journal to Axios \u2014 is hyping as a really serious piece of litigation. Here\u2019s CNN, for example, interviewing one of the eight plaintiffs:<\/span><\/p>\n<\/p>\n<p><span style=\"font-weight: 400\">So it turns out that, according to this plaintiff, Elon Musk evaluates employees based on their \u201cbra size.\u201d That\u2019s a serious claim. It sounds pretty outlandish, actually \u2014 so you\u2019d hope she has some proof to back it up.<\/span><\/p>\n<p><span style=\"font-weight: 400\">But instead of providing any real evidence for this claim, the employee points to a tweet that Musk sent out to his 180 million followers. Instead of just not reading the tweet or unfollowing Musk on Twitter, she apparently couldn\u2019t avoid seeing this horrible tweet. And conveniently, she says that she simply can\u2019t repeat the tweet on-air. It\u2019s just too shocking, apparently.<\/span><\/p>\n<p><span style=\"font-weight: 400\">If you read the complaint, though, you\u2019ll find the tweet she\u2019s talking about. Here\u2019s what Musk <\/span><a href=\"https:\/\/x.com\/elonmusk\/status\/1754067365707563045\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">wrote<\/span><\/a><span style=\"font-weight: 400\">: \u201cShould I make the Texas Institute of Technology &#038; Science real? It would of course have Advanced Social Studies too.\u201d<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Should I make the Texas Institute of Technology &#038; Science real?<\/p>\n<p>It would of course have Advanced Social Studies too.<\/p>\n<p>\u2014 Elon Musk (@elonmusk) <a href=\"https:\/\/twitter.com\/elonmusk\/status\/1754067365707563045?ref_src=twsrc%5Etfw\">February 4, 2024<\/a><\/p>\n<\/blockquote>\n<p><span style=\"font-weight: 400\">So this is what\u2019s known as a \u201cjoke.\u201d And millions of people who saw that tweet immediately understood that it was a joke. The acronyms for \u201cTexas Institute of Technology &#038; Science and \u201cAdvanced Social Studies\u201d would be \u201cT.*.*.*.\u201d and \u201cA.*.*.,\u201d respectively. That\u2019s the punchline. And in a follow-up tweet, the complaint says that Musk wrote, \u201cDs would get degrees\u201d at his fictional university.<\/span><\/p>\n<p><span style=\"font-weight: 400\">From those two tweets, we\u2019re supposed to conclude that Musk and SpaceX evaluate employees based on their \u201cbra size.\u201d It\u2019s a joke about \u201cDs getting degrees\u201d at a fictional university that he posted on Twitter. What we learn from the tweet is that Musk needs to hone his material a bit if he wants to pursue a career in stand-up comedy. But we don\u2019t learn that he runs a \u201chostile work environment,\u201d and it certainly shouldn\u2019t conclude that Musk conducts performance reviews that involve ranking employees by their bra size.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This is the kind of frivolous complaint that now confronts SpaceX, a $200 billion company that\u2019s objectively doing more to make humanity a spacefaring civilization than any other organization on the planet, including NASA. A woman and her colleagues didn\u2019t like a joke that Musk made on the internet about a fake university. And the corporate press is promoting this, aggressively, as a major scandal. Forget about how SpaceX landed a 400-foot-tall reusable rocket for the first time in human history. Never mind the fact that SpaceX could use that technology to land on Mars in the near future. Focus instead, they tell us, on this particular joke \u2014 a joke which, again, has nothing to do with Musk \u201cevaluating employees by their bra size,\u201d which was the original accusation.<\/span><\/p>\n<h4><strong><a href=\"https:\/\/www.dailywire.com\/episode\/ep-1388-the-matt-walsh-show\" target=\"_blank\" rel=\"noopener\">WATCH: The Matt Walsh Show<\/a><\/strong><\/h4>\n<p><span style=\"font-weight: 400\">I pulled up the full <\/span><a href=\"https:\/\/www.axios.com\/2024\/06\/12\/elon-musk-spacex-sexual-harassment-lawsuit\"><span style=\"font-weight: 400\">complaint<\/span><\/a><span style=\"font-weight: 400\">  to see if I was missing anything here. There\u2019s a whole section devoted to the grievous injuries that fired SpaceX employee, Rebekah Clark, allegedly suffered. Here\u2019s the part about \u201cevaluating\u201d women based on their \u201cbra size.\u201d<\/span><\/p>\n<blockquote>\n<p><i><span style=\"font-weight: 400\">Clark attended the Falcon meeting with Vice President Jon Edwards and HR representative Janet Fernandez. She observed that Mr. Edwards acted in an angry and aggressive manner in response to employees\u2019 concerns about the hostile work environment. \u2026Clark pushed Mr. Edwards to clarify whether Elon\u2019s \u2018T.*.*.*.\u2019 Tweet indicating that a woman is valued based upon the size of her breasts was the view of SpaceX. Edwards ultimately repeated words to the effect of, \u2018SpaceX is Elon and Elon is SpaceX.\u2019 \u2026 Simmons nodded his head in agreement with Edwards and repeated some of the things Edwards said, such as \u2018the mission [to Mars] is the most important thing,\u2019 and \u2018there is no time to focus on these issues at work.\u2019<\/span><\/i><\/p>\n<\/blockquote>\n<p><span style=\"font-weight: 400\">In other words, this woman was so offended by Elon\u2019s joke that she concluded that \u201ca woman is valued based on the size of her breasts\u201d at SpaceX. That\u2019s the leap she made, in her own words. And when the higher-ups told her to knock it off because they want to focus on important things like launching rockets to Mars, she of course became even more offended, and added that to the lawsuit as well.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The rest of this <\/span><a href=\"https:\/\/www.axios.com\/2024\/06\/12\/elon-musk-spacex-sexual-harassment-lawsuit\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">complaint<\/span><\/a><span style=\"font-weight: 400\">  from these former employees is full of allegations like this. Actually, it only gets worse. It reads like a parody of a lawsuit. It\u2019s almost as if they intended to catalog Musk\u2019s greatest hits on Twitter, and then some lawyer got a hold of the document and pretended to be outraged by it.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Here\u2019s one of the allegations that\u2019s supposed to convince us that this workplace is extremely hostile \u2014 so hostile that these women couldn\u2019t get any work done. The complaint states that Musk is guilty of:, \u201cMocking Bill Gates by creating a meme of him with a pregnant-looking belly, accompanied by the text, \u2018in case u need to lose a b***r fast.&#8217;\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">That\u2019s right. Elon Musk, on his public Twitter account, made fun of Bill Gates \u2014 a billionaire who does not work at SpaceX. It\u2019s a joke that millions of people thought was funny, based on their documented reactions on the internet. And this is supposedly evidence that Musk created a \u201chostile work environment\u201d at SpaceX (and, presumably, every other workplace on the planet where this tweet was ever viewed). In case you missed Musk\u2019s tweet, it\u2019s from April 2022. Here <\/span><a href=\"https:\/\/x.com\/elonmusk\/status\/1517707521343082496\"><span style=\"font-weight: 400\">it is<\/span><\/a><span style=\"font-weight: 400\">. <\/span><\/p>\n<div id=\"attachment_752005\" style=\"width: 501px\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-752005\" class=\"wp-caption-text\">Screenshot: X\/Twitter<\/p>\n<\/div>\n<p><span style=\"font-weight: 400\">So that\u2019s Bill Gates on the left. And on the right, it\u2019s an emoji that Apple rolled out to depict a \u201cpregnant man.\u201d I\u2019ll explain the joke here, just in case any former ex-SpaceX employees are reading, looking slack-jawed at your screens, wondering what could possibly be amusing about this meme.<\/span><\/p>\n<p><span style=\"font-weight: 400\">You see, back in 2022, both Bill Gates and the Apple emoji were being widely mocked. Bill Gates wanted to tell the whole world how to live their lives in order to be healthy, but he\u2019s substantially overweight. Meanwhile, Apple styles itself as a tech brand for intelligent, science-conscious consumers, but they\u2019re pushing the idea that men can get pregnant. Elon Musk posted a meme combining these two absurd situations in order, to maximize the humor. It\u2019s supposed to be funny. That\u2019s how jokes work on this planet we call Earth.<\/span><\/p>\n<p><span style=\"font-weight: 400\">It\u2019s a minor aside, but I\u2019ll also note that, contrary to what the complaint says, nowhere in his tweet did Musk suggest that he personally \u201ccreated\u201d that meme, as opposed to simply sharing it. Nor is it clear why they\u2019re saying in the complaint that Gates\u2019 belly is \u201cpregnant-looking.\u201d Isn\u2019t that offensive to pregnant-looking women employed by SpaceX? They\u2019re being compared to an overweight, unkempt photo of Bill Gates. What an outrage. Maybe someone should sue these employees. By complaining about Bill Gates and the pregnant man emoji, they\u2019re clearly creating a hostile work environment for birthing folks.<\/span><\/p>\n<p><span style=\"font-weight: 400\">But that lawsuit won\u2019t happen, and it\u2019s not a great mystery as to why it won\u2019t happen. Musk committed the sin of permitting freedom of speech on the internet, so he\u2019s the target. It seems that everyone from the DOJ to disgruntled SpaceX employees now wants to bring him down, by any means necessary.<\/span><\/p>\n<p><span style=\"font-weight: 400\">What\u2019s more interesting about this case, though, is that it highlights the increasing use of lawfare to enforce woke Left-wing gender ideology. Gender ideology is so unscientific and so arbitrary that it can\u2019t withstand any form of scrutiny whatsoever. It certainly can\u2019t withstand mockery. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Proponents of gender ideology understand that very well. So in order to ensure that this incoherent ideology survives, they know that it\u2019s vital to enact blasphemy laws. Parody and criticism aren\u2019t allowed. That\u2019s pretty much what they\u2019re doing here. Read further in the complaint, and that becomes very obvious.<\/span><\/p>\n<p><span style=\"font-weight: 400\">For instance, here\u2019s another allegation in the complaint. According to the complaint, he: \u201ctweet[ed], \u2018Pronouns suck.&#8217;\u201d Now, the tweet could be more specific. In fact, pronouns don\u2019t suck. Pronouns didn\u2019t do anything wrong. Let\u2019s not blame this on pronouns. What sucks is the idea that people get to choose their own pronouns. And that\u2019s obviously what Musk was referring to. If a pronoun wants to sue him for slander, maybe it would have a case. But an employee citing it in a lawsuit is a joke. An unintentional joke, unlike the jokes that they\u2019re suing over.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In fact, not only does this complaint seek to ban criticism or mockery of gender ideology. It also seeks to outlaw criticism or mockery of the tactics that these zealots are using to enforce their ideology. Again, from the complaint against Musk: \u201cIn response to news about a sexual harassment charge against him, Musk post[ed], \u201dFinally, we get to use Elongate as scandal name. It\u2019s kinda perfect.&#8217;\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">You can practically see these former SpaceX employees with their arms crossed, in their lawyer\u2019s office, explaining how offended they were by all of this. Not only was Musk making jokes they didn\u2019t like \u2014 he was also mocking their attempts to slander him.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Indeed, Musk was even mocking some of their favorite buzzwords. And they can\u2019t stand that. That\u2019s why the lawsuit also faults Musk for posting this meme:<\/span><\/p>\n<div id=\"attachment_752007\" style=\"width: 724px\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-752007\" class=\"wp-caption-text\">Screenshot: X\/Twitter<\/p>\n<\/div>\n<p><span style=\"font-weight: 400\">It reads: \u201cLadies. Mansplaining, is short for \u2018Man Explaining.&#8217;\u201d You see, the joke is that he\u2019s mansplaining the definition of mansplaining. This apparently contributes to a hostile work environment, somehow, which forces me to mansplain to the people filing the lawsuit that making fun of mansplaining does not make your work environment \u201chostile.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">But the lawsuit doesn\u2019t stop there. It also faults Musk for thinking that Monty Python is funny. The complaint states: Musk \u201cpost[ed] a photo from a Monty Python movie with subtitle \u2018Biggus Dickus.&#8217;\u201d Yes, he posted a photo from a Monty Python movie. That\u2019s not allowed anymore. Quoting the \u201cLife of Brian\u201d creates a hostile work environment.<\/span><\/p>\n<p><span style=\"font-weight: 400\">So this is obviously a demented lawsuit. It\u2019s a complete waste of time. And I\u2019m not cherry-picking here. The whole thing is this bad. For example, here are some allegations by former employee Claire Mallon. See if you can spot the problem here:<\/span><\/p>\n<blockquote>\n<p><i><span style=\"font-weight: 400\">Mallon also faced gender discrimination at work. In her 2018 performance evaluation, her manager criticized her for being too \u2018coarse\/straightforward.\u2019 In her 2019 evaluation, Mallon was told to \u2018absorb feedback cheerfully.\u2019 This was a double standard applied to Mallon because of her gender, as Ms. Mallon never observed men criticized for being straightforward or for not taking feedback cheerfully enough.<\/span><\/i><\/p>\n<\/blockquote>\n<p><span style=\"font-weight: 400\">In other words, this woman received negative feedback, and she didn\u2019t personally see men being criticized in the same way. Therefore, it must have never happened, because obviously, nothing ever happens at SpaceX unless Claire Mallon sees it herself. Now you might point out that performance reviews are conducted privately so Mallon couldn\u2019t possibly have any idea what anyone else is being told in their review. But if you say that, you\u2019re mansplaining, and now you\u2019ve victimized poor Ms. Mallon a second time.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Another ex-employee, Paige Holland-Thielen, makes the same non-argument. According to the complaint, Holland-Thielen:<\/span><\/p>\n<blockquote>\n<p><i><span style=\"font-weight: 400\">\u2026expressed frustration about being routinely assigned rotations on the support or operations team within ground software instead of development roles, lead Kyle Hosford gave her the feedback that she was too aggressive. This was a double standard because of Holland-Thielen\u2019s gender. She never observed men being criticized for being too aggressive.<\/span><\/i><\/p>\n<\/blockquote>\n<p><span style=\"font-weight: 400\">Again, if she didn\u2019t see it, it didn\u2019t happen. That\u2019s the idea. No man has ever been criticized for aggressiveness. It has never happened, because this woman didn\u2019t see it. If a tree falls in the forest and Paige Holland-Thielen isn\u2019t there to hear it, did it make a sound? No. Of course not. In fact, the tree doesn\u2019t even exist if Paige didn\u2019t see it.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Now, I\u2019ll admit that I\u2019m not a lawyer, nor am I up to date on the finer points of California labor law. But after reading this complaint, I can make a few determinations with a fair degree of confidence. First of all, \u201chostile work environment\u201d claims are completely out of control. The law that permits these kinds of claims obviously needs to be reworked or abolished. It\u2019s simply too easy to collect a bunch of jokes together and claim to be offended by them and then file a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/remember-the-bakery-falsely-accused-of-racism-by-oberlin-college-students-its-still-waiting-for-its-millions-of-dollars\/\" title=\"Remember The Bakery Falsely Accused Of Racism By Oberlin College Students? It\u2019s Still Waiting For Its Millions Of Dollars.\">multi-million dollar lawsuit<\/a>, especially in a Left-wing jurisdiction like Los Angeles. Humor is not illegal in this country. Criticizing pronouns and trans ideology is not illegal, either. But through lawsuits like this, humor \u2014 and other normal workplace interactions \u2014 are effectively being outlawed.<\/span><\/p>\n<p><span style=\"font-weight: 400\">On its website, the Equal Opportunity Employment Commission explicitly <\/span><a href=\"https:\/\/www.eeoc.gov\/harassment\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">states<\/span><\/a><span style=\"font-weight: 400\">  that \u201coffensive jokes\u201d can indeed constitute violations of the law. Whenever Bidens\u2019 administration is out of office, some changes need to be made here, because this has obviously gone too far. That\u2019s why we\u2019ve seen this form of lawfare repeatedly in recent years.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Just a year ago, there was that lawsuit filed by a Fox producer Abby Grossberg against Tucker Carlson and Fox News. Grossberg\u2019s complaint was full of jokes that she heard in the office which she claims she found offensive. From Grossberg\u2019s interviews on Left-wing cable news channels, it\u2019s apparent that one gag in particular really bothered her \u2014 the pictures of Nancy Pelosi that she says were \u201cplastered\u201d around the office. Watch:<\/span><\/p>\n<\/p>\n<p><span style=\"font-weight: 400\">This is what\u2019s known as \u201cbanter.\u201d They\u2019re joking around about a picture that millions of people were already joking about. But none of that matters because Grossberg says she was bothered by it. Add that to a zillion other similar complaints, and you get a \u201chostile work environment\u201d and a settlement worth millions of dollars. As a side note, you may have noticed that it seems so often to be women who are behind these complaints. Space X is trying to go to Mars and Elon has to deal with a bunch of women crying because their feelings were hurt by a tweet. The funny thing is that these women are ostensibly doing this in order to defend the rights of women in the workplace. But all they have really succeeded in doing is reinforcing every negative stereotype of women in the workplace.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Anyway, these kinds of complaints are becoming more common in part because the media always pretends to take them seriously, even when they make no sense. Take for example the complaint about a \u201ctoxic\u201d work environment at Jimmy Fallon\u2019s show. This complaint hasn\u2019t materialized into a lawsuit, at least not yet. But it was still presented by media outlets as evidence that Jimmy Fallon\u2019s workplace is hostile and oppressive. Watch:<\/span><\/p>\n<\/p>\n<p><span style=\"font-weight: 400\">Not that this needs to be stated, but a boss having \u201cgood days\u201d and \u201cbad days\u201d does not make the workplace \u201chostile\u201d or \u201ctoxic\u201d. That\u2019s what bosses do, at least until they\u2019re replaced by robots. This shouldn\u2019t even be a news story at all. But here, the media is trying to sell these claims as proof that Fallon\u2019s show is dysfunctional or \u201ctoxic.\u201d So Fallon had to grovel and apologize. And as you heard in that clip, there are many similar claims about many other shows. <\/span><\/p>\n<p><span style=\"font-weight: 400\">This is one of the main reasons that corporations are all producing homogeneous, uninteresting products now. It\u2019s why comedy is dead. It\u2019s why film, television, and video game companies are shoving diversity casting down our throats, along with \u201csocial justice\u201d plotlines. Any corporation that so much as makes a joke that a woman finds offensive could end up facing a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/peta-defends-pro-life-activist\/\" title=\"PETA Defends Pro-Life Activist\">multimillion-dollar lawsuit<\/a>. The clear incentive is to be dull, unoriginal, and uninteresting.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This is how destructive lawfare can be. It\u2019s not just about jailing your preferred presidential candidate. It\u2019s also a cancer on every other aspect of society. That\u2019s why this is happening all over the place, not just Fox or SpaceX. Ask Activision Blizzard or Amazon or Tesla or McDonald\u2019s or Blue Origin or Google or any number of other companies that have allegedly hosted a \u201ctoxic\u201d or \u201chostile\u201d workplace. If you have a large enough company or organization, you\u2019re going to eventually hire Left-wing activists and useless people, and then you\u2019re going to get these claims. That\u2019s why even Jimmy Fallon is getting them.<\/span><\/p>\n<p><span style=\"font-weight: 400\">No one is immune because none of the factual details really matter when there\u2019s a \u201chostile work environment claim\u201d to be made. The only thing that\u2019s important is for one person to say she\u2019s offended by things that no sane person would actually be offended by. The lawyers will take it from there.<\/span><\/p>\n<p><span style=\"font-weight: 400\">If you own a business, you should be doing everything you can to ensure you\u2019re not hiring employees who will end up trying this dishonest tactic against you. You have no other option. In the meantime, if we want more companies like SpaceX \u2014 companies that take risks and actually accomplish things \u2014 then the law needs to change.
