In truth, the \u2064Supreme\u2063 Court only dismissed the Alliance for\u200b Hippocratic Medicine&#8217;s challenge, stating that the party lacked\u2064 standing.\u200b This technical decision was based on the involvement and harms claimed by the\u200b challenging party, without \u2064addressing the substantive arguments against mifepristone&#8217;s approval. Although reported as a victory for\u2063 abortion \u200caccess, the\u2062 court&#8217;s decision did\u200c not \u200brule on the merits of \u200bthe case, leaving the possibility for future challenges open.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>Numerous media outlets erroneously reported the Supreme Court \u201c<a href=\"https:\/\/myfox8.com\/news\/politics\/washington-dc-bureau\/supreme-court-rules-in-favor-of-abortion-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled in favor<\/a>\u201d of access to the abortion pill mifepristone, but in reality <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-235_n7ip.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">the court<\/a> dismissed the case without addressing the merits of pro-life activists\u2019 argument, opening the door to future challenges. <\/p>\n<p>The reports follow the conclusion of the FDA\u2019s appeal to the Supreme Court against the Alliance for Hippocratic Medicine\u2019s (AHM) challenge to mifepristone\u2019s approval. A U.S. District Court had suspended the approval, but the Supreme Court reversed their ruling.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-280991738\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-f5e82642515ecdf18ba98a966d33b0a9 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-f5e82642515ecdf18ba98a966d33b0a9\"><\/div>\n<p>Attorney Andrea Picciotti-Bayer, director of <a href=\"https:\/\/conscience-project.org\/about\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Conscience Project<\/a>, explained that the technical decision related to the parties legally involved, rather than the substance of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/thursday-november-4th-2021\/\" title=\"Thursday | November 4th, 2021\">pro-life argument<\/a>. <\/p>\n<p>\u201cIn many respects I can understand and I appreciate the value [of] the main point of the opinion, which had nothing to do with the FDA shenanigans and everything to do with judicial restraint,\u201d Picciotti-Bayer told The Federalist in an interview.<\/p>\n<p>A variety of media outlets amplified the decision as \u201ccertainly a win\u201d for abortion access, as claimed by Planned Parenthood Medical Officer Colleen McNicholas in <a href=\"https:\/\/www.msnbc.com\/ana-cabrera-reports\/watch\/-today-is-certainly-a-win-for-abortion-access-supreme-court-allows-pill-to-stay-on-market-212908613691\" target=\"_blank\" rel=\"noreferrer noopener\">an appearance<\/a> on MSNBC.<\/p>\n<p>An ABC affiliate <a href=\"https:\/\/www.wftv.com\/news\/supreme-court-rules-favor-access-abortion-pill\/bcef9233-2033-4f85-8494-e423e802f6ec\/\">reported<\/a> in Washington, D.C., that the \u201cSupreme Court rule[d] in favor of access to abortion pill,\u201d billing the Court\u2019s opinion as a setback for the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/covid-has-killed-her-hundreds-of-thousands-but-abortion-has-killed-her-tens-of-millions\/\" title=\"COVID Has Killed Her Hundreds of Thousands, But Abortion Has Killed Her Tens of Millions\">pro-life movement<\/a>.<\/p>\n<div class=\"fdrlst__b89e9-e0cd4b9a0ca0e7ccb19e9d9f6d534aca fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-e0cd4b9a0ca0e7ccb19e9d9f6d534aca\"><\/div>\n<p>The Washington Bureau of <a href=\"https:\/\/myfox8.com\/news\/politics\/washington-dc-bureau\/supreme-court-rules-in-favor-of-abortion-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">Fox 8 also called the ruling<\/a> a victory for abortion advocates,\u201d stating that the \u201cSupreme Court rule[d] in favor of abortion rights.\u201d <\/p>\n<p>The ruling, however, was not a \u201cblow for anti-abortion advocates\u201d or a rejection of their objections to mifepristone, as <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-rejects-bid-restrict-access-abortion-pill-rcna151308\" target=\"_blank\" rel=\"noreferrer noopener\">reported by NBC<\/a>.  <\/p>\n<p>Understanding of the case hinges on a distinction between a ruling on whether a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republicans-pounced-on-kyrsten-sinema-bathroom-confrontation-joy-reid\/\" title=\"Republicans \u2018Pounced\u2019 On Kyrsten Sinema Bathroom Confrontation: Joy Reid\">party involved<\/a> has legal standing to participate in the lawsuit, and a ruling on the merits of the arguments in play. The court did not evaluate the validity of AHM\u2019s objections to the FDA\u2019s approval of mifepristone. Instead, it determined that AHM lacked standing to sue because they do not prescribe or use mifepristone, and do not allege direct monetary, property, or physical injuries.<\/p>\n<p>\u201cThe plaintiffs have sincere legal, moral, ideological, and policy objections to elective abortion and to FDA\u2019s relaxed regulation of mifepristone,\u201d Justice Brett Kavanaugh, a Trump appointee, <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-235_n7ip.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> in the Court\u2019s ruling. \u201cBut under Article III of the Constitution, those kinds of objections alone do not establish a justiciable case or controversy in federal court.\u201d<\/p>\n<div class=\"fdrlst__b89e9-b3a4effbe9420b71a45db5f327413252 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-b3a4effbe9420b71a45db5f327413252\"><\/div>\n<p>Numerous legal commentators have said that the ruling leaves the door open for more lawsuits fighting access to the abortion pill. <\/p>\n<p>Idaho, Kansas and Missouri will continue this legal battle and attempt to establish standing, according to Attorney Kristen Waggoner, who represented the AHM in Supreme Court oral arguments. This could provide an opportunity for the court to evaluate and strike down the FDA approval that \u201crecklessly removed commonsense safeguards\u201d on mifepristone, Waggoner <a href=\"https:\/\/www.npr.org\/2024\/06\/13\/nx-s1-5004679\/scotus-upholds-mifepristone-access-whats-next-for-the-anti-abortion-movement\" target=\"_blank\" rel=\"noreferrer noopener\">said\u00a0in an interview<\/a> with NPR.<\/p>\n<p>Mifepristone is a drug that instigates a chemical abortion, which accounted for <a href=\"https:\/\/www.guttmacher.org\/2024\/03\/medication-abortion-accounted-63-all-us-abortions-2023-increase-53-2020\" target=\"_blank\" rel=\"noreferrer noopener\">nearly two-thirds<\/a> of abortions last year. The drug has led to the death of dozens of women and serious side-effects, including hemorrhaging and severe infection, in thousands more since 2022, <a href=\"https:\/\/www.fda.gov\/media\/164331\/download?attachment\" target=\"_blank\" rel=\"noreferrer noopener\">according to FDA data<\/a>.
